NATURE OF APPLICATION: This is an application for an original Dispenser General liquor license, Category B 1. CATEGORY BI: Category 131 allows the licensee to provide recorded music and live entertainment within its licensed premises. APPLICANT: The applicant, Tun Hawaii LLC, is a domestic limited liability company, registered with the Department of Commerce and Consumer Affairs, State of Hawaii, on May 1, 2024. A unisex restroom is available for customers and employees within the proposed licensed premises. The entrance to the proposed licensed premises is through the unlicensed retail storefront located off Kilauea Avenue. Upon entering, there is a small retail space which will offer drink -related items such as glassware, flasks, shot glasses, and accessories. The retail space will also partner with other small local vendors, including bakers and craft businesses, to sell their products. Within the retail space is a door labeled "office" which leads back into the speakeasy/proposed licensed premises. Applicant will offer seated service, in tinned 90-minute intervals, with a two -drink minimum in place for all guests. Reservations may be made online and secured with a credit card. Applicant plans to sell craft cocktails and mocktails and offer small pairings to complement their drinks that are sourced from local producers such as Mahiai Made (chocolate), Liko Lehua (lilikoi butter), Sweet Bean Vanillary ('uala chips), and Ka`awaloa Food Supply (chili pepper water) . Applicant will be open four (4) days a week, Thursday through Sunday, from 5:00 p.m. — 10:00 p.m. The retail storefront will remain open during the hours of speakeasy operation and will serve as a reception area where guests will be received, reservations confirmed, and ID's will be checked prior to entry through "office" door. Applicant plans to have two employees, both of whom will be certified by the Department of Liquor Control to supervise the sale, service and consumption of liquor. Applicant plans to have regular low -volume recorded music and occasional karaoke or live entertainment in the form of a soloist. STOREFRONT LEASE AGREEMENT: This Storefront Lease Agreement ("Lease") made by and between BLANCHE LOKEMELE DAVIS, Trustee under the Revocable Trust Agreement of Blanche Lokemele Davis (``Landlord") and Tun Hawaii LLC, (``Tenant"), with the term of said Lease commencing on March 1, 2026 and ending on February 28, 2027. Tenant shall have one (1) option to extend this Lease for twelve (12) consecutive months. ZONING: Downtown Hilo Commercial. SURROUNDING AREA: Survey of the surrounding area reveals that there is one church, The Salvation Army, located within 500 feet of the proposed licensed premises. We are the tenants and applicants for Regulatory Inspection PW.RI2025-00023 at 81-6641 Hawaii Belt Road. During the County Building Division review, we were informed on February 11, 2026 that a change of use and alteration permit would be required because two non-structural walls had been removed. This required us to hire a licensed architect and prepare the necessary design and permit documents before the remaining regulatory inspection iterns could be completed. After that requirement was identified, Reel Aloha Poke and Fish Co. promptly contracted with an architect. The design and permit preparation process took additional time, and building permit application PW.B2026-001448 was submitted on April 24, 2026. Since then, we have continued working through the County and State review process in good faith. As of June 2, 2026, all other review agencies have completed their reviews for the building permit. We are currently awaiting final review by the Department of Health Wastewater Branch and the Department of Health Food Safety Branch. Once those remaining reviews are completed and the building permit is issued, we will move forward with the remaining steps needed to finalize the regulatory inspections and activate the liquor license. Because the delay was caused by the required change of use and alteration permit, including architectural design and agency review, we respectfully request that the Commission find good cause to grant a one-year extension. This extension will allow the pending building permit review to be completed and will allow us to proceed with final inspections as soon as the permit is issued. Waltjen Director Pursuant to Section 2-100(b) of the Hawai ` i County Code 1983 (as amended), the following report is submitted for the National Alcohol Beverage Control Association ("NABCA") 89th Annual Conference held May 17-21, 2026, at the JW Marriott Desert Ridge Hotel, Phoenix, Arizona. National Alcohol Beverage Control Association (NABCA) background NABCA is a national association that was founded in 1938. NABCA's mission is to support alcohol compliance efforts that: 1) protect public health and safety; and 2) ensure responsible and efficient systems for alcohol beverage distribution, sales, and service. NABCA provides research, analytics, and alcohol regulatory information to organizations and agencies responsible for alcohol compliance/enforcement. There were approximately 700 attendees from the United States, Mexico, Canada, and Europe gathered for this event. The theme for the conference was: 1) how to inspire change within organizations and systems; and 2) how to adapt to the global changes occurring in the liquor industry. The format of the conference consisted of general sessions open to all attendees, concurrent workshops, and invitation only business meetings for NABCA. Hawaii County is an Equal Opportunity Provider and Employer Mayor Alameda