Dear O'Oma Plantation Board Members,
The O'Oma Plantation Community are submitting the attached petition regarding the
Association's continued pursuit of legal action/expenses concerning Lot 6.
The petition contains 10 signatures from O`Oma Plantation homeowners
affirmatively stating that they do not support the Association continuing to
pursue this litigation.
For clarity, the 19 homeowners in the community are represented as follows:
10 homeowners have signed the petition opposing continued litigation and legal
expenses.
2 homeowners were asked but chose not to participate.
2 homeowners were asked but did not provide a response.
• 5 homeowners are believed to be directly involved in the litigation, four of
whom are believed to hold positions within the Association.
Accordingly, 10 of the 19 homeowners, representing a majority of the community,
have affirmatively expressed opposition to the Association continuing to pursue
the litigation and legal expenses not supported by a budget. We are not
characterizing the homeowners who did not participate or respond as either supporting
or opposing the litigation.
We respectfully request that the Board formally acknowledge receipt of the petition and
place this matter on the agenda for consideration at a properly noticed Board meeting.
Given that a majority of the homeowners have affirmatively expressed opposition to
continuing the litigation and legal expenses, we ask that the Board consider the
community's position before authorizing or incurring additional legal expenses with
Association funds for this matter.
We also request that the petition be retained with the Association's records and that the
membership be given an opportunity to have this matter addressed at a properly noticed
Board meeting.
Please confirm receipt of the attached petition and advise when the Board intends to
address this issue with our community.
