Ordinance No. 10-45 was approved to allow a change of zoning district classification from Agricultural- 1 Acre (A-1a) to Neighborhood Commercial-20,000 square feet (CN-20) for a 5.075-acre parcel. The subject property is located at 279 Komohana Street, approximately 150 feet from its intersection with Ponahawai Street, Hilo, South Hilo, Hawai‘i, TMK: (3) 2-3-037:006. PROPOSED ACTION 1. Applicant’s Request: The applicant is requesting the following amendments to Change of Zone Ordinance No. 10-45:  Amend Condition B (water commitment) to delete the 180-day timeframe for payment.  Amend Condition E (complete construction) to allow a 10-year time extension from the effective date of this amendment.  Delete Condition G (access easement).  Delete Condition H (limitations to Komohana Street access).  Delete Condition J (full improvements to Komohana Street).  Delete Condition K (streetlights & traffic control devices).  Add a new condition to allow partial relief from the easement along Komohana Street to provide for driveway access.  Add a new condition to recommend that the Department of Public Works (DPW) consider reducing the posted speed limit along Komohana Street fronting the subject property. -2- The following are the applicant’s specific amendment requests (material to be deleted is bracketed/struck through, material to be added is underscored): Amend Condition B: Prior to the issuance of a water commitment by the Department of Water Supply, the applicants shall submit the anticipated maximum daily water usage calculations as recommended by a registered engineer, and a water commitment deposit in accordance with the “Water Commitment Guidelines Policy” to the Department of Water Supply [within 180 days from the effective date of this ordinance]prior to the issuance of a building permit. Amend Condition E: Construction of the proposed improvements shall be completed within [five (5)]ten (10) years from the effective date of this amended ordinance. This time period shall include securing Final Plan Approval from the Planning Director in accordance with Section 25-2-70, Chapter 25 (Zoning Code), Hawai‘i County Code. Delete Condition G: [Prior to issuance of Final Plan Approval, the applicants shall grant a minimum 30-foot wide access easement on the subject property, in favor of the adjacent landowner(s) (TMK: 2-3-37:14), in order to connect the access at Ponahawai Street on TMK 2-3-37:14 to the access at Ponahawai Street on the subject property for the purpose of providing internal traffic circulation between the two properties.] Delete Condition H: [Access at Komohana Street shall be through road and utility easement “RU-9”and shall be limited to right-turn in and right-turn out movements only. This access shall be shared with the adjacent parcel (TMK: 2-3-37:22). Prior to the issuance of a Certificate of Occupancy, the applicants shall install “no left-turn” sign(s) and a physical barrier at the property access to prevent left-turns into and out of the access driveway. All improvements shall meet with the approval of the Department of Public Works.] -3- Delete Condition J: [Prior to the issuance of a Certificate of Occupancy, the applicants shall provide full improvements to the property’s frontage along Komohana Street consisting of, but not limited to, pavement widening with concrete curb, gutter and sidewalk, drainage improvements, and any required utility relocation, meeting with the approval of the Department of Public Works.] Delete Condition K: [Streetlights and traffic control devices, as may be required by the Traffic Division, Department of Public Works, shall be installed by the applicants at no cost to the County.] Add New Condition: Partial relief from “NO VEHICULAR ACCESS” PLANTING SCREEN EASEMENT in an area of the property fronting Komohana Street to provide for commercial driveway access that will not interfere with neighboring residential property access. Relief is requested for a length of approximately 45 feet at a location reviewed in coordination with the Department of Public Works (DPW) Engineering Division and DPW Traffic Division to ensure appropriate driveway placement and two‐way left turn lane (TWLTL) spacing from the Ponahawai/Komohana intersection, consistent with Chapter 22 (County Streets) of the Hawai‘i County Code and the completed TIAR. Add New Condition: As a matter of public safety, the Planning Commission and County Council recommend that the Department of Public Works (DPW) evaluate the posted speed limit along Komohana Street fronting the subject property and consider a reduction of the posted speed limit from forty‐five (45) miles per hour to thirty‐five (35) miles per hour. This recommendation is intended to support safe ingress and egress to the site and to improve overall traffic safety in light of the proposed commercial driveway access and turning movements. Nothing in this condition shall be construed to alter or -4- supersede the independent authority of DPW with respect to speed limit determinations or traffic control measures. It should be noted that if the applicant’s requested amendments are approved, the existing CN-20 zoning would allow for the construction of approximately 104 double-family or 104 multiple-family residential units on the portion of the subject property that is not located in flood zone A. 2. Applicant’s Reasons for the Request: The applicant acquired the property in March 2017, after the original deadline of May 20, 2015, to complete construction, as established by Condition E of Ordinance No. 10-45. The previous landowner had proposed to construct a 30,000-square foot office building, with plans to potentially construct an additional office building. The current applicant intends to construct a 36,000-square foot family entertainment center on the subject property, to include bowling, an arcade, laser tag, miniature glow golf, a restaurant, karaoke rooms and a lounge. In 2019, the zoning code was amended to add indoor amusement and recreation facilities to the list of permitted uses for the CN zoning district, which would include the proposed use. However, given that an administrative time extension for Condition E expired on May 20, 2020, the 10-year time extension is requested to allow adequate time to complete construction. The applicant is requesting to amend or delete various conditions that they believe are no longer relevant to the current proposal or that would impede the feasible completion of the project. Additionally, the applicant proposes to add two new conditions to allow driveway access and provide for safe vehicular movement with a reduction of the speed limit along the subject property’s Komohana Street frontage. 3. Construction Timetable and Cost: The applicant estimates that they will submit for plan approval within approximately two years. Construction is anticipated to take approximately 18-24 months, with costs expected to exceed $10 million. 4. Landowner: KBXtreme Hilo LLC. 5. Supporting Information: The applicant has submitted the attached in support of the request. (Planning Department Exhibit 1 - Change of Zone Amendment -5- Application dated January 14, 2026 and Additional Information dated June 12, 2026) STATE & COUNTY PLANS 6. State Land Use District: Urban. 7. General Plan 2045 Land Use Map: Medium Density Urban (mdu). These areas include uses such as village and neighborhood commercial and single family and multiple family residential and related functions (multiple family residential - up to 35 units per acre). 8. County Zoning: Neighborhood Commercial-20,000 square feet (CN-20). 9. Hilo Community Development Plan (CDP): The Hilo CDP, adopted by Resolution No. 1 on May 21, 1975, identifies the area as Single-Family Residential and Multiple-Family Residential. 10. Special Management Area (SMA): The Special Management Area is a part of the Coastal Zone Management Program and regulated by the County. The subject property is not located within the Special Management Area and is situated approximately 1.0 miles from the nearest coastline. DESCRIPTION OF SUBJECT PROPERTY AND SURROUNDING AREA 11. Subject Property: The subject, 5.075-acre property has frontage along both Ponahawai Street and Komohana Street. An approximately 30-foot wide “pole” connects the main portion of the property to Ponahawai Street and there is approximately 600 feet of frontage along Komohana Street. Two drainage easements are located in the northern portion of the property. Drainage easement “D-1” is 20 feet wide and drainage easement “D-2” is 80 feet wide. The property is currently vacant but was formerly planted in sugar cane. Elevation ranges from 200 to 240 feet above sea level and the property slopes slightly to the east and south. 12. Surrounding Zoning/Land Uses: Surrounding lands are zoned Single-Family Residential (RS-7.5), Multiple-Family Residential (RM-4, RM-5.5), Neighborhood Commercial (CN-20), Agricultural (A-1a) and Project District (PD). Existing surrounding land uses include residential, medical and church uses, in addition to -6- vacant parcels. 13. Flood Insurance Rate Map (FIRM): Portions of the property are located in the “A” flood zone, a special flood hazard area inundated by the 100-year flood where base flood elevations have not been determined. 14. Flora/Fauna Resources: No professional floral or faunal study was submitted with the application. As the property was historically used for sugar cane cultivation and has been grubbed in recent years, and given development of the surrounding area, it is unlikely to host endangered species of plants or animals. 15. Archaeological/Cultural/Historical Resources: No formal archaeological or cultural studies were conducted as the subject property has been grubbed and impacted by ground-disturbing activities associated with previous sugar cane cultivation. By letter dated January 8, 2010, the Department of Land and Natural Resources – State Historic Preservation Division (SHPD) provided comments stating that no historic properties would be affected by the proposed development, citing previous grading and grubbing (Planning Department Exhibit 2 – Letter from SHPD dated January 8, 2010). 