HomeMy WebLinkAbout2012-04-05 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES APRIL 5, 2012 The Windward Planning Commission met in regular session at 9:00 a.m. in the County of Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman Zendo Kern presiding. COMMISSIONERS PRESENT: Zendo Kern, Dean Au, Ronald Gonzales, Wallace Ishibashi, Stephen Ono and Raylene Moses STAFF PRESENT: Ivan Torigoe (Deputy Corporation Counsel), B. J. Leithead Todd (Planning Director), Daryn Arai (Planning Program Manager), Maija Cottle (Staff Planner), Jeff Darrow (Staff Planner), and Sharon Nomura (Secretary) The Chair introduced the staff and Windward Planning Commissioners to members of the public and described the procedures to be followed for today’s meeting. STATEMENTS FROM THE PUBLIC – There were no statements from the public presented at this time. NEW BUSINESS – 9:00 a.m. APPLICANT: PLANNING DIRECTOR INITIATED Amendment to Chapter 25 (Zoning Code) of the Hawai‘i County Code 1983 (2005 Edition, as amended) relating to Agricultural Tourism. The proposed amendment will specifically amend Sections 25-1-5(b), 25-2-71, 25-2-75, 25-2-76 and 25-4-15 relating to definitions, plan approval requirements, and use regulations, respectively, as they are related to agricultural tourism. The Commission took this item up at 9:02 a.m. with three people from the public in attendance. (SEE EXHIBIT A) APPLICANT: PLANNING DIRECTOR INITIATED Amendment to Chapter 25 (Zoning Code) of the Hawai‘i County Code 1983 (2005 Edition, as amended) relating to bed and breakfast establishments. The proposed amendment will specifically amend Sections 25-2-61(a), 25-2-71(c), 25-2-76(b through e), 25-4-7(a), 25-5-52(d), 25-5-62(d) and 25-5-72(d). This is a housekeeping matter that seeks to provide consistency among different sections of the Zoning Code relating to bed and breakfast establishments. The Commission took this item up at 9:32 a.m. with three people from the public in attendance. (SEE EXHIBIT B) 1 MINUTES – The Commission took up the following at this time, 9:34 a.m. Approval of Minutes of the March 1, 2012 meeting – It was moved by Commissioner Au, seconded by Commissioner Moses, and unanimously carried by a voice vote that the minutes be approved. ADMINISTRATIVE MATTERS - At 9:35 a.m., the Commission took up the following under administrative matters: 1.Coastal Zone Management (CZM)/Special Management Area (SMA) training by the State Office of Planning to ensure the consistency of the SMA permit system with the CZM objectives and policies, and the SMA guidelines. Messrs. Leo Asuncion and Shichao Li from the State Office of Planning introduced themselves. Mr. Asuncion gave a presentation on the CZM objectives and the SMA permit system (SEE EXHIBIT C) and submitted additional information (SEE EXHIBITS D, E and F). Mr. Asuncion added the Ocean Resources Management Plan is being updated this year, and they will be soliciting comments from the public statewide and government agencies, and then seeking funds if the Governor approves the plan. 2.Status regarding the following appeals: a.Rapoza, etal vs. Windward PC (Hu Honua) – SMA 221 b.Parisi et al. v. Priest (Monk) of Bang San Ho Temple, et al. - SPP 919 Mr. Arai noted this item will be placed on the next agenda after the Department receives additional information. Ms. Leithead Todd noted that the court is asking that there be some arbitration or mediation by the parties. ANNOUNCEMENTS – Mr. Arai announced anyone wishing to attend training on the Sunshine Law scheduled for May 24, 2012 should contact him. He informed the Commission that the rd May 3 meeting may possibly be very lengthy.
