HomeMy WebLinkAbout2011-05-04 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES MAY 4, 2011 The Windward Planning Commission met in regular session at 9:20 a.m. in the County of Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman Zendo Kern presiding. COMMISSIONERS PRESENT: Zendo Kern, Dean Au, Takashi Domingo, Wallace Ishibashi, and Stephen Ono STAFF PRESENT: Julie Mecklenburg (Deputy Corporation Counsel), Daryn Arai (Planning Program Manager), Phyllis Fujimoto (Staff Planner), Maija Cottle (Staff Planner), and Jeff Darrow (Staff Planner). The Chair introduced the staff and Windward Planning Commissioners to the public and described the procedures to be followed for today’s meeting. The Commission took the following item up at 9:22 a.m. with approximately 51 people from the public in attendance: APPLICANT: ARTS AND SCIENCES CENTER (SPP 11-115) Application for a Special Permit to allow the establishment of a charter school campus offering a full range of academic and extracurricular opportunities for up to 400 students from th Kindergarten through 12 grade, and provide continuing education and meeting facilities for the larger Pāhoa community on 14.251 acres of land situated within the State Land Use Agricultural District. The subject property is situated southeast of the Pāhoa Bypass Road and Post Office Road intersection, Nānāwale Homesteads, Pāhoa, Puna, Hawai‘i, Tax Map Keys: 1-5-006: portion of 002, 012, 026. (SEE EXHIBIT A) RECESSED – The Chair recessed the meeting at 11:03 a.m. RECONVENED – The Chair reconvened the meeting at 11:17a.m. The Commission took the following item up at 11:17 a.m. with approximately 25 people from the public in attendance: INITIATOR: PLANNING DIRECTOR Amendment to Condition F (connect to sewer) of Ordinance No. 03-82, which changed the district classification of approximately 21,050 square feet of land from Light Industrial (ML-20a) to Industrial-Commercial Mixed Use (MCX-20). The property is located in Waiākea House st Lots, 1 Series along the west side of Kanoelehua Avenue approximately 290 feet north of its intersection with Kekūanāo‘a Avenue, Waiākea, South Hilo, Hawai‘i, TMK: 2-2-035: 061. Mr. Arai oriented the Commission and public of the subject and surrounding properties on the location map and site plan, gave some background information and stated the Planning Director was recommending a favorable recommendation to the County Council. Mr. Arai explained that the proposed amendment was because of an error in the original ordinance requiring that the project connect to the Kinoole Street sewer line located a mile away. He noted that the subject property is located outside of the 300-foot requirement to hook up to an existing sewer main, there is no sewer line fronting the subject property on Kanoelehua Avenue, and a property located two lots to the north was granted an exemption from the sewer line requirement. He then reviewed the proposed amended conditions to the ordinance, including such conditions as the project shall dispose of development generated wastewater in a manner meeting with the State Department of Health and construction of the development shall be completed by June 5, 2013. The Planning Director confirmed that there was a typographical error in the original ordinance. There was no one from the public signed up to testify on this amendment. It was moved by Commissioner Au and seconded by Commissioner Ishibashi to send a favorable recommendation to the County Council as recommended by the Planning Director. There was no discussion on the motion. A roll call vote was taken and motion carried with five ayes (Au, Ishibashi, Domingo, Ono and Kern). The Commission took the following item up at 11:26 a.m. with approximately 26 people from the public in attendance: INITIATOR: PLANNING DIRECTOR Amendment to Chapter 25 (Zoning), Article 2, Division 4, Section 25-2-46 of the Hawai‘i County Code 1983 (2005 Edition, as amended) relating to the Addition of Civil Defense Sirens . to Concurrency Requirements (SEE EXHIBIT B) The Commission took the following item up at 11:36 a.m. with approximately 23 people from the public in attendance: APPLICANT: HU HONUA BIOENERGY LLC (SMA 221) Discussion and action on the Hearings Officer’s report and recommendation on amendment to Special Management Area Use Permit No. 221 which originally allowed the establishment of a coal storage area and a coal burning energy plant and related improvements. The amendment request is to allow a change in fuel source from coal to biomass, to upgrade the existing facility and to construct support facilities and infrastructure at the former Pepe‘ekeō Power Plant, Makahanaloa, South Hilo, Hawai‘i, TMK: 2-8-8:104 (formerly 2-8-7: Portion of 53). (SEE EXHIBIT C) MINUTES – At 5:27 p.m., the Commission took up the following approval of the minutes: 2 April 7, 2011 – It was moved by Commissioner Domingo and seconded by Commissioner Ono that the minutes be approved. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ANNOUNCEMENTS – Mr. Arai said since the matter of Hu Honu’s amendment to Special Management Area Use Permit No. 221 concluded today, tomorrow’s meeting is cancelled, noting notices will be posted on the doors to inform the public of this cancellation. ADJOURNMENT – There being no further business, it was moved by Commissioner Domingo and seconded by Commissioner Ono that the meeting be adjourned. Motion was unanimously carried by a voice vote of all Commissioners in attendance. The meeting adjourned at 5:29 p.m. Respectfully submitted, Sharon M.