16. Public Access: There is no public access to the mountains or the shoreline that runs through the property. PUBLIC UTILITIES AND SERVICES 17. Vehicular Access/Traffic: The property has two legal access easements; a 30- foot-wide road and utility easement identified as “RU-8” at Ponahawai Street which is shared with parcel 21 and a 15-foot-wide road and utility easement from Komohana Street identified as “RU-9” which is shared with parcel 22. Ponahawai Street and Komohana Street are both County roadways with a right-of-way width of 60 feet. An existing 10-foot wide no vehicular access planting screen easement runs along the east side of Komohana Street. The previous applicant intended to utilize the Ponahawai Street access as the primary access to the property but the current project proposes a primary driveway access from Komohana Street. The applicant commissioned a traffic impact analysis report (TIAR) for the proposed project, dated July 21, 2025, which found that the proposed project is not expected -7- to significantly impact traffic on Komohana Street and expects the proposed driveway to the subject property to operate at LOS “C” through year 2045 at peak hours of traffic. Additionally, the Komohana Street and Ponahawai Street intersection is expected to operate at acceptable levels of service through year 2045 at peak hours of traffic with the proposed project. The TIAR makes several recommended access improvements as follows: - Southbound Komohana Street should be widened at the proposed driveway to provide an exclusive left turn lane. - The south leg of Komohana Street should be widened at the proposed driveway to provide a median refuge lane. - The proposed driveway should provide separate left turn and right turn lanes. The Department of Public Works (DPW), Engineering Division, states that they oppose deleting Condition J (full improvements to Komohana Street) and Condition K (streetlights and traffic control devices), but are amenable to the request to delete Condition H (limitations to Komohana Street access). Regarding Condition H, DPW notes that access improvements shall be as required by the TIAR and by DPW. Regarding Condition J, DPW states that installation of curb, gutter and sidewalks along the subject property frontage is necessary for safe pedestrian access to the proposed facility. Regarding Condition K, DPW opposes the request for relief from installation of streetlights, but will defer to DPW, Traffic Division, during construction plan review. Based on comments from Traffic Division, they concur with DPW, Engineering Division, in opposing deletion of Condition K. Traffic Division notes that the requirement for installation of roadway lighting along the project area as deemed necessary by DPW is reasonable, particularly due to added pedestrian and bike traffic and for safer ingress and egress to the proposed development. Traffic Division goes on to state that the applicant should make sure there is adequate room for proper channelization and storage on Komohana Street, including a left turn lane and a median acceleration lane for left turns out. Finally, Traffic Division recommends that the applicant -8- coordinate roadway improvements with the proposed Project District that will take access from the top of Ponahawai Street, near the subject property. The applicant’s response to DPW notes that requiring curb, gutter and sidewalk improvements along the Komohana Street frontage would create an isolated section of sidewalk that will not connect to a continuous pedestrian system and requests reconsideration of the requirement to retain Condition J. The applicant states they are agreeable to specific frontage improvements to be determined by DPW during construction plan review, with consideration given to an alternative of maintaining a safe paved shoulder or other bicycle and pedestrian-compatible improvements. Regarding Condition K, the applicant proposes an alternative of installing on-site lighting at the project driveway entrance to allow entrance lighting to be installed and maintained directly by the applicant. Additionally, the applicant requests that any retained condition allow flexibility for DPW, Traffic Division, to make the final determination regarding necessary streetlights. Finally, the applicant states that they will coordinate with DPW to implement recommendations made in the TIAR. 18. Water: According to the Department of Water Supply (DWS), there is an existing 5/8-inch meter serving the subject property which is limited to an average daily usage of 400 gallons and suitable for only one single-family dwelling. DWS notes that previous comments, dated January 4, 2010, are still applicable and that they are not supportive of the applicant’s request to submit water usage calculations prior to issuance of a building permit as water availability may change. The 2010 comments requested submittal of estimated maximum daily water usage calculations for the proposed use including the total estimated daily water usage in gallons per day and the estimated peak flow in gallons per minute, including irrigation use. Upon receipt of the water usage calculations, DWS stated that they will determine the water commitment deposit amount, prevailing facilities charge and any water system improvements required for final approval. DWS also stated that CN zoning will require installation of a reduced pressure type backflow prevention assembly, meeting DWS approval, and that the applicant shall be -9- responsible for relocation and adjustment of DWS’s affected water system facilities, as necessary. DWS notes that the existing 12-inch water line within Komohana Street is adequate to provide 2,000 gallons per minute for fire protection, as required by DWS standards. The applicant has responded that they understand the DWS requirements and though the application proposes to defer certain project costs until later in the permit review process, they will work with appropriate design professionals to determine what is needed to prepare the required water usage calculations for DWS review. In an updated response letter, dated September 8, 2026, the applicant states that they have submitted preliminary water use calculations to DWS for review and are in discussion with DWS to submit the required water commitment deposit. 19. Wastewater: There is currently no municipal sewer in the area. According to comments from the Department of Environmental Management for the original change of zone, the property is located in a Critical Wastewater Disposal Area. All lots within this designated area are subject to the use of a septic tank system approved by the Department of Health. 20. Environmental Site Assessment: DOH notes that environmental site assessment may be appropriate for formerly cultivated agricultural lands where historic activities could have resulted in releases of hazardous substances. The applicant remains responsible for compliance with applicable DOH requirements during subsequent development and permitting. 21. Solid Waste: The applicant states that solid waste will be properly disposed of at an authorized county waste disposal or recycling facility. 22. Essential Utilities and Services: Electricity and telephone services can be made available to the property. Police, fire and medical services are available nearby in Hilo. -10- AGENCY COMMENTS 23. As of the date of this writing, the Planning Department has received no public comments on this application. Department of Planning  County of Hawaii  101 Pauahi Street   Hilo, Hawaii 96720    Dear Department of Planning:   Subject: Request for Rezoning and Ordinance Amendment – KBXtreme Hilo, LLC     REZ 09‐000113, Ordinance No. 10‐045     South Hilo, HI, TMK: 3‐2‐3‐037:006  The subject area, encompassing 221,067 square feet, was rezoned into the Neighborhood  Commercial (CN) district (EXHIBIT A) on May 20, 2010, originally intended for the construction of a  commercial office building. However, the construction failed to meet the deadline within the  permissible five‐year period, which expired on May 20, 2015, due to Condition E of the rezoning  ordinance.  A time extension was requested and subsequently approved by the Planning Director  through a letter dated December 23, 2016 (EXHIBIT B), granting an additional period until May 20, 2020.  Shortly after obtaining the administrative time extension, the subject property was sold to  KBXtreme Hilo, LLC. (KBXTREME) on March 17, 2017.  On October 2, 2019, the Hawaii County Council  passed Bill 94, which amended the Zoning Code to permit Indoor Amusement and Recreation Facilities  within the Neighborhood Commercial (CN) zoning districts. This change was eagerly awaited by  KBXTREME, as indoor amusement and recreation facilities were not previously allowed in Neighborhood  Commercial (CN) zoned areas.  However, due to unforeseen circumstances related to the COVID‐19  pandemic the development plans were inadvertently delayed, leading to the expiration of the  administrative extension, where construction of the improvements had to be completed, on May 20,  2020.  KBXTREME now plans to construct and operate a comprehensive family entertainment center in  Hilo. The center will feature various attractions centering around bowling and restaurants, and including  an arcade, laser tag, miniature glow golf, karaoke rooms, and lounge. Its objective is to provide a diverse  range of recreational opportunities for both county residents and visitors, consistent with the primary  goals stated in section 12.2 of the general plan.  To proceed with the development of the family entertainment center, KBXTREME requires an  amendment of the rezoning ordinance for the CN zoning district, suitable ingress and egress to the  property, and a reduced speed limit on Komohana Street fronting the property.    I. GENERAL BACKGROUND  As noted earlier, the rezoning ordinance for the subject area, covering 221,067 square feet, was  implemented as Neighborhood Commercial (CN) district (Ord. No. 10‐045) on May 20, 2010, with the  original intention of constructing a commercial office building in conjunction with the neighboring  parcel. However, construction of the facility was not completed within the designated timeframe,  January 14, 2026 including the extension period.  