Field inspector (00:08) Kona low. Property owner (00:08) The Kona low, it went that way. Some of it did go this way. Field inspector (00:13) Yeah, but — Property owner (00:13) Naturally. Naturally, some of it went that way. The flow went this way. Property owner (00:17) What would you like to do? Field inspector (00:19) Okay, so in theory —so you see our drainage stream right here? We're trying to maintain the natural drainage mitigation. Property owner (00:26) This is the natural flow. How can you say this is not Field inspector (00:29) Our natural flow comes from right over here and stays on this side. That's what we're all working on. Property owner (00:33) Okay, first off, I asked you to —you guys to email me the map. Field inspector (00:37) I don't have control of that map. Property owner (00:39) And there is no map. Field inspector (00:40) I can —I can have a — Property owner (00:41) There is not a map. I looked. Field inspector (00:42) I can have Brad send it to you. Property owner (00:43) Okay. This is the natural flow. Every flood thing (Hawaii County Code in respect to floods) says that the natural flow has to be open. Property owner (00:54) Like, you cannot even close it. Field inspector (00:56) No, it's — Property owner (00:56) Because this was — Field inspector (00:57) It's the natural way. Correct. Property owner (00:58) Okay, so if this was the natural way it went, you guys are illegally asking me to make it go another way. Field inspector (01:06) I'm not illegally asking you to maintain anything. We're just trying to keep this natural drainage flow. Field inspector (01:12) That's it. Property owner (01:12) That's not the natural flow. The flow went this way. Field inspector (01:18) Okay, I'm just going to — Property owner (01:24) There was nothing even here before. This was all flat. There was no rock burn, beam, nothing. You guys are going off what some guy lied, and you guys are continually catering to him when you can see with your own eyes what happened. And then he came on my property with an excavator and tried to build a false wall here that was never here before. Field inspector (01:51) I have no —I have no knowledge of what he was doing on your property. That's not even what this is. So, again, if you want to comply, that's on you. Property owner (02:02) Comply with what? Field inspector (02:03) We need to restore a berm. So he — Property owner (02:05) There was no berm here. I have pictures. Property owner (02:07) I can show you what it looked like before. Field inspector (02:09) Okay. If that's how you want to go about it, I'm not going to stop you. But I will document on my end so I can say I at least tried to advise you. Property owner (02:18) To do what? Field inspector (02:19) Restore the berm stream. Property owner (02:21) There was no natural berm here. Field inspector (02:24) This is the natural documented stream. We don't have any record of it veering off on this side. Property owner (02:31) This is what it did. Pull —okay, so you're the guy who's supposed to do this. Property owner (02:36) Pull up the code that says what you're supposed to do with a flood. With the natural control —with the natural progression of a flood. Field inspector (02:46) Okay. You're not going to comply, so I'll just do my part. Property owner (02:50) No, I need you to pull up the county code. Field inspector (02:53) That's the engineer's. I'm not an engineer. Property owner (02:59) I need you to pull up the county code. If you guys are accusing me of doing something, I need you to pull it up and show me. Field inspector (03:06) Okay, I'll have my engineer do it. Property owner (03:07) There was no berm here. There was no berm here. Field inspector (03:14) Okay. There was —supposedly there was an existing one that got washed out. Property owner (03:22) No, there was not. You don't even have proof of that. Field inspector (03:26) We have records. I'll have them provided for you. Field inspector (03:29) I don't have it on me. I'm a field guy. Field inspector (03:32) So, okay, you already made it very clear you're not going to comply, so I'm going to document that and so be it. Property owner (03:39) No, I'm not going to comply to illegal requests. You —what you are doing is illegal. Field inspector (03:45) Illegal requests to restore the drainage. Property owner (03:48) There was no berm here. Field inspector (03:52) Okay, okay. I'm just going to take — Property owner (03:53) For starters. Field inspector (03:54) I'm going to take your statement. I'm not even — Property owner (03:56) Second of all, if the floodwater took out a —what —how —high would you say this is? (pointing to the rock wall that the Kona low storm took out) Field inspector (04:02) Well, let's get a measurement on it. Let's go at the top of the rock. Field inspector (04:09) Let's say, for sake of conversation, give or take 3 feet. Property owner (04:14) So it took out a 3-foot wall and a tree. What sort of berm do you think I'm going to build here that's going to — Field inspector (04:22) Match the existing