HomeMy WebLinkAbout2011-11-17 Leeward Planning Commission Agenda NOTICE OF PUBLIC MEETING AND HEARINGS LEEWARD PLANNING COMMISSION COUNTY OF HAWAI‘I NOTICE IS HEREBY GIVEN of the following matters to be considered by the Leeward Planning Commission of the County of Hawai‘i in accordance with the provisions of Chapters 91 and 92, Hawai‘i Revised Statutes, Section 6-7.5 of the Charter of the County of Hawai‘i, and the Commission’s Rules of Practice and Procedure. DATE: Thursday, November 17, 2011 TIME: 9:30 a.m. PLACE: West Hawaii Civic Center, Community Center, Building G 74-5044 Ane Keohokalole Highway, Kailua-Kona, Hawai‘i STATEMENTS FROM THE PUBLIC – Note that statements from the public regarding any particular item on this agenda will be taken at the time the particular item is called to order. NEW BUSINESS – 9:30 a.m. 1. APPLICANT: JAMES SARGENT (USE 11-029) Application for a Use Permit to allow the establishment of a 5-bedroom bed and breakfast operation within an existing 6-bedroom single family dwelling on 2.27 acres of land within the Single Family Residential-15,000 square foot (RS-15) zoned district. The property is located at 55-3456 Akoni-Pule Highway (Highway 270), which is on the south side of Akoni-Pule Highway approximately 700 feet east of the Akoni-Pule Highway (Highway 270) and Hwi Road intersection, Hwi, North Kohala, Hawai‘i, TMK: 5-5-15:41. 2. APPLICANT: CELLCO PARTNERSHIP DBA VERIZON WIRELESS (USE 11-30) Application for a Use Permit to construct a 114-foot tall, self-supported steel telecommunication monopole with twelve 8-foot tall panel antennas and related facilities on an approximately 900 square-foot portion of a 3.952-acre parcel situated in the State Land Use Agricultural District and the County’s Agricultural 5-acre (A-5a) zoned district. The property is located at 87-3070 Mamalahoa Highway, which is on the east side of Mamalahoa Highway, approximately 1,900 feet north of the intersection of Mamalahoa Highway and st Kukuiopa‘e Place, Kukuiopa‘e 1, South Kona, Hawai`i, TMK: 8-7-010: portion of 013. 3. APPLICANT: CELLCO PARTNERSHIP DBA VERIZON WIRELESS (USE 11-31) Application for a Use Permit to construct a 150-foot tall, self-supported steel telecommunication monopole with twelve 8-foot tall panel antennas and related facilities on an approximately 1,000 square-foot portion of a 2,396-acre parcel situated in the State Land Use Agricultural District and the County’s Agricultural 5-acre (A-5a) zoned district. The property is located approximately 3,500 feet east (mauka) of Hawai‘i Belt Road in the vicinity of mile marker 90, ‘Alik ahupua‘a, South Kona, Hawai‘i, TMK: 8-8-001: portion of 003. 1 NEW BUSINESS – 10:00 a.m. 4. APPLICANT: HOLUALOA LIKANA, LLC (AMEND SMA-06-000015) Request for an amendment to allow for a 5-year time extension to Condition No. 3 (complete construction) of Special Management Area Use Permit No. 06-000015, which allowed the development of a commercial parking lot with 128 stalls and landscaping improvements on approximately 1.23 acres situated within the County’s Special Management Area (SMA). The property is located on the makai side of Kuakini Highway at the junction of Kuakini Highway and Henry Street, Kailua-Kona, North Kona, Hawaii, TMK: 7-5-006: 001. 5. INITIATOR - COUNTY COUNCIL County Council Bill No. 90, proposing the amendment of Chapter 25, Article 1 and Article 5 of the Hawai‘i County Code 1983 (2005 Edition, as Amended), relating to zoning district regulations for crematoriums, funeral homes, funeral services, and mortuaries. 6. INITIATOR - PLANNING DIRECTOR Amendments to Planning Commission Rule No. 9 regarding the Special Management Area (SMA) to conform with Act 153, which amended Chapter 205A, Hawai‘i Revised Statutes regarding Special Management Area. The proposed amendments to Rule No. 9 seek to exempt the State Division of Boating and Ocean from any SMA permit, amend the definition of single family dwelling as an exempt class of action, and increase the valuation of improvements that could be considered exempt from the SMA requirements. Submitting Testimony: According to Rule 1 (General Rules) of the Planning Commission, a person desiring to submit oral or written testimony shall indicate her/his name; address; and whether the testimony is on her/his behalf or as a representative of an organization or individual. If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony. Written testimony shall be submitted with an original and fifteen copies prior to testifying. The Commission would appreciate timely submittal to the Planning Department at least one week prior to the hearing date to allow for mailing and thorough Commission review. Testimony that is irrelevant or unduly repetitious may be limited by the Chairperson pursuant to Rule 1. 2 Pursuant to Rule 4, Contested Case Procedure, of the County of Hawai‘i Planning Commission Rules of Practice and Procedure, any person seeking to intervene as a party to a contested case hearing on Item Nos. 1, 2, 3 & 4 above is required to file a written request which must be received in the office of the Planning Department no later than seven (7) calendar days prior to the Planning Commission’s first public meeting on the matter. Such written request shall be in conformity with Rule 4, in a form as provided by the Planning Department entitled “Petition for Standing in a Contested Case Hearing.” The written petition/request shall be filed with the Planning Commission at Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawai‘i 96720, and accompanied by a filing fee of $200 payable to the Director of Finance. Any party may retain counsel if that person so desires. Rule 4 may be inspected or purchased ($2.50) at the above-cited location. Rule 4 may also be viewed at the County of Hawai‘i website (http://www.co.Hawaii.hi.us). Notice to Lobbyists: If you are a lobbyist, you must register with the Hawai‘i County Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawai‘i County Code}. A lobbyist means “any individual engaged for pay or other consideration who spends more than five hours in any month or $275 in any six-month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials.” {Article 15, Section 2-91.3(a)(6), Hawai‘i County Code} Registration forms and expenditure report documents are available at the Office of the County Clerk, 25 Aupuni Street, Room 1402, Hilo, Hawai‘i 96720. Copies of the applications are on file and open to inspection during office hours at the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawai‘i and at the Kona office of the Planning Department, West Hawaii Civic Center, 74-5044 Ane Keohokalole Highway, Kailua-Kona, Hawai‘i. Anyone who requires an auxiliary aid or service, other reasonable modification, or language interpretation to access this meeting please contact the Planning Department at 961- 8288 as soon as possible, but no later than five working days prior to the meeting date, to arrange for accommodations. “Other reasonable modification” refers to communication methods or devices for people with disabilities who are mentally and/or physically challenged.
