ORDINANCE NO. O5 151.
AN ORDINANCE AMENDING CHAPTER 18, ARTICLE 4, DIVISION 1,
SUBSECTION 18- 90(h), OF THE HAWAI`l COUNTY CODE 1983 (2005 EDITION),
RELATING TO PUBLIC TRANSPORTATION.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 18, article 4, division 1, subsection 18- 90(h), of the Hawaii
County Code 1983 (2005 EDITION), is amended to read as follows:

provide the public with a transportation alternative to the private
automobile. The provision of an effective public transportation system for
the residents of the County of Hawaii will produce economic, social and
lifestyle benefits for the residents of Hawaii County. The distances
residents must travel for work, medical, education, and social needs will
be alleviated by providing public transportation at no cost to the user.
The County of Hawaii shall be designated a transportation kokua zone.
Riders boarding and alighting any regularly scheduled bus route operated
by the County of I Iawai`i or its designee shall ride free of charge.
(3) The transportation kokua zone shall not apply to County contracted
shared -ride taxi services, County operated curb to curb van services, or
County operated non - scheduled bus services.
(4) A designated transportation kokua area shall terminate two years after its
implementation, unless extended or terminated by the council.
(5) Within one year of the date of the implementation, and again not later than
ninety days prior to termination of the transportation kokua zone, the
transit administrator shall report to the Hawaii County council on the
impact of its implementation, at which time the council may extend or
terminate the established zone(s)."
SECTION 2. Material to be repealed is bracketed. New material is underscored. In
printing this ordinance, the brackets, bracketed material and underscoring need not be included.
SECTION 3. If any provision of this ordinance, or the application thereof to any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid provision or application, and to
this end, the provisions of this ordinance are declared to be severable.
SECTION 4. This ordinance shall take effect upon its approval.
