To the Windward Planning Commission:
Re: PL-SPP-2026-000140 - Special Permit Application
12-7208 and 12-7210 Kalapana-Kapoho Beach Road
We are owners of property adjoining the properties that are the subject of the above Special Permit
application. We are submitting this testimony to clarify an existing property-boundary and access condition
that may be relevant to the proposed bed-and-breakfast use.
We are not submitting this testimony either in opposition to or in support of the applicants' proposed
bed-and-breakfast use. Our concern is limited to ensuring that approval and operation of the proposed use
do not rely upon or create any right of access or use over our property.
An existing sidewalk associated with the applicants' property crosses the surveyed property boundary and
extends onto our property. The location of the common boundary was previously surveyed at the applicants'
request, and the applicants acknowledged at that time that the property line crosses the sidewalk.
Because the application proposes a commercial bed-and-breakfast use, including guest parking on an
adjoining parcel, the existing sidewalk could reasonably be used by B&B guests for pedestrian access. We
have not granted the applicants an easement, right-of-way or other legal right for B&B guests or members
of the public to use the portion of our property crossed by the sidewalk for access to the proposed
commercial operation.
There is also an existing fence associated with the applicants' property that crosses the surveyed boundary
and terminates at a stone wall located on our property. We have not required removal or relocation of these
existing improvements, but our decision not to do so should not be construed as an agreement that the
fence represents the property boundary or as granting an easement, right-of-way, ownership interest or
other property right.
We respectfully request that, before approving the application, the Planning Department and Commission
confirm that all parking, pedestrian access and other facilities necessary for operation of the proposed B&B
can be provided entirely over property owned by the applicants or property over which they possess a
documented legal right of use.
We further request that any approval of PL-SPP-2026-000140 expressly not be construed as authorizing
the applicants, their guests or other persons associated with the B&B operation to use our property for
pedestrian access, parking or other B&B-related purposes.
We appreciate the Commission's consideration of this clarification and request that it be included in the
record for this application.
Sincerely,
Ben Coolik
