days of filing the subdivision application notifying the public of the following:
1) The nature of the application;
2) The proposed number of lots;
3) The size of the property;
4) The tax map key or keys of the property;
5) That they may contact the Planning Department for additional information; and
6) The address and telephone number of the Planning Department,

Notwithstanding any other provisions of law, the sign shall be not less than nine (9) square feet and not
more than twelve (12) square feet in area, with letters not Tess than one (1) inch high. No pictures,
drawings, or promotional materials shall be permitted on the sign.
The sign shall be posted at or near the property boundary adjacent to a public road bordering the property
and shall be readable from said public road. If more than one public road borders the property the
subdivider shall post the sign to be visible from the more heavily traveled public road. The sign shall, in all
other respects, be in compliance with Chapter 3, Hawai'i County Code 1983 (2005 Edition).
The subdivider shall file an affidavit with the planning department not more than five (5) days after posting
the sign stating that a sign has been posted in compliance with these requirements, and that the subdivider
and its agents will not remove the sign until the application has received final subdivision approval, or that
such application has been rejected or withdrawn. A photograph of the sign in place shall accompany the
affidavit.
The sign shall remain posted until final subdivision approval is issued, or until the application has been
rejected or withdrawn. The subdivider shall remove the sign promptly after such action.

We notice that the preliminary plat map does not fully conform to the minimum requirements of the
Subdivision Code. Some of the items missing include:
1. Acreage of proposed subdivision;
2. Zoning upon adjacent parcels, show zoned district boundaries;
3. Vicinity map; and
4. The approximate location within the subdivision and in the adjoining streets and property of existing

The following is submitted as a follow-up to our discussion and as a formal submittal of our request
to revise the subject subdivision.
Background
L.C. Aw. 1-0, Ap. 2 to Paaluhi was shown on a title map prepared by A.J. Williamson in 1932. The
location is the same as shown on the original Papaikou Farm Lots Subdivision prepared by the R.M.
Towill Corporation. A copy of a portion of the title map is enclosed for your perusal.
Security Title raised a question regarding the location of the kuleana since the call for an adjoinerwould
place the kuleana adjacent to L.C. Aw. 4734 which is below the current location as shown on
Williamson's title map.
Either L.C. Aw. 4734 is plotted incorrectly or L.C. Aw. 1-0, Ap. 2 is not placed in the proper Location.
The current and older tax maps also shows the subject kuleana in the location shown by Williamson.
In 1976, a complaint was filed in the Third Circuit Court, Civil No. 4118 to quiet title to TMK: 2-7-12:
10 in which the L.C. Aw. 1-0, Ap. 2 was noted as being a portion of the parcel.
The action was dismissed without prejudice. The significance of the action was that the plaintiff
thought that L.C. Aw. 1-0, Ap.2 was within TMK: 2-7-12: 10.
Request for Revision
Based on the preceding, we are requesting that Lot 41 of Papaikou Farm Lot Subdivision be revised
to eliminate any reference to L.C. Aw. 1-0, Ap.2 since the location of the kuleana cannot be accurately

determined. The removal of the kuleana would remove any questions regarding title and location.

subdivision, conforming to Standard Detail R-39.
8. Submit construction plans and drainage report for
review and comment.
a. Additional storm runoff due to development shall
be disposed within the subdivision and shall not
be discharged onto adjacent properties or
roadways. For planned drywells, satisfy
Department of Health (DOH) drywell requirements,
including issuance of an underground injection
control (UIC) permit to the subdivider.
b. Install streetlights/signs/pavement markings as
required by the Traffic Division, Department of
Public Works.
9. Submit written proof that all taxes and assessments on
the property are paid to date.
10. Place property markers in accordance with the final
plat map. Surveyor shall submit certification upon
completion.
11. Submit nine (9) copies of the final plat map prepared
in conformity with Chapter 23, Subdivisions, within one
year from the date of tentative approval, on or before
August 26, 1999. If not, tentative approval to the
preliminary plat map shall be deemed null and void.
Only upon written request from the subdivider and for a
good cause can a time extension be granted, provided it
is submitted forty-five (45) days before the expiration
of said period of one year.
12. Subdivider shall complete all requirements specified as
conditions for tentative approval of the preliminary
plat map within three (3) years of said tentative
approval, on or before August 26, 2001. An extension
of not more than two (2) years may be granted by the

