STATE OF HAWAII BILL NO. 42 071 22 (DRAFT 2) AN ORDINANCE NAMING A COUNTY RECREATIONAL FACILITY (TMK: (3) 7 -5- 041:052) PURSUANT TO CHAPTER 15, HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED) BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Findings and Purpose: The purpose of this ordinance is to designate the name "William Charles Lunalilo Playground" for that certain County recreational facility, identified as Lot 129, area 6.835 acres, more or less, Pualani Estates Subdivision Phase 1, Tax Map Key: (3) 7 -5- 041:052, situate at Puapua`aiki and Puapua`anui, in the District of North Kona, County and State of Hawaii, pursuant to chapter 15, article 8, section 15- 67(a)(2)(B), Hawaii County Code 1983 (2005 Edition, as amended), which establishes guidelines for naming of such facilities. SECTION 2. Background. Ordinance No. 99 -51, which amended Ordinance Nos. 90 -63 and 93 -76, has a park dedication condition for Pualani Estates, which requires of owner D.R. Horton - Schuler Homes, LLC, as `Condition J': "To ensure that the goals and policies of the Recreation Element of the General Plan are implemented, the applicant shall construct a minimum five acre recreational park within the project site for active and passive recreational uses to be dedicated and accepted by the County of Hawai`i." D.R. Horton - Schuler Homes, LLC requests the park be named "William Charles Lunalilo Playground" in honor of King William Charles Lunalilo, a former member of the Hawaiian monarchy. William Charles Lunalilo was born in Honolulu on January 31, 1835. He was the grandson of the half brother to King Kamehameha I and his grandmother was Queen Ka`ahumanu's sister. Lunalilo was elected to the throne via special election after King Kamehameha V left no heir to the throne of the Kingdom of Hawai'i. Lunalilo, the unanimous choice among the people in a popular vote, became known as the "People's King." Lunalilo officially took the throne in January 1873. While King, Lunalilo removed the property owning requirements that the Constitution of 1864 required for voting eligibility. William Charles Lunalilo's reign ended after a year with his untimely death on February 3, 1874. Lunalilo choose not to be buried with the past monarchs at the Royal Mausoleum, but instead was laid to rest with his mother and his people on the grounds of Kawaiha`o Church. He left his property to create the Lunalilo Home, to be used for poor and elderly Hawaiians. SECTION 3. Pursuant to chapter 15, article 8, section 15 -68, Hawaii County Code 1983 (2005 Edition, as amended), that certain open area county park at Pualani Estates, identified by Tax Map Key (3) 7 -5- 041:052 is hereby named "William Charles Lunalilo Playground." SECTION 4. Chapter 15, article 8, section 15 -68.1, Hawaii County Code 1983 (2005 Edition, as amended), is amended by adding the following new facility to the parks and recreation Kona facilities schedule: "William Charles Lunalilo Playground" SECTION 5. New material is underscored. In printing this ordinance, underscoring need not be included. SECTION 6. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 7. This ordinance shall take effect upon its approval.