Page -2- June 2, 2026 Workshop: Navigating the Latest Legislative Trends: Impacts on Alcohol Regulation and Policy This workshop was extremely helpful and useful because it focused on the most pressing legislative developments affecting the alcohol industry. The workshop provided: 1) updates on federal and state - level alcohol legislation; 2) emerging regulatory challenges facing the alcohol industry; 3) insight on how broader shifts in policy trends, including cannabis and hemp regulation, may influence alcohol markets. Budget pressure is a major factor for some of the legislative changes (increasing alcohol taxes to increase revenues). Marijuana and THC products and popularity are another factor. For states that are responsible for both alcohol and tobacco regulation flavored vapes are back, once again raising concern that youth are being targeted. Alcohol marketing on social media is also prompting legislation to ensure that minors are not being targeted. The prevalence of Kratom and other additives (synthetic or natural) are also prompting legislation to make those products regulated and/or age restricted. For enforcement, there are more states moving to lower the impaired driving limit (i.e. lowering BAC levels from .08 to .04 or .OS) and the need to train law enforcement on more than just alcohol impairment. Impaired drivers are impaired due to a combination of alcohol and prescription or illegal drugs/substances. This workshop was moderated by Terrance Merriweather, Director of Public Policy for NABCA, and the panelists consisted of Buddy Buckner, General Counsel for NABCA, and Harrison Martingayle, Associate General Counsel for NABCA. Workshop: Modernization and Innovation that Deliver This session was concurrent with Workshop I and focused on how to engage NABCA as a strategic partner in liquor industry modernization and innovation. This session showcased faster cross stakeholder coordination through the NABCA Logistics Committee portal, measurable data processing enhancements from business process automation, and an overview of NABCA's product focused, customer value -based framework to prioritize and measure innovation. General Session I: The Art of Navigating Change with Erik Wahl, Synthesizer of Art and Business This was the keynote speaker and he did not disappoint! He used to work in the corporate business world and the economy burst in the 2000s. Losing everything, he had to come up with a way to support himself and his wife and kids. Instead of giving up, he adapted and changed and returned to his childhood passion (art) and became a public speaker on adaptation and change. The session description was that change is no longer something to prepare for, it's something we live inside every day. While he spoke to the audience he painted on stage. While he painted there were different genres of music and videos playing. What he was painting wasn't always clear in the beginning but it underscored the words he spoke and the theme of his keynote. His words, "the purpose of art is not to create a product. It is to create thinking. Do not be afraid." His message, "Change your definition of success. No longer about the, financial success. Be present in the moment, with the ones you love." C C_ Mayor Alameda Page -3- June 2, 2026 While he mesmerized with his words, paint, music, and video montages he created three portraits (Michael Jordan, Statute of Liberty, and Albert Einstein) as he explained that leaders and teams need to rethink how they respond to uncertainty, disruption, and rapid transformation. They need to let go of outdated thinking, embrace adaptability, and approach change with creativity and confidence. Turn complexity into clarity and uncertainty into opportunity. General Session II: Seven Leadership & Life Lessons with Susan O'Malley, Former President of the Washington Sports and Entertainment & First Female President of a Professional Sports Franchise The second keynote speaker (or as she labelled herself, "Keynote Speaker 1 b") kept with the overall theme of adapting to change and fostering change in a positive manner. Her presentation was a stark contract to that of Mr. Wahl. O'Malley's presentation did not have the visual effects or digital media but it was equally compelling and engaging. She was funny, genuine, and inviting. On stage, with just herself and a microphone she shared her warm sense of humor in a folksy style. She told entertaining stories to make her lessons memorable. O'Malley was the first female president of an NBA franchise (Washington Bullets) at the age of 29. She described how she was influenced by her family and familial experiences. Sitting around the kitchen table listening to parents and grandparents discuss the struggles and triumphs of life and work was one of the most vital learning experiences for her. By focusing on the lessons of her childhood and then reinforcing them with her proven business expertise, O'Malley offered insights for all attendees. O'Malley outlined the seven seminal `rules' for leadership and life and shared insider stories about entertainment, hockey, and basketball. Here seven rules were as follows: l . Make your bed every day. Motion creates motion. If you can't do small things right how do you get the big things right? Also, if you have a bad day, it's nice to come home to a made bed. 2. Plan your work. Work your plan. Don't confuse activity for achievement. 