The subject property was purchased by KBXtreme Hilo, LLC on March  17, 2017 for the purpose of developing a family entertainment center. Progress on this project was  initially delayed by the Kilauea volcanic eruption, as the Planning Department appropriately prioritized  its response to the crisis. This, in turn, postponed the administrative process to amend the zoning code  to expand permitted uses within Neighborhood Commercial (CN) zoning to include “Indoor  Amusement.” These changes were ultimately approved by the Hawaii County Council in November  2019, allowing us to proceed with development efforts, including drafting construction documents.  However, just two months later, the COVID‐19 pandemic abruptly halted all progress, compounding the  delays caused by the earlier circumstances. Now that economic conditions have stabilized, we are  actively resuming development efforts and remain committed to completing this much‐needed facility  for the Hilo community. Due to these unusual and unavoidable circumstances, we respectfully request  relief from the lapse of the prior extension and seek an additional ten (10) years to fulfill the conditions  of Ordinance 10‐45.  KBXtreme's owners currently operate a popular 25,805 square foot family entertainment center in  Kailua Kona, which has been delighting patrons since 1987. The facility offers an array of exciting  activities, including sixteen lanes of bowling, a state‐of‐the‐art video arcade, a karaoke lounge, a sports  bar, and the renowned restaurant Chubby's Diner. KBXtreme purchased the property in Hilo with the  intention of constructing a similar 36,000‐square‐foot facility. However, the property was initially  rezoned for a commercial office building under the Neighborhood Commercial (CN) district, which did  not allow indoor amusement and recreation facilities as a permitted use. Although a time extension was  granted, the construction could not be completed within the given timeframe. On October 2, 2019, the  Hawaii County Council passed Bill 94, amending the Zoning Code to permit indoor amusement and  recreation facilities within the CN zoning districts, which KBXtreme had eagerly awaited. Unfortunately,  due to the unforeseen delays caused by the COVID‐19 pandemic, the administrative extension expired  on May 20, 2020. Undeterred, KBXtreme now plans to construct and operate a family entertainment  center in Hilo, featuring a range of exciting attractions such as bowling, an arcade, laser tag, miniature  glow golf, a restaurant, karaoke rooms and a lounge (EXHIBIT F), (EXHIBIT G), (EXHIBIT H).   The hours of this facility will closely follow those of our established Kona facility, which has been in  operation since 1987. The hours of operation will be 9:00 AM to 2:00 AM daily (Sunday–Saturday), with earlier closing on Sunday through Thursday as business demand warrants. The total number of  employees for the facility is estimated to be around 80 people, with staffing adjusted during peak and  off‐peak periods to ensure operational efficiency. Given the facility’s size and diverse entertainment  offerings, it is anticipated that an average of 300 daily visitors will utilize the facility, with higher  volumes on weekends and during special events such as concerts or school field trips. Our Kona  location's historical data shows that peak days (typically weekends) could see up to 500‐600 visitors,  while weekdays might average closer to 200‐250 visitors, depending on the time of year and scheduled  events.   A very diverse clientele is anticipated, that will necessitate catering to a wide range of interests.  During the morning hours, seniors will be serviced through our bowling leagues and open lanes. The  restaurant will serve breakfast, lunch, and dinner for the local community, and the facility will host  bowling leagues during weeknights from Monday to Thursday. Ongoing communications with UH Hilo  and HCC are underway as they are very interested in reviving their weekly bowling intramural leagues,  which will bring in additional college‐aged patrons. The lounge area will also attract patrons for live  events and PPV broadcasts, particularly during major sports and entertainment events. Friday, Saturday,  and Sunday will be focused on providing entertainment for local families to enjoy, particularly after‐ school hours and on weekends. Plans to host school field trips throughout the year are in awaiting, as  evidenced by our experience at our Kona location, where we frequently serve local schools. Additionally,  we will continue our tradition of hosting Project Grad events to provide high school graduates with a  safe, alcohol‐free environment for their celebration.  Minimal conflict with school or institutional traffic is anticipated as the facility opens at 9:00 AM,  after most school and work traffic. Traffic patterns at the Kona facility during the morning are largely  driven by senior leagues and do not coincide with high traffic times for local schools or offices. The  facility will have 213 parking stalls (including 7 accessible stalls), which significantly exceeds the required  134 stalls. Based on the experience at the Kona facility, minimal morning and afternoon traffic is  expected, with the majority of traffic at those times due to scheduled senior league events. The varied  entertainment offerings and services will help spread out visitor traffic throughout the day, minimizing  peak congestion.  This is a highly leveraged project, with construction costs expected to exceed $10 million.  Conceptual planning and pre‐development documents are underway, and construction documents will  be completed as the project advances through plan approval and permitting. Once these factors are in  place, we estimate submitting for plan approval within the next two years. After obtaining the necessary  permits, we anticipate an 18‐to‐24‐month construction period. Attached is the street striping and sign  plan (EXHIBIT D), along with the site plan, which includes information such as property lines, and  proposed structures, parking lots, and entrance driveway (EXHIBIT F), as well as the grading plan  (EXHIBIT J) and ALTA survey (EXHIBIT K). Also attached is the tax map which reflects the easements  including road and utility easements RU‐9 and RU‐8, the "No Vehicular Access” Planting Screen  Easement, and drainage easements D‐2 and D‐1 (EXHIBIT I). Detailed plans, including construction  documents for the on‐site septic system, availability of water, and improvements will be provided during  final plan approval. Exterior elevations for the facility are attached (EXHIBIT H).  The vision is to provide a diverse range of recreational opportunities for both residents and visitors,  aligning with the county's general plan. To proceed with their development plans, KBXtreme requires an  amendment of the rezoning ordinance for the Neighborhood Commercial district, suitable ingress and  egress to the property, and a reduction of the speed limit on Komohana Street fronting the subject  property.  II. NATURE OF REQUEST  The applicant is eager to proceed with the development of the site but faces obstacles due to  certain rezoning conditions that are no longer relevant or impede the feasibility of the indoor  recreational facility – family entertainment center project. Moreover, the deadlines associated with the  previous rezoning have expired, necessitating an amendment of the current ordinance to move forward.  Consequently, the applicant is requesting an amendment of the rezoning ordinance for the completion  of the project and additionally for relief from the “NO VEHICULAR ACCESS” Plant Screening Easement for  a dedicated driveway of approximately 45 feet wide to enable ingress and egress at a commercial scale  on to Komohana Street as not to impede neighboring residential driveways and proposed driveway  location is crucial to ensuring safe and efficient access. The applicant is also requesting a reduction of  the speed limit along Komohana Street, specifically the portion fronting the subject property, from forty‐ five (45) miles per hour to thirty‐five (35) miles per hour. The applicant is also seeking a removal of the  rezoning conditions G, H, J, and K in the amendment to the ordinance.  III. PROJECT LOCATION  The subject area, consisting of 221,067 square feet, is located in the City of Hilo and more  specifically at 279 Komohana Street, southeast of the intersection with Ponahawai Street. TMK (3) 2‐3‐ 037‐006‐0000 (EXHIBIT C), (EXHIBIT F), (EXHIBIT I).    IV. REZONING CONDITIONS  The subject area was initially rezoned into the CN‐20 district on May, 20, 2010, subject to a number  of conditions.  An administrative time extension for completion of the project was granted on December  23, 2016. (EXHIBIT B) This section covers the status of the various conditions of the rezoning ordinance  (ORD. 10‐45) as originally enumerated and the changes to be made as if a new ordinance was to be  adopted.  A. The applicant(s), successors or assigns shall be responsible for complying with all of the  stated conditions of approval.    The property is owned by KBXtreme Hilo, LLC, and as such, intends to assume the  responsibility of complying with all pertinent conditions and any amendments thereto of  this rezoning ordinance.    B. Prior to the issuance of a water commitment by the Department of Water Supply the  applicants shall submit the anticipated maximum daily water usage calculations as  recommended by a registered engineer and a water commitment deposit in accordance  with the Water Commitment Guidelines Policy to the Department of Water Supply prior  to the issuance of a building permit.    The applicant shall comply with this requirement by making the required payment, if  needed, prior to the issuance of a building permit.    C. The applicants shall install a reduced pressure type backflow prevention assembly within  five 5 feet of the existing water meter and any additional water meters on private  property which must be inspected and approved by the Department of Water Supply  prior to issuance of a Certificate of Occupancy.    