<br />PLANNING COMMISSION <br />COUNTY OF HAWAI‘I <br /> <br />HEARING TRANSCRIPT <br />MAY 3, 2012 <br /> <br />PLANNING DIRECTOR INITIATED REVOCATION OF <br />A regularly advertised hearing on the <br />SPECIAL PERMIT 1122 (HAWAI‘I’S VOLCANO CIRCUS) <br /> was called to order at 10:41 a.m. in <br />the County of Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with <br />Chairman Zendo Kern presiding. <br /> <br />COMMISSIONERS PRESENT: Zendo Kern, Dean Au, Ronald Gonzales, Wallace Ishibashi, and <br />Raylene Moses <br /> <br />STAFF PRESENT: Molly Lugo (Deputy Corporation Counsel), B. J. Leithead Todd (Planning <br />Director), Daryn Arai (Planning Program Manager), Phyllis Fujimoto (Staff Planner), Maija Cottle <br />(Staff Planner), Jeff Darrow (Staff Planner), Sarah Hata-Finley, (Staff Member) and Sharon Nomura <br />(Secretary) <br /> <br />And approximately 108 people from the public in attendance. <br /> <br />ABSENT AND EXCUSED: Stephen Ono <br /> <br />APPLICANT: PLANNING DIRECTOR INITIATED <br /> <br />Hearing regarding Non-Compliance with conditions of approval of Special Permit No. 1122 (SPP <br />1122) and special permit revocation proceedings pursuant to Condition No. 8 of SPP 1122. SPP 1122 <br />was issued to Hawai‘i’s Volcano Circus to allow the establishment of a performing arts educational <br />center on 2.5 acres of land within a larger 10-acre site situated within the State Land Use Agricultural <br />District. The properties are located within and adjacent to the west side of Kalapana Sea View Estates <br />subdivision near the intersection of West Pohakupele Loop and Kehauopuna Street, Puna, Hawai‘i, <br />TMK: 1-2-009: 034 and 1-2-038: 050. <br /> <br />KERN: Okay, Applicant No. 4 is the Planning Director initiated hearing regarding Non-Compliance <br />with conditions of approval of Special Permit No. 1122 (SPP 1122) and special permit revocation <br />proceedings pursuant to Condition No. 8 of SPP 1122. I checked with my Corporation Counsel and I do not <br />need to recuse myself. But just to alleviate any appearance of potential impropriety I would like to <br />disclose the fact that I do know Graham, I consider a friend. We are not like really close friends, but I <br />do know Graham. Graham has made a contribution to my campaign. I've been to SPACE, farmer’s <br />market. And actually I attended the 25th anniversary celebration, didn’t know it wasn't kosher, but I <br />was there. So I just wanted to disclose that.