height and then put it to about the corner right there. Property owner (04:24) I'm not fucking doing that. Field inspector (04:26) Okay. Property owner (04:27) That's crazy. Field inspector (04:29) Well, if you're going to —I'm trying to be as nice and respectful and — Property owner (04:31) You're not, because you're not providing evidence. This is not how it looked. Property owner (04:35) There was no natural berm Field inspector (04:36) I'm just —this sounds from my department. I don't know what they've been telling you. Field inspector (04:38) I'm just —I take their directives and I follow orders. I don't know what happens behind the scene. Field inspector (04:44) 1 don't know what they tell you. I'm just a field inspector. Field inspector (04:47) So I hear what you're saying, but Property owner (04:49) There's no natural berm here. You guys are making me do something that was not here. Field inspector (04:53) Okay. I'll let you take that up with my department and my engineers. I understand where you're coming from. Field inspector (04:59) I'm not saying you're right or wrong. I'll just document for what it is and so be it. Property owner (05:06) You're going to document what? That this stream went this way? Field inspector (05:08) That there's no berm in place. Property owner (05:09) That there was never no berm in place. There was never —you have no —I have pictures that I can pull up and show you there was no berm here. Field inspector (05:15) Okay. Send that to our department and I'll let you guys hash that out. I don't know what directive they're holding you to, as far as for —other than just restoring this to the — Property owner (05:26) What they're trying to do is cater to somebody who is wrong, and that is wrong. Field inspector (05:32) I don't know both sides of this, okay? Property owner (05:34) And if this is how we're going to do it, then I'm —I'm going to make a complaint about the people above me. Field inspector (05:39) Okay. Property owner (05:39) And have them —have them not —have their floodwater come on my property. Field inspector (05:43) Okay. Property owner (05:43) And then they're going to go up to the county because the county diverted all the water this way, and then we'll just have a huge lawsuit against the county. Field inspector (05:50) I'm not telling you what to do. Property owner (05:53) What you should do is your job. The job —you could see this went this way. Field inspector (05:57) Do my job. Property owner (05:57) Nothing prevented it. There was no berm here. Property owner (06:01) You have no evidence that there was a berm here. There wasn't a berm here. Field inspector (06:06) Okay. Property owner (06:06) Why do you keep saying there was a berm here? Field inspector (06:08) Because I was told there was a berm here. Property owner (06:10) By who? Field inspector (06:11) My department. Property owner (06:12) Your department never saw a berm here. Field inspector (06:15) Yeah, because it got washed out. Kona low. Property owner (06:20) Okay, so if the Kona low washed something out. Field inspector (06:24) We still have to restore it. Property owner (06:26) No, you don't. That is not in the code. Property owner (06:29) In fact, it says it needs to be unobstructed. Field inspector (06:32) Okay. Property owner (06:32) You need to unobstruct the flow of the flood. That's what it says. Field inspector (06:36) So be it. Okay. Property owner (06:38) So that's what you need to report back. That the flood goes this way. Property owner (06:41) If she put something up here, that would obstruct the flow. Field inspector (06:45) Okay. So now it's unobstructed. Okay. Field inspector (06:48) Let me take a couple field photos and I'll be on my way. Property owner (07:25) And also, it's clear that there was no berm here because the rock wall —you can clearly see where the rock wall starts. Field inspector (07:32) 1 told you I'm not here for the rock wall. That's not what I'm here for. Property owner (07:36) Yeah, but you just told me that there was a berm here that was at the rock wall going all the way across. Field inspector (07:40) Okay. Property owner (07:41) And clearly that's not true because you can see the rock wall all the way down. You can see the rock wall here, here, here, here, here, here where it busted out. Property owner (07:53) And then you can go on the other side and keep seeing the rock wall down. There's no berm. Field inspector (07:59) Okay. Property owner (08:02) Like, do you guys have college degrees (meaning engineering degrees) to —does that —who's —who's — who came up here and said that there was a berm here when you can clearly look at the evidence and see that there wasn't? Field inspector (08:13) Okay. I'm —I'm —I'm doing my part. Okay. Field inspector (08:17) That's all I got, so. Okay, so it is what it is. Field inspector (08:30) I got my shot, so. So this is considered unobstructed, so so be it. Field inspector (08:39) That's all I got. I'm ready to leave. Property owner (08:41) Okay, perfect. Field inspector (08:42) Okay.