The applicant shall comply with this requirement.    D. The applicants shall relocate and adjust the Department of Water Supply water system  facilities that are affected by construction of improvements within the Ponahawai Street  right‐of‐way fronting the subject property that are required by this permit.    The applicant shall comply with this requirement when developing access to Ponahawai  Street.    E. Construction of the proposed improvements shall include securing Final Plan Approval  from the Planning Director in accordance with Section 25‐2‐70, Chapter 25 Zoning Code  Hawaii County Code.    The Applicant is requesting the Planning Department to allow a new or amended  rezoning ordinance with a 10 year time limit on the construction of improvements, due  to the scope and size of the project.    F. Development of the property shall be designed and constructed in a way to minimize  obstruction of the scenic views of Hilo Bay from Komohana Street.    The applicant shall comply with this and has planned for this in its construction design.    G. Deleted.    The requirement to provide a minimum 30‐foot‐wide access easement on the subject  property, in favor of the adjacent landowner(s) (TMK: 2‐3‐037:22) shall be deleted.  Initially, the rezoning ordinance was intended for the construction of a commercial  office building, and both TMKs mentioned were under the ownership of a single fee  owner. However, the circumstances have changed as the TMKs now have separate fee  owners, and the original plan for a commercial office building is no longer being  pursued. As a result, the need for internal traffic circulation between the two properties  is no longer relevant. Furthermore, the neighboring TMK to the east has its own  dedicated access to Ponahawai Street, making the provision of an easement through the  subject property unnecessary for accessing Ponahawai Street.    H. Deleted.    The applicant is seeking relief from Condition H, as the designated entrance through the  road and utility easement "RU‐9" on Komohana Street is not viable for commercial  property. This entrance would place excessive stress and traffic on the driveway of the  adjacent residential property, which is undesirable. The applicant has developed plans  that ensure unimpeded access from Komohana Street. The proposed entrance is located  at a sufficient distance from the traffic control device at the intersection of Komohana  Street and Ponahawai Street. Additionally, the applicant has made provisions for  necessary off‐site work to widen the pavement and accommodate left turn‐in channel  lane and left turn‐out merge lane, ensuring minimal interference with traffic flow along  Komohana Street. (EXHIBIT D; EXHIBIT L)    I. Access connections to Ponohawai Street and Komohana Street shall conform to Chapter  22 (County Streets) of the Hawai’i County Code.    The applicant shall comply with this requirement.     J. Deleted.    The applicant is seeking relief from Condition J, particularly the requirement to provide  curb, gutters, sidewalk, drainage improvements, and utility relocation along Komohana  Street. It should be noted that these improvements are absent on neighboring parcels  along Komohana Street as well. However, the applicant does intend to undertake  pavement widening as necessary to fulfill their Sign and Striping Plan (EXHIBIT D).    K. Deleted.    The applicant is seeking relief from this requirement, as they have planned to address  the need for lighting through the installation of sufficient light standards in the parking  lot and driveway entrances on the property. These on‐site improvements will effectively  fulfill the lighting requirements without the need for additional streetlights or traffic  control devices.    L. A Traffic Impact Analysis Report (TIAR) shall be submitted for review and approval by the  Department of Public Works prior to Final Plan Approval. The applicants shall implement  when required by the Department of Public Works, at no cost to the County, any  transportation improvements deemed necessary by the Department of Public Works.    TIAR Compliance (Completed and Attached)  A Traffic Impact Analysis Report (TIAR), dated July 21, 2025, which is within six (6)  months of this resubmittal, has been completed and is submitted herewith for review  and approval by the Department of Public Works (EXHIBIT L). The TIAR was prepared in  accordance with Hawai‘i County Code Chapter 25, Section 25‐2‐46 (Concurrency  Requirements) and evaluates the Komohana Street corridor, the Ponahawai Street  intersection area, and the proposed project driveway.     The TIAR analyzes the proposed family entertainment center (including bowling and  accessory restaurant/bar/arcade uses) and concludes that the project is not expected to  create significant adverse impacts to traffic operations on Komohana Street or nearby  intersections, with acceptable operations projected through the study horizon. The TIAR  also identifies and recommends specific access improvements at the Komohana Street  driveway to support safe and efficient ingress/egress, including turn‐lane and driveway  channelization improvements.    The applicant will implement TIAR‐recommended and DPW‐required transportation  improvements, at no cost to the County, in conjunction with final plan approval and  permitting.      M. Any construction within the designated FEMA flood zone shall comply with the  requirements of Chapter 27, Floodplain Management, of the Hawai’i County Code.    The applicant shall comply with this requirement.    N. All development‐generated runoff shall be disposed of on‐site and shall not be directed  toward any adjacent properties. A drainage study shall be prepared and submitted to  the Department of Public Works prior to the issuance of Final Plan Approval.  Any  drainage improvements if required shall be constructed meeting with the approval of the  Department of Public Works prior to the issuance of a Certificate of Occupancy.    The applicant shall comply with this requirement.    O. During construction, measures shall be taken to minimize the potential of both fugitive  dust and runoff sedimentation. Such measures shall be in compliance with construction  industry standards and practices utilized during construction projects of the State of  Hawai’i.    The applicant shall comply with this requirement.    P. All earthwork activity, including grading and grubbing, shall conform to Chapter 10  Erosion and Sedimentation Control, of the Hawaii County Code.    The applicant shall comply with this requirement.    Q. Comply with Chapter 11‐55, Water Pollution Control, Hawai’i Administrative Rules,  Department of Health, which requires a NPDES permit for certain construction activity.    The applicant shall comply with this requirement.    R. Construction activities must comply with the provisions of Hawai’i Administrative Rules,  Chapter 11‐46, “Community Noise Control.”    The applicant shall comply with this requirement.    S. The applicants shall install a septic system(s) meeting with the requirements of the  Department of Health prior to the issuance of a Certificate of Occupancy. In the future,  should a public sewer system be installed in Ponahawai Street or Komohana Street  fronting the subject property, the applicants shall connect to the sewer system.    The applicant shall comply with this requirement.    T. A Solid Waste Management Plan shall be submitted to the Department of Environmental  Management for review and approval prior to Final Plan Approval.    The applicant shall comply with this requirement.    U. Should any remains of historic sites, such as rock walls, terraces, platforms, marine shell  concentrations or human burials be encountered, work in the immediate area shall cease  and the Department of Land and Natural Resources ‐ State Historic Preservation Division  (DLNR‐SHPD) shall be immediately notified. Subsequent work shall proceed upon an  archaeological clearance from the DLNR‐SHPD when it finds that sufficient mitigation  measures have been taken.    The applicant shall comply with this requirement.    V. To ensure that the Goals and Policies of the Housing Element of the General Plan are  implemented, the applicants shall comply with the requirements of Chapter 11, Article 1,  Hawai’i County Code relating to Affordable Housing Policy. This requirement shall be  approved by the Administrator of the Office of Housing and Community Development  prior to final plan approval or final subdivision approval for any new residential  structures.    The applicant shall comply with this requirement.    W. If the applicants, successors, or assigns develops residential units on the subject  property, the applicants shall make their fair share contribution to mitigate the potential  regional impacts of the property with respect to parks and recreation, fire, police, solid  waste disposal facilities and roads. The fair share contribution shall become due and  payable prior to receipt of Final Plan Approval. The fair share contribution for each lot  shall be based on the actual number of residential units developed. The fair share  contribution in a form of cash, land, facilities or any combination thereof shall be  determined by the County Council. The fair share contribution may be adjusted annually  beginning three years after the effective date of this ordinance based on the percentage  change in the Honolulu Consumer Price Index (HCPI). The fair share contribution shall  have a combined value of $7,698.11 per multiple family residential unit ($11,996.63 per  single family residential unit).  The total amount shall be determined with the actual  number of units according to the calculation and payment provisions set forth in this  condition. The fair share contribution per multiple family residential unit (single family  residential unit) shall be allocated as follows:    1. $3,797.26 per multiple family residential unit ($5,784.99 per single family  residential unit) to the County to support park and recreational improvements  and facilities;    2. $120.01 per multiple family residential unit ($279.07 per single family residential  unit) to the County to support police facilities;    3. $369.17 per multiple family residential unit ($551.20 per single family residential  unit) to the County to support fire facilities;    4. $164.54 per multiple family residential unit ($241.32 per single family residential  unit) to the County to support solid waste facilities; and    5. $3,247.12 per multiple family residential unit ($5,140.06 per single family  residential unit) to the County to support road and traffic improvements.    