COMMISSIONERS PRESENT: Zendo Kern, Dean Au, Takashi Domingo, Wallace Ishibashi, Stephen Ono and Raylene Moses STAFF PRESENT: Ivan Torigoe (Deputy Corporation Counsel), B. J. Leithead Todd (Planning Director), Daryn Arai (Planning Program Manager), Maija Cottle (Staff Planner), Jeff Darrow (Staff Planner), and Sharon Nomura (Secretary) And three people from the public in attendance. APPLICANT: PLANNING DIRECTOR INITIATED Amendment to Chapter 25 (Zoning Code) of the Hawai‘i County Code 1983 (2005 Edition, as amended) relating to bed and breakfast establishments. The proposed amendment will specifically amend Sections 25-2- 61(a), 25-2-71(c), 25-2-76(b through e), 25-4-7(a), 25-5-52(d), 25-5-62(d) and 25-5-72(d). This is a housekeeping matter that seeks to provide consistency among different sections of the Zoning Code relating to bed and breakfast establishments. KERN: Application No. 3, Planning Director initiated amendment to Chapter 25 relating to bed and breakfast establishments. Jeff. DARROW: Our next application, the Planning Director is recommending that this be deferred, not to a specific date. What has happened again, we’ve come across a situation just recently where in the process of amending one bill, another bill going up to Council would have an effect on this bill. So that recent bill that we had sent up to Council regarding changes to mortuaries and crematoriums will have an effect on this particular bill. So we’ve been advised to wait until that passes. And then this bill can go up clean, and then we’d be able to not have conflicts. So we’re requesting just an open-ended deferral until that bill passes, and then we would place it back on the Planning Commission’s agenda. KERN: Okay, very good. Thank you, Jeff. Any questions for staff? We do have two people signed up to testify from the public. So we’ll give them that opportunity since they are already here, or one of them representing the other one, I believe. So Debbie Ward and Cory Harden please come forward. HARDEN: No, we won’t testify. KERN: Okay, they’re not going to testify. With that we can take a motion to defer. AU: Mr. Chair? KERN: Commissioner Au. 1 EXHIBIT B AU: I move to defer Chapter 25 (Zoning Code) relating to bed and breakfasts to a future date. KERN: Is there a second? MOSES: Second. KERN: Thank you. Any discussion? Commissioner Au? AU: So you mentioned that because of the other bill has to get passed by the County Council it will affect this bill. So when do you think we’re going to be looking at this again? DARROW: It has been sent up to the Council so we would anticipate within the next two months. If it does occur prior to our next meeting, we’ll place it on that. But most likely it would probably be maybe the June meeting. But, and the reason why is if look at the actual bill, you’ll notice references to mortuaries and crematoriums in regards to the way that it was before it was sent up. And so if we anticipate it being amended and we sent it up and something happens, then we’re going to be -. So they’re just asking us wait, let it pass, and then we’ll reflect the current changes on this bill. KERN: Very good. Any other discussion or questions? Seeing none, with that Jeff, let’s take the vote. DARROW: Thank you, Mr. Chairman. The motion before us is to defer this matter. With that I’ll take the roll call. Commissioner Au? AU: Aye. DARROW: Commissioner Moses MOSES: Aye. DARROW: Commissioner Gonzales? GONZALES: Aye. DARROW: Commissioner Ishibashi? ISHIBASHI: Aye. DARROW: Commissioner Ono? ONO: Aye. DARROW: And Mr. Chairman? KERN: Aye. DARROW: The motion passes six to zero. KERN: Very good. Thank you. DAROW: Thank you. 2 EXHIBIT B The discussion ended at 9:34 a.m. Respectfully submitted, Sharon M. Nomura, Secretary Planning Commission 3 EXHIBIT B
