COUNTY OF HAWAII <br />STATE OF HAWAII <br />BILL NO. 170 (2002 -2004) <br />Draft 2 <br />ORDINANCE NO. 05 165 <br />AN ORDINANCE AMENDING CHAPTER 19, OF THE HAWAII COUNTY CODE 1983 <br />(2005 EDITION), RELATING TO REAL PROPERTY TAXES, BY REALIGNING <br />WATER TANK EXEMPTIONS. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF I IAWAII: <br />SECTION 1. The purpose of this measure is to clarify section 19 -54. water tank <br />exemption, by removing it from article 7, relating to "Tax maps; Valuations," and placing it <br />in article 10, relating to "Exemptions." <br />SECTION 2. Chapter 19, article 7, section 19 -54, of the Hawaii County Code 1983 <br />(2005 Edition), is repealed. <br />SECTION 3. Chapter 19, article 10, section 19 -81, of the Hawaii County Code 1983 <br />(2005 I?dition), is amended to read as follows: <br />lReservedl Section 19 -81. Water tanks. <br />Any provision to the contrary notwithstanding, any tank or other storage <br />receptacle required by any government apency to be constructed or installed on <br />any taxable real property before water for home and farm use is supplied, and <br />any other water tank, owned and used by a real property taxpayer for storing <br />water solely for said taxpayer's own domestic use, shall be exempted in <br />determining and assessing the value of such taxable real property." <br />SECTION 4. Material to be repealed is stricken and bracketed. New material is <br />underscored. In printing this ordinance, the brackets, bracketed material and underscoring <br />need not be included. <br />