In lieu of paying the fair share contribution, the applicants may contribute land and/or  construct improvements facilities related to parks and recreation, fire, police, solid waste  disposal facilities and roads within the region impacted by the proposed development,  subject to the review and recommendation of the Planning Director, upon consultation  with the appropriate agencies and approval of the County Council.     The applicant shall comply with this requirement.     X. Should the Council adopt a Unified Impact Fees Ordinance setting forth criteria for  imposition of exactions or the assessment of impact fees, conditions included herein shall  be credited towards the requirements of the Unified Impact Fees Ordinance.    The applicant shall comply with this requirement.    Y. The applicants shall comply with all applicable County State and Federal laws, rules,  regulations and requirements.    The applicant shall comply with this requirement.    Z. Deleted.    Considering the allowance of indoor amusement and recreation facilities within the  Neighborhood Commercial , no time limits shall be imposed on construction of  improvements.    AA. Deleted.    KBXtreme requests that the County Council approve a new rezoning ordinance to  ensure compliance with the conditions outlined above.    BB. Added.    Partial relief from “NO VEHICULAR ACCESS” PLANTING SCREEN EASEMENT in an area of  the property fronting Komohana Street to provide for commercial driveway access that  will not interfere with neighboring residential property access. Due to the unsuitability of access and utility easement RU‐9, a new area of ingress and  egress to the parcel must be created. The area identified for relief is a stretch of  approximately 45 feet on the Komohana Street facing boundary that will accommodate  commercial traffic flow and left‐turn lanes into and out of the parcel. The completed  Traffic Impact Analysis Report (TIAR) (EXHIBIT L) evaluates the proposed driveway  location and associated traffic operations and concludes that, with the recommended  access improvements, the project is not expected to create significant adverse impacts  to traffic operations along Komohana Street or at nearby intersections. The TIAR further  identifies and recommends specific driveway and roadway improvements to support  safe and efficient ingress and egress, including turn‐lane and driveway channelization  improvements, which the applicant will implement as required during final plan  approval and permitting. The applicant has consulted with the Department of Public  Works (DPW) Engineering Division prior to submitting this application to discuss  necessary revisions regarding the “No Vehicular Access & Planting Screen” easement,  and has also engaged with the DPW Traffic Division to ensure that driveway placement  and the two‐way left‐turn lane (TWLTL) are positioned far enough away from the  Ponahawai/Komohana intersection. Based on consultations to date, the applicant  understands DPW Engineering may not support the requested relief and will document  any related technical concerns in their formal review comments on the resubmittal  materials. Additionally, the applicant has communicated with the neighboring TMK, and  their only request was to avoid sharing a driveway (specifically RU‐9) or having the  project driveway adjacent to theirs to prevent unintentional commercial traffic from  using a residential driveway; the applicant has worked to incorporate these  considerations to maintain good neighbor relationships. Notwithstanding any agency  comments, the applicant respectfully requests that the Planning Commission and  County Council consider and act upon the requested ordinance amendment and the  associated partial relief through the public process.    CC. Added    As a matter of public safety, the Planning Commission and County Council recommend  that the Department of Public Works (DPW) evaluate the posted speed limit along  Komohana Street fronting the subject property and consider a reduction of the posted  speed limit from forty‐five (45) miles per hour to thirty‐five (35) miles per hour. This  recommendation is intended to support safe ingress and egress to the site and to  improve overall traffic safety in light of the proposed commercial driveway access and  turning movements. Nothing in this condition shall be construed to alter or supersede  the independent authority of DPW with respect to speed limit determinations or traffic  control measures.      V. RESTATEMENT OF REQUEST  The applicant is seeking to move forward with the development of the site, facing challenges  presented by certain rezoning conditions that are either no longer applicable or impede the feasibility of  the Family Entertainment Center project. Additionally, the previous rezoning deadlines have lapsed,  requiring either a new or amended rezoning ordinance to proceed.  Furthermore, the applicant seeks  partial relief from the “NO VEHICULAR ACCESS” planting screen easement to provide for commercial  driveway access, and a reduction in the speed limit along Komohana Street, specifically on the subject  property frontage, from 45 mph to 35 mph.        VI. JUSTIFICATION OF REQUESTS  From the 2005 General Plan, SECTION 12.2 (a) GOALS  “Provide a wide variety of recreational  opportunities for the residents and visitors of the County”; From the 2005 General Plan, SECTION 12.3  (f) POLICIES “The "County of Hawaii Recreation Plan" shall be updated to reflect newly identified  recreational priorities”; From the 2005 General Plan, SECTION 12.3 (h) POLICIES “Provide facilities and a  broad recreational program for all age groups, with special considerations for the handicapped, the  elderly, and young children.”; From the 2005 General Plan, SECTION 12.3 (i) POLICIES “Coordinate  recreational programs and facilities with governmental and private agencies and organizations.  Innovative ideas for improving recreational facilities and opportunities shall be considered”. SECTION  12.5.2.1 SOUTH HILO – PROFILE “In many of the parks, there are drainage problems. Lack of playground  equipment, inadequate landscaping, and the lack of benches and adequate shelters have restricted the  use of some parks. Some residential areas do not have easy access to neighborhood parks, and newer  communities lack recreational areas altogether.” 12.5.2.2(m) COURSE OF ACTION “Develop a  center/complex for major cultural, educational and recreational activities.”   KBXTREME is in a unique position to help achieve many of the County’s goals and policies through  the nature of its recreational offerings. Bowling has always been a popular sport, and facilities are  frequently utilized by schools, adult leagues, and senior clubs and leagues. Bowling coupled with an  arcade space and other activities creates a space for young children, seniors, and people with disabilities  to remain active and social while participating in a recreational activity in a safe environment with the  necessary facilities to accommodate their needs. Providing an indoor space for recreation allows for  continuous use independent of the weather conditions. Justification for proposed amendments follow:         1. AMEND CONDITION E, EXTENSION OF REZONING ORDINANCE  i. KBXtreme justifiably requests an extension of rezoning ordinance no. 10‐045.  Granting an extension of this rezoning ordinance would align with the General  Plan and Zoning Code, as it allows KBXtreme to proceed with their intended  development of the Family Entertainment Center.    ii. Moreover, the extension of this rezoning ordinance would not be contrary to  the original reasons for granting the change of zone.    2. REMOVAL OF CONDITION G  i. The minimum 30 foot wide access easement in favor of the adjacent  landowner to the east (TMK 3‐2‐3‐037‐014) was provisioned previously when  a commercial office building was being contemplated on both parcels.    ii. The two properties were subsequently sold individually to two different  owners, and the previously planned commercial office building is no longer  contemplated.    iii. Each TMK has their own dedicated access to Ponahawai, and the previously  planned easement to provide for internal traffic circulation between both  neighboring properties is now irrelevant.      3. REMOVAL OF CONDITION H, PROVIDING RELIEF FROM RIGHT‐TURN IN/OUT TRAFFIC  FLOW AND ACCESS THROUGH UTILITY EASEMENT RU‐9 ONLY.  i. KBXtreme has engaged in discussions with the neighboring landowner to the  south (TMK 3‐2‐3‐037‐022) and sharing of the utility easement "RU‐9" is not  possible, nor does it provide reasonable access to the subject commercially  zoned property.  ii. The neighboring residential property would experience unnecessary  commercially related traffic down their driveway if forced to share access via  RU‐9.  iii. There are too many private utility poles located on RU‐9, that would present  unnecessary risk by routing commercial traffic through the narrow roadway.  iv. KBXtreme has been in discussion with the County of Hawaii Department of  Public Works Traffic Division regarding widening pavement, creating left turn  channel and merge lanes into and out of TMK: 3‐2‐3‐037:006 from Komohana  Street, and is planning for necessary off‐site work to provide smooth ingress  and egress to the subject property without interfering with neighboring  driveways or the flow of traffic on Komohana Street, while providing sufficient  distance from the traffic control device located at the Komohana and  Ponahawai intersection (EXHIBIT D).    4. REMOVAL OF CONDITION J WITH REGARD TO CURBS, GUTTERS, SIDEWALK, DRAINAGE  IMPROVEMENTS AND UTILITY RELOCATION ALONG KOMOHANA STREET.  