A regularly advertised hearing on the PLANNING DIRECTOR INITIATED AMENDMENT TO CHAPTER 25
(ZONING CODE) OF THE HAWAI‘I COUNTY CODE 1983 (2005 EDITION, AS AMENDED) RELATING
TO BED AND BREAKFAST ESTABLISHMENTS, was called to order at 9:57 a.m. in the County of Hawai‘i,
Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman Zendo Kern presiding.
COMMISSIONERS PRESENT: Zendo Kern, Dean Au, Takashi Domingo, Wallace Ishibashi, Stephen Ono
and Raylene Moses
STAFF PRESENT: Ivan Torigoe (Deputy Corporation Counsel), B. J. Leithead Todd (Planning Director),
Daryn Arai (Planning Program Manager), Phyllis Fujimoto (Staff Planner), Maija Cottle (Staff Planner), Jeff
Darrow (Staff Planner), and Sharon Nomura (Secretary)
And eight people from the public in attendance.
APPLICANT: PLANNING DIRECTOR INITIATED
Amendment to Chapter 25 (Zoning Code) of the Hawai‘i County Code 1983 (2005 Edition, as amended)
relating to bed and breakfast establishments. The proposed amendment will specifically amend Sections 25-2-
61(a), 25-2-71(c), 25-2-76(b through e), 25-4-7(a), 25-5-52(d), 25-5-62(d) and 25-5-72(d). This is a
housekeeping matter that seeks to provide consistency among different sections of the Zoning Code relating to
bed and breakfast establishments.
KERN: Okay, Application No. 5, Amendment to Chapter 25, Hawai‘i County Code, relating to bed and
breakfast establishments. That is to be deferred as well?
DARROW: Yes.
KERN: Do you have a time for that?
DARROW: Thank you, Mr. Chairman. The reason for the request for the deferral is that we currently have a
bill relating to crematoriums, funeral homes, mortuaries that is in the process of going up to Council and it
hasn’t been adopted yet. If that’s adopted it will make a difference to this bill. And so they have asked us to
hold off on introducing this bill until that bill passes. So that’s the only reason for the request on the deferral.
KERN: There’s a correlation between funerals and crematoriums to bed and breakfasts?
DARROW: Some of the sections -. Yeah, what happens is like under use permits, a certain section will require
a use permit for a B&B, as well as a mortuary. And so those sections will conflict.
KERN: Okay.
DARROW: But there’s no relation.
KERN: And so it’s an open deferral until such time that -?

DARROW: There’s a good chance that it will be next month that we’ll be able to reintroduce it. Thank you.
KERN: Okay, thank you, Jeff. Can I get a motion to defer? Anyone, motion to defer? Commissioner Au?
AU: Thank you, Mr. Chair. I move to defer Applicant No. 5, Planning Director initiated, to the next meeting -.
KERN: Or till -?
AU: Or until further notice.
DOMINGO: Second.
KERN: Any discussion? Seeing none, we’ll do a voice vote on this. All those in favor aye?
COMMISSIONERS: Aye.
KERN: Those opposed nay? Hearing none, motion to defer is approved.
