KIND OF BUSINESS: Applicant will continue to operate as a bar and karaoke lounge serving local
pupus and bar food, including but not limited to fries, gyoza, small poke bowls, nachos, etc.
Applicant is open six (6) days a week, Wednesday through Monday, from 2:00 p.m. — 2:00 a.m. the
following day and closed on Tuesdays. Employment consists of approximately ten (10) employees, nine
(9) of whom are certified by the Department of Liquor Control to supervise the sale, service and
consumption of liquor.
Applicant currently has karaoke several times a week and occasional live music.
MANNER OF OPERATION: The current licensee, Pi Yon Cho, Inc. dba Joann's Restaurant &
Lounge (DG-673) has had no violations within the past five years and has operated in a reputable
manner.
ASSIGNMENT AND ASSUMPTION OF LEASE AND LESSOR'S CONSENT: This Assignment
and Assumption of Lease and Lessor's Consent, ("Assignment") was made as of the 22nd day of June
2026) by and between Pi Yon Cho Inc. ("Assignor"); Ash & Co Hospitality LLC ("Assignee"); and
WKSP Limited Partnership ("Lessor"). Assignor is the Lessee/Tenant as appropriate under that certain
commercial lease dated February 1, 2020, along with any amendments thereof (the "LEASE"), of the
property located at 88 Kanoelehua Ave., Unit B 108, Hilo HI 96720 (the "Premises").
Assignor desires to assign its interest and obligations in and to the Lease to Assignee effective on July 1,
2026 (the "Effective Date"), and Assignee desires to accept the assignment thereof and assume
Assignor's obligations thereunder from and after the Effective Date through and including January 31,
2030.
TEMPORARY LIQUOR LICENSE: A temporary liquor license was issued effective July 2, 2026.
ZONING: Industrial- Mixed Commercial.
SURROUNDING AREA: Survey of the surrounding area reveals that there are no churches and no
liquor licenses with the same class and kind located within 500 feet of the licensed premises, however,
there is one public charter school, Ka `Umeke Kd'eo, located within 500 feet of the licensed premises.
There is also a County facility, named the Waiakea Recreation Center, that is used extensively by the
community for youth Aikido, Judo, Kendo, Karate, Tae Kwon Do, etc., located within a 500-foot radius
of the licensed premises.
At the present time there are 64 of the same class and 58 of the same kind of liquor licenses being
lawfully exercised in the County of Hawai `i.
DETERMINING PROTESTS WITHIN 500 FEET OF A SCHOOL OR PLAYGROUND:
Section 281-39.5 of the Hawaii Revised Statutes, as amended, states in relevant part, "The liquor
commission... may deny or restrict the issuance of a liquor license for on -site sale and consumption by
the drink to any applicant whose establishment is or would be located within five hundred feet of a

minors, as determined by the liquor commission."
Section 281-39.5 of the Hawaii Revised Statutes, as amended, also states in relevant part, "...that the
liquor commission... shall deny the issuance of a liquor license if forty per cent of the registered
voters... owners and lessees of record of real estate and owners of record of shares in a cooperative
apartment within five hundred feet of the nearest point of the premises for which the licensed is asked;
have duly filed or caused to be filed their protests against granting the license."

will create a small, curated, speakeasy -style lounge experience within the existing retail space. Applicant
will offer a small cold -kitchen tapas menu, and plans on being open daily from 11:00 a.m. — 9:00 p.m.,
maintaining the same hours as its existing Retail General licensed premises.
Employment will consist of approximately three (3) employees, all of whom will be certified by the
Department of Liquor Control to supervise the sale, service, and consumption of liquor. The applicant
will ensure that all liquor rules and regulations regarding the sale and/or service of alcohol are followed.

Big Island Bottle Shop already runs a tasting program under its existing tasting permit.