i. KBXtreme requests relief from Condition J, which mandates the provision of  curbs, gutters, sidewalk, drainage improvements, and utility relocation along  Komohana Street.   ii. The requirement for these improvements greatly impedes the feasibility of our  project.   iii. Not only do neighboring parcels along Komohana Street lack these features, but  enforcing this condition exclusively on KBXtreme creates an undue burden.   iv. KBXtreme plans to address the necessary pavement widening to accommodate  the proposed striping and sign plan.     5. REMOVAL OF CONDITION K, STREETLIGHTS AND TRAFFIC CONTROL DEVICES.  i. Given the unique circumstances of the applicant's project, it is justifiable to  grant relief from the requirement of installing streetlights and traffic control  devices as stipulated by the Traffic Division Department of Public Works.   ii. The applicant has demonstrated proactive planning and commitment to public  safety by proposing an alternative strategy that is specifically tailored to the  project's requirements.   iii. The implementation of adequate lighting standards within the parking lot and  driveway entrances ensures that the necessary illumination will be provided on‐ site, thus negating the necessity for additional streetlights.   iv. This solution not only maintains safety standards but also minimizes potential  light pollution and cost to the county.   v. The traffic control needs, as well, are anticipated to be suitably addressed  through the well‐designed layout for ingress and egress to the property. This  approach reflects a careful consideration of both functionality and aesthetics,  while still upholding the core objective of ensuring safety and visibility.  vi.  Therefore, it is reasonable to consider this request for exemption, recognizing  that the proposed on‐site improvements fulfill the intention of the original  condition.    6. REMOVAL OF CONDITION Z, TIME LIMITS.  i. The removal of the proposed improvements within a five year time frame  renders this condition moot.    7. ADDITION OF CONDITION BB, PARTIAL RELIEF FROM “NO VEHICULAR ACCESS”  PLANTING SCREEN EASEMENT FOR COMMERCIAL DRIVEWAY   i. Due to the unsuitability of access and utility easement RU‐9 a new area of  ingress and egress to the parcel must be created.  ii. The area identified for relief is a stretch of approximately 45 feet on the  Komohana Street facing boundary that will accommodate commercial traffic  flow and left turn lanes into and out of the parcel.   iii. The applicant has consulted with the Department of Public Works (DPW)  Engineering Division prior to submitting this application to discuss necessary  revisions regarding the "No Vehicular Access & Planting Screen" easement.   iv. The Traffic Division has also been engaged to ensure that the driveway  placement and two‐way left turn lane (TWLTL) are positioned far enough away  from the Ponahawai/Komohana intersection.  v. Additionally, there has been communication with the neighboring TMK, and  their only request was to avoid sharing a driveway or having our driveway  adjacent to theirs to prevent unintentional commercial traffic from using their  residential driveway.   vi. We have worked diligently to incorporate these considerations into our plans to  maintain good relationships with our neighbors.    8. ADDITION OF CONDITION CC, REDUCTION OF THE SPEED LIMIT ALONG KOMOHANA  STREET FRONTING THE SUBJECT PROPERTY FROM 45MPH, DOWN TO 35MPH.  i. While we understand that posted speed limits and traffic control measures  are administered by the Department of Public Works (DPW) and may be  outside the direct purview of the Planning Department, we respectfully  request that the Planning Commission and County Council, through action on  this rezoning ordinance amendment, include a recommendation that DPW  evaluate and, if appropriate, reduce the posted speed limit along Komohana  Street fronting the subject property from 45 mph to 35 mph as a matter of  public safety.  ii. The request for a reduction of the speed limit along Komohana Street fronting  the subject property from 45 mph to 35 mph warrants strong consideration,  primarily due to existing precedents and the potential for enhanced safety.   iii. It is notable that the speed limit has already reduced to 35 mph at the  Komohana Street property frontage. Our proposal is simply an extension of  this current regulation, moving the reduction point south closer to Mohouli  Street. This adjustment is projected to have significant benefits in terms of  public safety.   iv. By encouraging more uniform travel speeds along this stretch of road, the  proposed change would reduce the potential for abrupt speed adjustments,  which can be a contributing factor to accidents.   v. Furthermore, a lower speed limit in this area could lead to reduced severity of  accidents, should they occur, given the correlation between speed and crash  impact.   vi. By extending the 35 mph zone closer to Mohouli Street, it would create a  more consistent, predictable, and thus safer, driving environment for all users  of Komohana Street.    Pursuant to this amendment request, please find enclosed the following:  1. A copy of this letter, with appropriate enclosures; and  2. Introduction A. Project Description KBXtreme, LLC is proposing to develop the Hilo Entertainment Center in South Hilo, Hawai`i Island. The project site is identified as Tax Map Key: 2-3-037:006. The 5.075- acre property is located on the east side of Komohana Street, about 100 feet south of Ponahawai Street. Figure 1 depicts the project location. The Hilo Entertainment Center is expected to be fully built out and operational by the Year 2030. The Hilo Entertainment Center will consist of a 20-lane bowling alley. In addition to the bowling alley, commercial activities will include a restaurant, a bar, and an arcade, totaling 23,287 square feet of gross floor area. KBXtreme, LLC will be submitting a change of zone for the property to the County of Hawai`i from agricultural to commercial zoning. Access to the Hilo Entertainment Center will be provided by one (1) driveway on the east side of Komohana Street, about 450 feet south of Ponahawai Street. The proposed site plan is depicted in Figure 2. B. Purpose and Scope of the Study The purpose of this study is to analyze the traffic impacts of the proposed Hilo Entertainment Center. This Traffic Impact Analysis Report (TIAR) is prepared in accordance with the Hawai`i County Code Chapter 25 Section 25-2-46 (Concurrency Requirements). The scope of the TIAR for the proposed project includes the following: 1. Conduct turning movement traffic count surveys during the weekday AM, midday, and PM peak periods of traffic and the Saturday peak period of traffic at the intersection of Komohana Street and Ponahawai Street. 2. Analyze the data collected in Item No. 1 to establish the existing conditions. Hilo Entertainment Center Traffic Impact Analysis Report July 21, 2025 2 Figure 1. Estimate future traffic conditions for the 5-year, 10-year, and 20-year planning horizons, including other developments and traffic improvements in the vicinity, which have been approved or committed to within the time frame of this traffic study. 4. Analyze the 5-year, 10-year, and 20-year planning horizons traffic conditions without the proposed project, during the weekday AM, midday, and PM peak hours of traffic and the Saturday peak hour of traffic, in order to establish the baseline conditions from which to measure the traffic impacts of the proposed project. 5. Develop weekday AM, midday, and PM peak hour and Saturday peak hour trip generation characteristics for the proposed project, using generally accepted techniques developed by the Institute of Transportation Engineers. 6. Analyze the weekday AM, midday, and PM peak hour and Saturday peak hour site- generated traffic impacts for the 5-year, 10-year, and 20-year planning horizons. 7. Recommend traffic improvements that would mitigate the traffic impacts identified in this traffic study. C. Methodologies 1. Capacity Analysis The highway capacity analysis, performed in this study, is based upon procedures presented in the Highway Capacity Manual, 7th Edition (HCM), published by the Transportation Research Board. HCM defines the Level of Service (LOS) as “a quantitative stratification of a performance measure or measures representing quality of service.” HCM defines the six (6) Levels of Service from the traveler’s perspective, ranging from the best LOS “A” to the worst LOS “F”. LOS translates the complex mathematical results of the highway capacity analysis into an A through F grading system for the purpose of simplifying the roadway performance for decision-makers. Synchro is a traffic analysis software that was developed by Trafficware. Synchro is an intersection analysis program that is based upon the HCM 7th Edition methodology. Synchro is used to calculate the Levels of Service for the intersections in the study area. Worksheets for the capacity analysis, performed throughout this report, are compiled in the Appendix. LOS’s “A”, “B”, and “C” are generally considered to be satisfactory Levels of Service. The Hawai`i County Code Chapter 25, Section 25-2-46 “Concurrency Requirements” defines LOS “D” as the minimum acceptable Level of Service. LOS’s “E” and “F” are defined as worse than acceptable Levels of Service. The intersection LOS is primarily based upon average delay (d) in seconds per vehicle (sec/veh). The delays at unsignalized intersections, which include stop-controlled intersections and roundabouts, are generally shorter than signalized intersections, due to the drivers’ expectation and acceptance of longer delays at higher-volume signalized intersections. Table 1 summarizes the HCM LOS criteria. Hilo Entertainment Center Traffic Impact Analysis Report July 21, 2025 5 Table 1. Intersection Level of Service Criteria (HCM) LOS Signalized Control Unsignalized Control Description A d10 d10 Control delay is minimal. B 10<d 20 10<d15 Control delay is not significant. C 20<d35 15<d25 Stable operation. Queuing begins to occur. D 35<d55 25<d35 Less stable condition. Increase in delays, decrease in travel speeds. E 55<d80 35<d50 Unstable operation, significant delays. F d80 d50 High delays, extensive queuing. 