Please be informed that tentative approval of the preliminary plat map dated August 2, 1996, is
hereby granted with modifications and conditions.
The subdivider is now authorized to prepare detailed drawings of the subdivision plan in
accordance with Chapter 23, Subdivision Control Code, County of Hawaii, as modified. Before
final approval can be granted, the following conditions must be met:
1. Final plat map shall reflect all easements required by the Department of Water
Supply.
2. Identify top -of -bank of stream or gulches and identify areas within as "approximate
areas of flood inundation."
3. Submit written proof that all taxes and assessments on the property are paid to
date.
4. Place property markers in accordance with the final plat map. Surveyor shall
submit certification upon completion.
5. Submit nine (9) copies of the final plat map prepared in conformity with
Chapter 23, Subdivisions, within one year from the date of tentative approval, on
or before October 8, 1997. If not, tentative approval to the preliminary plat map
shall be deemed null and void. Only upon written request from the subdivider and
for a good cause can a time extension be granted, provided it is submitted forty-
five (45) days before the expiration of said period of one year.

6. Subdivider shall complete all requirements specified as conditions for tentative
approval of the preliminary plat map within three (3) years of said tentative
approval, on or before October 8, 1999. An extension of not more than two (2)
years may be granted by the director upon timely written request of the subdivider.
As part of final plat map submittal, the Planning Director requests an additional copy of the final
plat map be submitted as a ".dwg" or ".dxf' diskette file prepared by CAD software.
You should be aware that if at any time during the fulfillment of the foregoing conditions, that
environmental and/or problems emerge; problems which were earlier overlooked or not
anticipated/accounted for in data/reports available to date, this should be sufficient cause to
immediately cease and desist from further activities on the proposed subdivision, pending
resolution of the problems. The Planning Director shall confer with the listed officers to resolve
the problems and notify you accordingly.
No final approval for recordation shall be granted until all the above conditions have been met.
Land shall not be offered for sale, lease or rent until final approval for recordation of the

conforming to Department of Public Works Standard Detail
R-34 with horizontal and vertical alignment based on 30 mph
design speed from Mamalahoa Highway to the western -most
boundary of the subdivision.
7. Submit construction plans and drainage report for review
and comment. Provide street lights as required by the
Traffic Division.
8. Place property markers in accordance with the final plat
map. Surveyor shall submit certification upon completion.
9. Submit nine (9) copies of the final plat map within one
year from the date of tentative approval. If not,
tentative approval to the preliminary map shall be deemed
null and void. Only upon written request from the
subdivider and for a good cause can a time extension be
granted, provided it is submitted forty-five (45) days

the foregoing conditions that environmental problems emerge --
problems which were earlier overlooked or not anticipated/
accounted for in data/reports available to date --this should be
sufficient cause to immediately cease and desist from further
activities on the proposed subdivision, pending resolution of the
problem(s). The Planning Director shall confer with members of the
Subdivision Technical Review Committee or other concerned agencies
to resolve the problem and notify you accordingly.

readjustment of forty-two (42) lots of record. Our previous map is based on
thirty-four (34) lots of record.
A research of the documents at Mauna Kea Sugar Company's land office and
the Bureau of Conveyances has disclosed the existence of an eight (8) lot sub-
division called "Spanish Camp". Since the lots have been repurchased by
Mauna Kea Sugar Company we have consolidated said "Spanish Camp" with the
previous thirty-four (34) lots of record and resubdivided into forty-two (42)
lots.

posed readjustment of boundaries. Also enclosed is a check in the amount of
ONE HUNDRED TWENTY DOLLARS ($120.00) for filing fee with the subdivision ap-
plication.
The proposed readjustment of boundaries will result in thirty-four (34)
lots that conform to present county zoning regulations and all lots provided
with access to the Hawaii Belt Highway. The proposed Lot 10 will not conform
to present county zoning regulations, however, it will provide TMK: 2-7-04: 30
which is presently landlocked) with access since said TMK will be dropped
into proposed Lot 10. The owner of TMK: 2-7-04: 30 will increase the present
area of 3.12 acres to 11.2 acres which will be in closer conformity with county
zoning regulation for Ag-20.
The proposed lots will continue to utilize existing roadways and maintain
existing access connections to Hawaii Belt Highway.