Aloha Liquor Commission Chair Yadao, Vice Chair Okabe and Esteemed Commissioners.
We are writing to ask for an extension of one year for our liquor license. We had planned to build
the building using the agricultural exemption permit and all the way up to the liquor commission
meeting we had indication that our agricultural building permit would be sufficient. Even during our
hearing at the commission Director Takase hinted that he'd had some conversation with the building
department and felt positive for us.
We waited months and months for building to give us clear direction how to proceed. We emailed,
called and went into the county building more times than we can count. We even scheduled a
meeting with Building department acting director, Aaron Speilman. We still have not been given any
direction how to proceed except a it not sure the agricultural permit will work".
Now that nearly a year has passed we are frustrated and saddened by Our buildings delay. Our
steel building was delivered last summer. It's been sitting in our yard waiting. So, we can't wait for
the county to make the decision about our agricultural permit any longer. We will get the traditional
permit to build our building. This means in addition to the electrical engineer and mechanical
engineer we need a structural engineer, septic engineer, draft -person, and a contractor.
We have enlisted the help of our friend, Stacy Ojano, who will act as quarterback getting all the
engineers and permit for our build.
As soon as the county issues the permit we believe we can have the building up and inspected by
fire and health quickly.
We are sorry to be asking for an extension for one year. We'd much rather be in business.

SUBJECT: National Conference of State Liquor Administrators 2026 Annual Conference
June 14 - 17, 2026, New Orleans, Louisiana
Pursuant to Section 2-100 (b) of the Hawaii County Code 1983 (as amended), the
following report is submitted for the National Conference of State Liquor Administrators
(NCSLA) hosted by the Louisiana Office of Alcohol and Tobacco Control held at the Hotel
Monteleone in New Orleans, Louisiana.
The conference brought together alcohol beverage regulators, attorneys, law enforcement
officials, policy makers, and industry representatives from across the United States to discuss
emerging issues affecting alcohol regulation, licensing, enforcement, public safety, and industry
trends. The conference theme, "New Opportunities in Liquor Administration The Rhythm of
Regulation," emphasized balancing innovation with effective regulatory oversight. Throughout
the conference, attendees examined legal developments, emerging technologies, changing
consumer behavior and best practices that will shape alcohol regulation for years to come. The
information presented is directly applicable to the Hawai `i County Department of Liquor Control
and will assist the Department in maintaining an effective and modern regulatory program while
continuing to protect public health and safety.
Panel #1 Alcohol Resulation University. The panel consisted of Janelle Christian
(Alcohol and Tobacco Tax and Trade Bureau (TTB)), Louis Luchini (Maine Bureau of Alcohol
Beverage and Lottery Operations), Matthew D. Botting (The Law Office of Matthew D. Bolting)
and Phillip Sanchez (New Mexico Regulation and Licensing Department -Alcohol Beverage
Control Division).
The panel provided an overview of the historical development of alcohol regulation in the
United States beginning with early federal excise taxes (the Tariff of 1791), the Whiskey
Rebellion, the Temperance Movement, and the repeal of Prohibition in December 1933.

Particular emphasis was placed on the historical abuses that led to the creation of today's
three-tier system, including tied -house arrangements, commercial bribery, consignment sales,
exclusive outlets and monopolistic trade practices that encouraged excessive alcohol
consumption and unfair competition.
The panel discussed the continued importance of tied -house restrictions, franchise laws,
and vertical integration prohibitions in preserving marketplace independence and preventing
anti -competitive behavior. Speakers also reviewed the respective roles of federal, state, and local
regulators in licensing, compliance, taxation, and enforcement. The presentation reinforced that
although the alcohol industry continues to evolve, the core principles established following
Prohibition remain essential for protecting public safety, ensuring fair competition and
maintaining regulatory integrity.
Panel #2 Common Challenges and Potential Solutions: The Balancing Act. The
panel consisted of Carrie Bonnington (Pillsbury Winthrop Shaw Pittman LLP), Debbi Beavers
(Kansas Alcoholic Beverage Control Division — Department of Revenue), Thomas Graham
(Texas Alcoholic Beverage Commission) and William Crowley (New York State Liquor
Authority).
The panel discussed the increasingly complex environment faced by alcohol regulatory
agencies nationwide. Common challenges include political pressures, limited staffing and
financial resources, expanding regulatory responsibilities, emerging product categories and
rapidly changing market dynamics. Regulators must balance support for legitimate businesses
while maintaining strong enforcement programs that protect public safety.
Panelists emphasized the importance of interagency cooperation, modernization of
licensing systems, strategic use of technology, staff development, and consistent communication
with licensees. Agencies also discussed adapting to new products entering the marketplace while
maintaining effective oversight despite limited resources.
Panel #3 Industry Slowdown. The panel consisted of Alicia Iverson (Koloa Rum
Company), Marc Sorini (Brewers Association), Rodrigo Diaz (Pennsylvania Liquor Control
Board), Steve Gross (Wine Institute) and Wendy Knight (Vermont Department of Liquor and
Lottery).
The discussion focused on declining alcohol consumption trends throughout the United
States and their impact on manufacturers, wholesalers, retailers, regulators and tax revenues.
National data presented during the session demonstrated declining sales volumes across beer,
wine and spirits while consumer preferences continue shifting toward moderation, premium
products, non-alcoholic alternatives and health -conscious lifestyles.
Panelists discussed changing demographics, including younger consumers drinking less
alcohol than previous generations, resulting in lower overall consumption despite increases in
premium product pricing. Speakers emphasized that regulators should continue focusing on
public safety while recognizing changing industry conditions and considering ways to modernize
regulatory frameworks without compromising consumer protection.

