COUNTY OF HAWAII ORDINANCE NO. STATE OF HAWAII BILL NO. 53 (Draft 2) 0'7 S'7 AN ORDINANCE AMENDING CHAPTER 24 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), VEHICLES AND TRAFFIC, RELATING TO TEMPORARY CHANGES IN TRAFFIC CONTROLS TO EFFECTUATE TRAFFIC CODE AMENDMENTS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The purpose of this measure is to amend section 24 -11, temporary changes to effectuate amendments, by authorizing the director of public works to extend the initial ninety -day period of a temporary traffic control, for another ninety -day period should a bill to enact an amendment remain pending beyond the initial ninety -day period. SECTION 2. Chapter 24, article 2, section 24 -11, of the Hawai'i County Code 1983 (2005 Edition, as amended), is amended to read as follows: "Section 24 -11. Temporary changes to effectuate amendments. The director of public works of the County is hereby empowered to make changes in parking and other traffic controls for a period of ninety days as a temporary measure to effectuate the provisions of an amendment to this chapter. The director of public works may have a single ninety -day extension of this period if a bill to enact the so effectuated amendment of this chapter remains pending before the County Council at the end of the initial ninety -day period. Any additional extensions of time shall require Council approval." SECTION 3 Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and included. underscoring need not be SECTION 4. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable.
