APPELLANT'S EXHIBITS AND WRITTEN TESTIMONY
Appellant `OHANA O MOKUHULU, KAIMU MAKENA, AND KALAPANA
("Appellant"), by and through its attorneys, hereby submits its exhibits listed below, together
with the written testimony of Leslie Lihaunani Enriquez Rosehill, Howard Konanui, Leila
Kealoha, and Nainoa Rosehill (collectively, the "Written Testimony"), attached hereto, pursuant
to the Board's Scheduling Order filed July 10, 2026.
Appellant respectfully requests that the presiding officer receive the Written Testimony,
as the witnesses' prepared testimony on direct examination, in evidence without reading at the
November 13, 2026 hearing, as may be allowed under BOA Rules § 3-13(e) when substantial
saving in time will result. Copies of the Written Testimony are being served upon all parties and
filed with the Board at least fifteen (15) days before the hearing, to permit proper cross-
examination of the witnesses on matters contained in the Written Testimony. See also BOA
Rules § 3-13(a). Appellant nonetheless reserves the right to call any or all of these witnesses to
testify live at the hearing, including to supplement their Written Testimony, respond to cross-
examination, or offer rebuttal testimony.
Electronic copies of each of the below -listed exhibits and the Written Testimony are filed
through the County's electronic portal (EPIC), pursuant to BOA Rules §§ 2-4 and 3-13(g). A
shared folder with an electronic copy of each exhibit and the Written Testimony is also being
provided to the Board and all parties.