2. Trip Generation The trip generation methodology is based upon generally accepted techniques developed by the Institute of Transportation Engineers (ITE) and published in the Trip Generation Manual, 11th Edition. The ITE trip rates for a bowling alley were developed by correlating the total vehicle trip generation data with various land use activities/ characteristics, such as the vehicle trips per hour (vph) per bowling lane. II. Existing Conditions A. Roadways Komohana Street is a two-way, two-lane collector roadway between Waianuenue Avenue and Ainaola Drive in South Hilo. North of Ponahawai Street, the posted speed limit on Komohana Street is 35 miles per hour (mph). South of Ponahawai Street, the posted speed limit on Komohana Street increases to 45 mph. Komohana Street provides exclusive left-turn and right-turn lanes at its signalized intersection with Ponahawai Street. Ponahawai Street is a two-way, two-lane collector roadway between Komohana Street and Kamehameha Avenue. Ponahawai Street provides separate left-turn and right-turn lanes at its signalized Tee-intersection with Ponahawai Street. The posted speed on Ponahawai Street is 40 mph. completeness review items for the above‐referenced application. This revised supplement is intended to  supplement and clarify the January 14, 2026 revised application package. To the extent any prior narrative  language is inconsistent with this revised supplement, this revised supplement is intended to supersede the  inconsistent language only for the subjects addressed below.  The applicant remains committed to moving the application forward in a clear and coordinated manner and  appreciates the Planning Department's guidance in identifying the items that should be clarified before the  application is accepted as complete.  1. Condition B ‐ Time Extension and Building Permit Timing  The applicant acknowledges that the original Condition B of Ordinance No. 10‐45 required the anticipated  maximum daily water usage calculations, as recommended by a registered engineer, and the water commitment  deposit to be submitted to the Department of Water Supply within 180 days from the effective date of the  ordinance. The applicant further acknowledges that this requirement was not completed within the original 180‐ day period.  To address this directly, the applicant hereby expands and clarifies the pending ordinance amendment request to  include a time extension and amendment to Condition B. The requested amendment would extend the original  180‐day deadline and align the water commitment requirement with the current project request by requiring the  water usage calculations and required water commitment deposit to be completed before issuance of a  Department of Water Supply water commitment and before issuance of the first building permit for the project.  The applicant is not requesting that the Department of Water Supply requirement be waived. Rather, the  applicant requests that the timing be updated to match the present stage and realities of the project while  preserving the Department of Water Supply's full review authority. The water calculations and deposit should be  tied to the current family entertainment center project, current engineering, and the site plan that will be used for  the Planning Commission presentation, rather than to the former commercial office concept associated with the  original rezoning.  This timing is also important to the financial feasibility of the project. KBXtreme Hilo, LLC is making a significant  private investment in a community‐based facility intended to serve Hilo families, students, seniors, leagues, local  KBXtreme Hilo, LLC ‐ Revised Supplemental Application Response  employees, and community events. The application narrative identifies the project as highly leveraged, with  construction costs expected to exceed $10 million. Requiring a water commitment deposit before the entitlement,  plan approval, construction drawing, financing, and building permit pieces are aligned would unnecessarily tie up  capital that is needed to move the project through the remaining pre‐construction steps. Aligning the payment  with the building permit stage allows the applicant to preserve project capital until the project is ready to proceed,  while still ensuring that no water commitment or building permit is issued until the Department of Water Supply  requirement is satisfied.  The applicant understands that the Department of Water Supply may require time to review the calculations and  process any water commitment before building permit issuance. The applicant will coordinate with the  Department of Water Supply sufficiently in advance of the building permit stage so that this condition can be  resolved without delaying construction once the project is otherwise ready to proceed.  Requested amended Condition B:  B. Prior to the issuance of a water commitment by the Department of Water Supply and prior to the  issuance of the first building permit for the proposed development, the applicant(s), successors or assigns  shall submit to the Department of Water Supply the anticipated maximum daily water usage calculations,  as recommended by a registered engineer, and a water commitment deposit in accordance with the Water  Commitment Guidelines Policy, or as otherwise required or approved by the Department of Water Supply.  The time for performance of this condition is hereby extended and amended from the original requirement  that performance occur within one hundred eighty (180) days from the effective date of Ordinance No. 10‐ 45 to the timing set forth in this amended condition. No water commitment shall be issued by the  Department of Water Supply, and no building permit for the proposed development shall be issued, until  the Department of Water Supply confirms that the requirements of this condition have been satisfied or  otherwise addressed to its satisfaction.  The applicant is willing to work with Planning Department staff, the Department of Water Supply, and the  Planning Commission on non‐substantive wording revisions needed to conform the requested Condition B  amendment to the County's preferred ordinance format, provided that the amended condition preserves the  requested extension to the building permit stage and continues to protect the Department of Water Supply's  authority.  2. Surrounding Property Owners Within 300 Feet  The applicant understands that the previously submitted surrounding property owner list was incomplete. The  applicant will replace the previously submitted Exhibit E with a revised Exhibit E generated using the County Real  Property Tax website buffer tool and consistent with the accurate list provided by the Planning Department.  The previously submitted Exhibit E should be considered superseded. Enclosed/uploaded with this supplement are  the corrected 300‐foot surrounding property owner list and corresponding mailing labels generated from the  County Real Property Tax website buffer tool. If the Planning Department requires any formatting change to the  mailing labels or owner list, the applicant will provide the requested revision promptly.  3. Controlling Site Plan for Planning Commission Presentation  The applicant confirms that the most accurate site plan for Planning Commission presentation is the site plan  included in the Final Traffic Impact Analysis Report dated July 21, 2025, specifically Figure 2, "Hilo Entertainment  Center Site Plan."  KBXtreme Hilo, LLC ‐ Revised Supplemental Application Response  Any different site plans included in the application narrative or earlier exhibit materials should be treated as  preliminary, supporting, or superseded drawings for purposes of Planning Commission presentation. The TIAR site  plan should be used as the controlling conceptual site plan at this stage.  This clarification does not change the applicant's understanding that final building layout, parking layout, civil  improvements, drainage, utility details, and other design items will be reviewed and finalized through Final Plan  Approval, Department of Public Works review, Department of Water Supply review, and the Building Permit  process. The purpose of this clarification is simply to provide a single site plan for the Planning Commission record  and staff presentation.  4. EPIC Contact and Billing Contact Update  Ralph Brown should be removed as the billing contact in EPIC, and the billing contact information should be  updated. The updated billing contact is:  Billing Contact Nancy Wang‐Ponthier  Title / Entity Accountant / Accounts Payable  Mailing Address 75‐5591 Palani Road, Suite 3008, Kailua‐Kona, Hawai'i 96740‐3633  Phone / Email 808‐930‐9208 /     If Planning Department staff still sees Ralph Brown associated with any billing or application‐contact role that  should be removed, please advise and the applicant will correct the EPIC entry promptly.  5. Request for Acceptance as Complete  With this revised supplement, the revised 300‐foot surrounding property owner list, the mailing labels, the  controlling TIAR site plan clarification, and the EPIC billing contact update, the applicant respectfully requests that  the Planning Department accept the application as complete and continue processing it for the Planning  Commission.  Mahalo for your continued assistance.  Sincerely,  Calvin C. M. Higa Water is available from an existing 8-inch waterline within Ponahawai Street and from an existing 12- inch waterline within Komohana Street, both fronting the subject parcel. There is an existing 1-inch service lateral to the subject parcel, capable of accommodating a 5/8-inch meter, which is limited to a maximum daily usage of 600 gallons. The Department has no objection to the proposed application: however, prior to issuing a water commitment, the applicant shall comply with the following conditions: 1. The Department requests that the applicant submit estimated maximum daily water usage calculations for review and approval. The water usage calculations shall be prepared by a professional engineer licensed in the State of Hawaii and should include the estimated peak flow in gallons per minute (GPM) and the total estimated maximum daily water usage in gallons per day, including all irrigation'landscaping use. Upon receipt of the water usage calculations above, the Department will make a determination as to the water commitment deposit amount_ prevailing facilities charge(subject to change) to be paid. and any water system improvements required for final approval. Based on the water usage calculations provided, if the existing 5'8-inch meter cannot accommodate the estimated demand, a larger or additional meter will need to be installed and remittance of the prevailing facilities charge, will be required. 