3. Keep working on your craft. Learned from Dallas and Chicago and Boston. Larry Bird still looking for ways to improve, taking hundreds of shots before the game when no one else is around. Even Michael Jordan. If I get nervous you'll never know. I want the last shot. I practice that shot every day and its muscle memory. I will not miss that shot. 4. Set expectations. Tell me what I should expect. With Washington we started the lst internship program for college students. Had an army of college students working for us. Had an intern cheering for the visiting team once. I had to talk to that intern. The intern said that nobody told me I had to cheer for the Bullets. He had a point. After that, it was made clear to the entire organization and staff, always cheer for the home team. 5. When you mess up, make it right. My father would have a question of the night at the dinner table. What would you do if you won the million -dollar lottery? People understand you'll mess up, they want to know how far you will go to make it right. 6. Have fun. If you enjoy what you're doing you'll do better at it. 7. It's all about people. It's about human capital. You can affect attitude and effort. Her presentation was entertaining, inspiring, and uplifting. Mayor Alameda Page -4- June 2, 2026 Workshop: THC Perspectives — Getting Down in The Weeds This workshop explored the many viewpoints shaping the legal cannabis ecosystem (regulation and compliance, distribution and sales, as well as health and safety). We gained practical, multi -stakeholder understanding of how competing priorities, opportunities, and constraints influence business decisions and policy outcomes across the legal cannabis sectors. We rotated between three 30-minute presentations with guided Q&A through each perspective from: 1) the spirits industry; 2) the cannabis industry; and 3) the public health sector. Getting Down in The Weeds: Spirits Industry The Sprits Industry panel wants THC regulated like alcohol. They want a level playing field so that everyone can compete fairly and have the same change at business success. They want it taxed like alcohol. The spirits industry, through DISCUS and WSWA have issued public position statements. Getting Down in The Weeds: Hemp Industry The Hemp Industry panel wants clear rules and regulations. They want to legitimize their operations. They are willing to be taxed, if the taxes are reasonable and fair. They are still trying to figure out the dosage amounts for THC beverages. They are trying to determine the potency of THC in regard to consumption and effects of impairment. It does not fit into the alcohol by volume standard in the liquor industry. Getting Down in the Weeds: Public Policy The Public Policy panel consisted of a psychotherapist, public policy expert, and a veteran police officer. They examined regulation, enforcement strategies, community health, and the broader safety impacts of cannabis legalization. This panel wants to either prohibit THC alcohol products completely or have specific, comprehensive rules and structure to regulate it. Beverages are a large part of the THC industry. The psychotherapist felt these products are unsafe and need strict regulation. There are 26 different variations of cannabinoids (synthetics). Lots of fraud about source of THC. What is in synthetic cannabinoids? Heavy metals still in finished product. This byproduct is toxic. Heavy pesticides, yeast, mold, mercury, lead, being found in test samples, especially products from China. THC beverages do not have the same regulations as alcohol advertising. There is greater THC use, especially amongst teenagers. The data on cross consumption of alcohol and marijuana shows that 30% of the individuals that use marijuana have cannabis use disorder. Daily use of alcohol is 11 %. 42% use THC daily. 5.1 % teenage use THC daily. 1 % teenage use alcohol daily. The hemp industry also refer to a serving as a "dosage" to make it seem more medically grounded. There are many legal challenges and lawsuits ongoing. Class action lawsuit filed in 11 states (green leaf et al). Psychosis, failure to warn of health risks, misleading practices. Lawsuit of reschedule from 1 to 3. The rescheduling is invalid because it did not follow administrative process. Illegal to do it by executive order. THC is not a 3-tier product covered by the 21 st Amendment. Could claim it is not subject to 21 st amendment (alcohol) regulations and needs its own constitutional amendment. Mayor Alameda Page -5- June 2, 2026 General Session III: Leading a Switch with Dan Heath, Author and Podcast Host Sticking with the conference theme of change, the speaker for this session was more analytical than the previous two general session speakers. Mr. Heath's message was to help organizational leaders change things in tough times. His presentation was based around a picture of a small human rider on a huge elephant on a path. A variation of the psychological "elephant and rider" metaphor used by social psychologists to explain the three distinct parts of human psychology (The Rider --The Rational Brain, The Elephant —The Emotional Brain, The Path —The Environment). Mr. Heath wanted us to look at change situations in organizations. He commented that change leaders look at data but workers want things to stay the same if they work. Mr. Heath summarized his approach into three categories: 1) Direct the Rider; 2) Motivate the Elephant. (feeling and desire); and 3) Shape the Path (remove obstacles. Look at social culture.) DIRECT THE RIDER "People resist change." What looks like resistance is just a lack of clarity. Ambiguity is the enemy of change. Translate goals into behaviors. What is working and how can we do more of it? Are you on the lookout for bright spots? MOTIVATE THE ELEPHANT The # 1 mistake of leading