Panel #4 Evolving Landscape. The panel consisted of Brandon King (Vermont
Department of Liquor and Lottery), Biran Howie (Quarles and Brady LLP), Jeannie Bremer (The
Wine Group) and Nicola Reid (Washington State Liquor and Cannabis Board).
The panel examined the rapidly changing relationship between alcoholic beverages and
non-alcoholic products. Speakers discussed alcohol manufacturers entering the non -alcohol
beverage market, non -alcohol companies partnering with alcohol producers, and the growing use
of co -branding strategies.
Panelists highlighted regulatory concerns involving product labeling, packaging
similarities, consumer confusion, marketing practices, placement within retail establishments and
products that may appeal to underage consumers. Discussion also covered licensing
implications, intellectual property considerations, distribution practices and advertising
restrictions as regulators attempt to adapt existing laws to emerging business models.
Panel #5 Legal Update. Richard M. Blau, Chair of the Nationwide Alcohol Beverage &
Food Law Group, provided an annual legal update covering significant court decisions and
emerging legal issues affecting alcohol regulation.
The presentation reviewed recent constitutional law decisions that continue to strengthen
states' authority to regulate alcohol under the Twenty-first Amendment while simultaneously
limiting the authority of administrative agencies in certain circumstances. Additional discussion
focused on First Amendment cases involving religious freedom, commercial speech, and other
constitutional issues affecting regulatory authority.
The session also addressed the growing importance of cybersecurity. As regulatory
agencies increasingly rely upon electronic licensing systems and maintain sensitive information,
agencies face increasing exposure to cyber threats while federal cybersecurity funding and
guidance continue to decline. Speakers emphasized implementing robust cybersecurity practices
to reduce legal liability and protect confidential information.
Panel # 6 Direct to Consumer. The panel consisted of Ashley Cowgilt (Pillsbury
Winthrop Shaw Pittman LLP), Donovan Anderson (District of Columbia Alcoholic Beverage
and Cannabis Administration), Drew Cousins (Arkansas Alcoholic Beverage Control Division),
Erik Smoot (Oklahoma Alcoholic Beverage Laws Enforcement (ABLE) Commission) and
Melinda Leonard (Michigan Liquor Control Commission.
The panel explored the continued expansion of di rect-to- consumer (DTC) alcohol
shipping and home delivery services. Speakers distinguished interstate direct shipping from
intrastate delivery services and discussed the growing role of third -party delivery platforms.
Panelists reviewed licensing requirements, age verification procedures, tax reporting
obligations, interstate enforcement challenges, wet and dry jurisdiction issues and recent
legislative developments. The discussion emphasized the absence of a national regulatory
standard and highlighted the importance of maintaining compliance through licensing, reporting,
data retention and accountability.