2. The proposed zoning will require the installation of a reduced pressure type backllow prevention assembly, within live (5) feet ofthe existing meter on private property. if a larger or additional meter is required, rt hackflow prevention assembly will also be required for that meter. We appreciate the Department of Water Supply's review, comments, and recommendations regarding the existing water meter, the need for anticipated water usage calculations, and the importance of establishing a water commitment. We understand DWS's comment that the existing 5/8-inch meter serving the subject parcel is limited to an average daily usage of 400 gallons and is suitable only for one single-family dwelling. We also understand DWS's recommendation that the required water usage calculations be submitted and that a water commitment be established as soon as possible, since water availability may change until a water commitment is officially issued. In response, we have reached out to our project architect, Shane Labeth, and Bruce Meyers of Okahara and Associates, Inc., to review the prior project files and assist us in determining whether any prior water demand calculations, plumbing fixture schedules, mechanical plans, or related documentation were previously prepared. If those calculations were not previously completed, we will work with the appropriate design professionals to determine what is needed to prepare the required water usage calculations for DWS review. 75-5591 Palani Road, Suite 3008 Kailua-Kona, Hawaii 96740 (808) 329-0911 FAX(808) 329-0913 As background, this is a complex, community-based project with substantial private capital at risk. We are working to move the project forward in a fiscally responsible manner while also trying to defer certain project costs until the entitlement, plan approval, construction drawing, financing, and building permit pieces are properly aligned. Bowling and family entertainment facilities are not generally high-margin or financially lucrative businesses, but we believe this project can provide a meaningful benefit to the Hilo community by creating a safe, indoor, family-friendly recreational facility for residents, students, seniors, local families, and visitors. Our intent is not to delay necessary coordination with DWS, but rather to proceed carefully and responsibly as we get the project's requirements in order. We appreciate DWS's guidance and will coordinate with our consultants regarding the water usage calculations and next steps for establishing the appropriate water commitment. Thank you again for your input and recommendations. We look forward to working with the Department of Water Supply, the Planning Department, and the County as we continue moving toward bringing this project to life for the Hilo community. As part of our Change of Zone Amendment Application, KBXtreme Hilo, LLC requested relief from the original 180-day timeframe in Condition B. The purpose of that request was to address the fact that the original timeframe had passed and to better align the water commitment requirement with the current status of the project, including the need to complete entitlement, plan approval, construction drawing, financing, and building permit steps in a fiscally responsible manner. Since submitting the application, however, KBXtreme Hilo, LLC has been actively coordinating with the Department of Water Supply to address its comments and move the water commitment process forward. After receiving DWS’s comments, we contacted our project consultants and coordinated with Okahara and Associates, Inc. to prepare preliminary water use calculations for the proposed family entertainment center. Those calculations were submitted to DWS for review. We understand that DWS has reviewed the matter further and has advised regarding the applicable water commitment requirements, including arranging for a payment plan for the required fee. KBXtreme Hilo, LLC appreciates DWS’s assistance and guidance, and we are continuing to work cooperatively with DWS to further the water commitment process. Accordingly, while our application included a request for relief from the original 180-day timeframe in Condition B, we wish to clarify for the Commission that KBXtreme Hilo, LLC is not seeking to avoid the water commitment requirement. Rather, we requested relief to address the expired timing condition and to allow the project to proceed in an orderly and financially responsible manner. We have since taken active steps to satisfy DWS’s concerns and are working toward securing the required water commitment. To the extent the Planning Department, Department of Water Supply, or the Commission determines that the requested Condition B relief is no longer necessary or should be revised in light of the ongoing DWS coordination and payment-plan arrangement, KBXtreme Hilo, LLC is amenable to modifying that portion of the request accordingly. Our intent is to keep the record accurate, remain responsive to agency comments, and continue moving this community-based project forward in cooperation with the County. KBXtreme Hilo, LLC remains committed to developing a family entertainment center that can provide a safe, indoor, community-oriented recreational facility for Hilo residents, local families, students, seniors, and visitors. We appreciate the County’s review and the opportunity to provide this update. Respectfully submitted, Calvin C. M. Higa Jr. Senior Vice President WLW Development Methods, Inc. We sincerely appreciate DPW’s review of our application and the time taken to evaluate the requested amendments. KBXtreme Hilo, LLC respectfully provides the following responses. Item H – Komohana Street Access We appreciate DPW Engineering’s concurrence with removing the existing right-turn- in/right-turn-out restriction for the Komohana Street access. We understand and agree that the ultimate access improvements, including any auxiliary lanes along Komohana Street, should be consistent with the recommendations of the favorable consideration of this requested amendment. Item J – Komohana Street Frontage Improvements We respectfully request further consideration of the requirement for full curb, gutter, and sidewalk improvements along the project frontage. There are presently no adjoining sidewalks immediately north or south of the subject property extending toward the Ponahawai Street intersection. The existing condition along this portion of Komohana Street consists primarily of paved roadway shoulders. Requiring curb, gutter, and sidewalk improvements solely along the KBXtreme frontage would therefore create an isolated section of sidewalk that would not presently connect to a continuous pedestrian system. We are also mindful that Komohana Street functions as a busy Hilo thoroughfare and that including bicycle travel. The proposed KBXtreme Hilo facility intends to provide bicycle racks for patrons, and we anticipate that University of Hawai‘i at Hilo students and other nearby residents may utilize bicycles to access the facility. Rather than constructing an isolated curb-and-sidewalk segment, we respectfully request the opportunity to preserve and, where necessary, improve the existing paved shoulder in a manner that safely accommodates bicycle and pedestrian movement and remains consistent with the existing character of Komohana Street. We recognize DPW Engineering’s recommendation that Condition J remain subject to further discussion during construction plan review. As an alternative to complete deletion tage improvements to be determined by DPW during construction plan review, with consideration given to maintaining a safe paved shoulder or other bicycle- and pedestrian- compatible treatment in lieu of mandatory curb, gutter, and sidewalk improvements where appropriate. Our objective is to construct the frontage improvements in a safe, functional, and cost- to similar infrastructure on adjoining properties. Item K – We agree with DPW that adequate lighting at the project entrance is necessary for public safety, particularly given the anticipated evening operating hours of the facility. However, existing street lighting is already present within the surrounding Komohana Street project entrance is illuminated. -site streetlight infrastructure, we propose installing appropriately designed on-site lighting at the project driveway entrance. Our intent would be to utilize downward-facing light standards designed to provide the maximum practical illumination permitted under applicable County lighting requirements while minimizing glare, light spill, and impacts to neighboring properties. Locating these improvements on the project site would allow the necessary entrance lighting to be installed and maintained directly by the applicant, while reducing the -site streetlight infrastructure. -site entrance lighting can satisfy the public--site streetlights. We are not requesting relief from the responsibility to provide adequate lighting. Rather, we Item L – been included with the application. KBXtreme will continue to coordinate with DPW required as part of project design and permitting. We sincerely appreciate DPW Engineering’s review and recommendations. KBXtreme Hilo is a substantial community-based project, and we are working to move it forward in a manner that balances public safety, sound engineering, compatibility with existing infrastructure, and the substantial costs associated with development. We respectfully request that these responses and proposed alternatives be considered as the Planning Department prepares its recommendation to the Windward Planning Commission. Mahalo, Calvin C. M.