change is trying to motivate people with info. Knowledge is not sufficient to spark change. If you want change, feeling is the fuel. Find the fuel! SEE, FEEL, CHANGE. Instead of analyze, think, change. Don't inform people about change. Boost their desire to change. SHAPE THE PATH Combination of social environment and physical environment. Behavior is contagious. But for behavior to be contagious it must be visible. You get what you celebrate. Make the right kind of behavior visible to make it contagious. Make right behaviors easier. Wrong behaviors harder. (i.e. smaller opening in trash receptacle so trays wouldn't be thrown away). When the path changes, people change. So, shape the path. Shape the path to prevent injuries. Make the right behavior the path of least resistance. Mr. Heath's session was very good with the content based on his book, Switch, which spent 47 weeks on the New York Times best-seller list. His simple, three-part framework to help you change things in tough times made a lot of sense and was easy to grasp. This session gave us the specific tools and the inspiration needed to make change happen. Mayor Alameda Page -6- June 2, 2026 Workshop: Ready -to -Drink Cocktails - What's Fueling one of the Only Growth Engines in Beverage Alcohol? This session focused on ready -to -drink (RTD) cocktails to determine why they have been so successful when overall alcohol sales across the nation have declined. This panel was an executive -level panel made up of four industry leaders. They discussed shifting consumer mindsets, evolving occasions, and the strategic tradeoffs their brands are making. Market research and study found that there is mega consumer desire for more interesting flavors. RTD is no longer a beer alternative. Within the past five years, the industry leaders have been building true brands, improving the quality of the beverage, so it has grown in popularity. People aren't afraid to spend $27.99 for a pack of RTD. Convenience is a big factor as well, not just for the consumer but for the industry workers as well. Six to seven years ago restaurants would not support a canned product. But products like High Noon and bartenders nowadays have changed that attitude. There is increased speed of service, easier to use canned RTD option. Crack open a can and charge $9 instead of having to mix a drink. Consumer convenience is a factor. It is EASY TO SHOP. Clear role for consumers, make it easy to find, as long as the industry makes it stand out on the shelves. RTD is easy to understand and high quality nowadays. Liquid, what is your product (customer can easily understand what they are buying), accessibility (right size at right price at right time). Are the consumers new drinkers or existing drinkers switching from spirits or other categories? Half and half. In the United States market, there are lots more casual drinking occasions. Less money in the consumers pocket to spend, so RTD fits that. RTD are also easier drinking, fruit flavors, so the 21 and older drinker... new drinker... going to RTD instead of beer. Beer is an acquired taste. Fruit, tea, and lemon flavors are very accessible. High Noon, was vodka soda, then added vodka lemonade, and now vodka tea. Looking at the next five years, the industry leaders do not see RTD slowing down or going away. They are realizing spirit margin profits on beer production costs. They are comfortable investing and developing the product because they have operated under the three-tier system for 100 years and that organization and structure provides stability. For RTD, there were 300 new brands launched in 2 years. 10 brands carried the category. In five years, there will be a massive clean-up. Some brands gone. Others will take off and be popular. Category could double. Seltzer is still the lion's share of the category. Some new variations is a sports drink inspired flavor RTD being worked on. There are other novelty products being developed as well, such as a Buzz Ball Jello Shot. Mayor Alameda Page -7- June 2, 2026 Workshop: Killing Headwinds - Pivotal Challenges Facing the Alcohol Industry This workshop focused on the decline in alcohol sales across the nation. This panel consisted of the leaders of alcohol industry beverage companies that have conducted studies and polls on the economy, consumer spending, and low and no alcohol beverages. The panel asked who is drinking less alcohol (is it Gen Z drinking less or other generations too), is there less drinking of alcohol, and will this downturn last forever? The panel opined that it is NOT just Gen Z drinking less, there is less drinking of alcohol (but not how we think), and how long this downturn will last remain to be seen. Consumers (Gen Z and other generations) are NOT switching to non-alcoholic (N/A) beverages or low - alcohol (L/A) beverages only, they are still consuming alcohol. The marketplace just has a greater variety of products and the consumers are enjoying the product diversity. Instead of grabbing two cases of Budweiser, they now get one case of Budweiser and one case of seltzer or N/A beer like Athletic. Because the N/A and L/A products have gotten better in quality and selection. The proliferation of GLP-1 medications has resulted in lower alcohol consumption, especially for the wine and spirits industry that had a large consumer base of "soccer moms". The quality and availability of RTD cocktails have also led to a decline in spirits and wine sales since you don't have to buy the individual ingredients anymore. The consumer is able to purchase a high quality, ready -to -drink cocktail at a reasonable price.
