HomeMy WebLinkAbout2010-10-13 Board of Ethics Agenda BOARD OF ETHICS , County of Hawaii 101 Aupuni Street, Suite 325, Hilo, Hawaii 96720 A G E N D A Wednesday, October 13, 2010 - 10:00 a.m. 25 Aupuni Street (County Council Chambers) Hilo, Hawai‘i 96720 1.CALL TO ORDER 2.STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS 3.APPROVAL OF MINUTES Minutes of the September 8, 2010, Regular Session. 4.COMMUNICATIONS Communication No. 2010-073: dated 9/30/10 from Council Member Dennis “Fresh” Onishi to the Board, requesting that it review and resubmit comments and recommendations regarding Bill 230, relating to the Code of Ethics. 5.NEW BUSINESS a. Petition No. 2010-08: Employee’s request for an informal advisory opinion on whether she may work part-time as a marriage and family therapist in private practice. b. Petition No. 2010-09: Initial review of petition alleging that an officer and officer’s aide improperly used County property and equipment for personal or campaign purposes and improperly engaged in a personal or business relationship as supervisor and subordinate. 6.UNFINISHED BUSINESS a. Review draft order dismissing Petition No. 2010-06, which alleged that the Board, or its members, had a conflict of interest in its handling of a petition. b. Review draft informal advisory opinion for Petition No. 2010-07, regarding whether an employee may work part-time as a security guard at a transfer station while also employed as an account clerk with the Department of Environmental Management. 7.EXECUTIVE SESSION With reference to the agenda items listed below, one or more executive meetings are anticipated. In particular, the Board of Ethics anticipates it may consider the evaluation, dismissal, or disciplining of an officer or employee of the County of Hawai‘i, where considerations of matters affecting privacy will be involved. The Board may also consult with the Board’s attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities. Therefore, pursuant to Hawai‘i Revised Statutes (“HRS”) Sections 92-5(a)(2), 92-5(a)(4), and 92-6(a)(2), the following items may be considered in Executive Session. a.Approval of the minutes of the September 8, 2010, Executive Session. b.Review of Confidential Financial Disclosure Forms filed pursuant to Section 2- 91.1(d), Hawai‘i County Code, by County board and commission members and designated County employees, where personal matters will be reviewed: Board, Commission, Name Positionor Department 1Bernard Balsis, Jr. Member Board of Ethics 2David Heaukulani Member Board of Ethics 3Kenneth Kaneshiro* Member Water Board 4Franklin Nacis* Electrical Inspector Public Works Department 5Stephen Ono* Member Planning Commission (E. NOTICE TO LOBBYISTS If you are a lobbyist, you must register with the Hawai‘i County Clerk within five days of becoming a lobbyist (Article 15, Section 2-91.3(b), Hawai‘i County Code). A lobbyist means “any individual engaged for pay or other consideration who spends more than five hours in any month or $275 in any six-month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials.” (Article 15, Section 2-91.3(a)(6), Hawai‘i County Code.)