Panel #7 Ethics and Mindfulness: "The Professional Duty of Self -Care". Dr. Angela
White-Bazille and Lisa Gardner conducted an interactive presentation emphasizing professional
wellness and ethical leadership.
The session discussed recognizing stress, burnout, compassion fatigue, depression, and
anxiety within government service. Dr. White-Bazille explained that burnout results from
prolonged stress combined with emotional exhaustion and discouragement. Participants were
encouraged to establish healthy work -life balance, prioritize quality sleep, set professional
boundaries, practice mindfulness and develop healthy coping strategies.
The presentation emphasized that effective leadership requires personal wellness and that
maintaining physical and mental health enables public servants to make better decisions while
providing improved service to the public.
Panel #8 Artificial Intelligence Part 1. The panel consisted of Brian Bennett
(Corporate Counsel, and Assistant Secretary, Constellation Brands, Inc.), Commissioner Chad
M. Brown (Louisiana Department of Revenue — Office of Alcohol and Tobacco Control),
Karthik Agarwal (Gov2Biz, Inc.), Micah Chaffee (Nebraska Liquor Control Commission) and
Risa Williams (Arizona Department of Liquor Licenses and Control).
Panelists discussed practical applications of generative artificial intelligence, predictive
analytics and biometric technologies within alcohol regulatory agencies. Speakers explained that
Al can improve drafting, document summarization, research, licensing efficiency, inspections
and regulatory analysis when used appropriately.
The panel emphasized that Al does not replace human judgement and that effective Al
implementation requires trusted data sources, clear instructions, human review, verification of
outputs and comprehensive governance policies to protect privacy, maintain transparency and
ensure accountability.
Panel #9 Artificial Intelligence Part 2. The panel consisted of Emilie Oglesby (Florida
Division of Alcoholic Beverages and Tobacco), Lynn Walding (Control States, Diageo North
America), Missy Welch (North Carolina Alcoholic Beverage Commission) and Ryan Malkin
(Malkin Law, P.A.)
This interactive session demonstrated both the strengths and limitations of Al through
actual compliance scenarios. Panelists illustrated examples where Al incorrectly interpreted
federal regulations, misunderstood tied -house restrictions or failed to answer licensing questions
accurately.
The panel emphasized that Al should be considered a decision -support tool rather than a
decision -maker. Regulatory agencies must verify AI -generated information against applicable
statutes, administrative rules and agency policies before relying upon the information for
enforcement or licensing decisions.

Panel #10 Hemp_ The panel consisted of Alan Greenspan (Southern Glazer's Wine and
Spirits), Eric Brewer (Total Wine & More), Meg Nash (Vicente LLP), Shauna Barnes (Barnes
Beverage Group) and Thomas Akras (Maryland Alcohol, Tobacco, and Cannabis Commission).
The panel discussed the rapidly evolving regulatory environment surrounding hemp -
derived products. Speakers reviewed consumer demand, manufacturing practices, federal and
state legal frameworks, agency coordination, and anticipated federal legislative changes.
Particular attention was given to distinguishing sealed versus mixed products,
manufacturing standards, labeling, distribution, testing requirements, and consumer safety. The
panel emphasized the importance of coordination among alcohol, cannabis, agriculture and
public health agencies to ensure consistent regulation.
Panel #11 Public Safety. This panel focused on protecting public safety in licensed
establishments and consisted of Donald McGehee (Michigan Attorney General), Latonya Hucks-
Watkins (Virginia ABC), Jessica Allen (Indiana Alcohol &Tobacco Commission), Russell
Thomas (Tennessee ABC), and Bart Branyon (Kansas ABC).
Topics included drink spiking prevention, nuisance establishments, adult entertainment
venues, inspection procedures, and enforcement strategies. Significant discussion focused on
recent constitutional litigation concerning administrative inspections and Fourth Amendment
requirements for liquor establishments.
Panelists emphasized understanding inspection authority, search warrant requirements,
administrative inspection exceptions and protecting constitutional rights while maintaining
effective enforcement programs.
Panel #12 Regulatory Challenges in Alcohol Licensing. The final panel addressed
emerging challenges in alcohol licensing involving increasingly complex ownership structures.
Panelists included Beth Hatef (Davis Wright Tremaine LLP), Nick Bergman (Buchman Law
Firm), Robert De Ruyter (California Department of Alcoholic Beverage Control), and Stan
Harris (Louisiana Restaurant Association).
Discussion focused on licensing consistency across jurisdictions, ownership disclosure
requirements, mergers and acquisitions, private equity investments, celebrity ownership, trusts,
and other complex business structures.
Speakers emphasized the importance of ensuring regulators receive sufficient ownership
information to protect the integrity of the licensing process while balancing business
confidentiality concerns. The panel also explored opportunities for regulators and industry to
work collaboratively during ownership changes to minimize operational
disruptions.

The conference provided valuable information directly applicable to the Hawaii County
Department of Liquor Control. The sessions reinforced the importance of maintaining strong
regulatory oversight while adapting to evolving industry practices, technological advancements
and changing consumer preferences.
The opportunity to exchange information with regulators, attorneys, and industry
representatives from throughout the United States provided valuable insight into national trends
and best practices that can be evaluated for potential application within Hawaii County.
