("Applicant"), is requesting to have three (3) contiguous parcels consisting of a combined area of approximately 9.93 acres reclassified from State land Use Agriculture to Urban district and subsequently rezoned from the County Agricultural (A - ]q) to (CV-10) zoning district Village Commercial. 'Me above referenced property is the site of the base yard for "'Bryson's Cinders" (Dba) which is owned and operated by applicant and is located at 15-2714 Old Pahoa Village Road, Pahoa, HI 96778. The operation provides screened soil, sand, cinder, and rock mixtures for agriculture, landscaping, and construction projects. If the change of zone is approved, the applicant intends to consolidate the above referenced property and establish a family shopping complex, which will include but not be limited to a family medical clinic with related professional services'. Super market garden center, restaurants, retail shops, paint and hardware, outside entertainment area, and a County "Hele On" Bus Stop. The subject parcels are located at the southwest comer of the Kahakai Blvd/Pahoa Village Road intersection. It is diagonally opposite of the Woodland Center at the intersection of Old Pahoa Village road and Kahakai Boulevard. The property is approximately 9.93 acres on TMK (3) 1-5-007: 006, (3) 1-5-007: 69 and The proposed facties, the existing roadways, the project generated traffic, and the level of service are described in the Traffic Impact Analysis Report. See Figure 4 (TLAR) In order to mitigate congestion in the ate vicinity of the p *ect a traffic signal will r0i 10 be installed at this location. Making this M"tersection a signalized intersection will keep thl�; level of service for the Kahakai BlvdJOld Paboa Rd. intersection at "B" for the projected twenty-year period, The applicant is cognizant of the Hawan" County Concurrency requirements Section 46. The applicant by constructing a signalized intersection wifl be providing "local mitigation by improving roads and intersections which are in the immediate nity of thl:i project". -9 As an example, according to the TL4R provided by the applicant the "level of service or IN zF. The Site is already well served by all necessary utilities via overhead lines. As recommended by the TL411, widening of Old Pahoa'%rdlage Road will also M*clude utility pole realignment, and sidewalks along the Old Pahoa Village Road frontage of the property. The Projects conformance with such rules follows below: It shall include lands characterized by "city-like" concentrations of people, structures, streets, urban level of services and other related land uses-, The general area, including P. #'. Village, 'I's characterized by a concentration of people, structures, sN reets, and rural/urban level of services. Pahoa Village 'is approximately one (1) mile from the sub ect site and has a variety of existing land uses, including single and multi-family residential and j commercial, It shall take into consideration the following speeme iactors: 1) Pro ity to centers of tradm*g and employment except where the development would generate new centers of 0 trading and employment; 2) Availabty of basic services such as schools, parks, waste wate systems, solid waste disposal, drainage, water, transportation systems, pub Hc utilities, and pofice and fire protection; and 3) Sufficient reserve areas for foreseeable urban growth. The site is ;-Atuated in flood zone X. The soil is volcanic rock and is porous. Drainage is good. Flooding has never been an issue. The site is fi-ee from the threat of tsunami. The property is contiguous to other Urban District lands to the east, directly across Pahoa Village a B. T. Kuwahara LLC SL 11 Boundary Amendment & Change of Zone Road is Woodland Center and Pahoa Auto Parts, and to the north a few blocks on Pahoa Village Road is Aloha Market Place. It shall include lands m" appropriate locations for new urban concentrations and shall give consideration to areas of urban growth as shown on the state and county general plans. The LU?AG map was recently amended and the property is located in area designated medium density urban appropriate for conunercial development and also consistent with CDP map preliminary village boundary. It shall not include lands, the urbanization of which will contribute toward scattered spot urban development, necessitating unreasonable investment I infrastructure or support services. The proposed urbanization of the Property will not contribute to scattered spot urban development, as the Property is contiguous to existing Urban District lands. Also, all the necessary public infrastructure and support services are readily available to the Site. It may include lands with a general slope of twenty percent or more if the commission finds that those lands are desirable and suitable for urban purposes and that the design and construction controls, as adopted by any federal, state, or county agency, are adequate to 6 protect the public health, welfare and safety, and the pubs interest w the aesthetic quality of the landscape. The Property does not include lands with a slope of twenty percent. The Site is relatively flat due to previous grading with a final slope of 2-3%. I 11. Coastal Zone Management The proposed Project is not contrary to the policies and objectives of Chapter 205A Coastal Zone agement program. It is not a shore-front parcel and is located approximately 10 miles from the coast. The proposed Project will have no effect on r# ublic access to the shoreline. There is no view of the coast from the property. Project 'I's not expected to have any effect on coastal systems. The Hawaii State Plan is intended to serve as a guide for the growth and ftiture long range development of the state. Chapter 226, Hawaii Revised Statutes, provides the lon.1 TOIJ B.T. The food waste from the super market and restaurants could be recycled, composted to create soil amendment to be applied back to the landscape. There will be a new family medical clu'm'c and other medical specialized facilities that are desperately needed in the Puna area. An outdoor stage will be provided to provide a gathering place for families to enjoy presentations by the local community. HN ff. Having opportunity for commercial services closer to commemia I Puns should help reduce traffic congestion and traffic accidents on highway 130. rr The subject site, in addition to attempting to meet this need also fulfills other policies and swd_ard--s articulated in the General Plan. As mentioned earlier the site is already serviced by adquate infiastructure. The county water line is available with an adequate supply of water for the proposed project. Fire protective services are available wi .2 miles. All other utilities are available to the r. site. The site does not have any on-site developmental constraints. The land is relatively fr. level, and there are no flood or other :!ii' us condition that would render the site a developmental problem and pose a burden to public agencies. The development of this site would not remove a cn"tical ' habitat. The proposed Project will serve the needs of the residents of Pahoa Village, as well asa larger population. Once the construction of the si light is completed, the level of service for the north bound movement improves to a "C". Presently the eastbound movement from Malama Market intersection onto Old Pahoa Vfl1age Rd. is level of service "E". Once the construction of the signal light is compla.,-, the level of service for the eastbound movement improves to a "C". The south-eastbound traffic from VO; Blvd/Keauu.-ByPass intersection is level of service ("B"" through-out the projected 20 year period. The property -is not part of any proposed non-motorized travel area, trail system or biki path network. There are no known trails crossing the Site. The property's northwestern boundary follows the northwestern boundary 400 ft mauka on Kahakai Blvd. The Topography of the site i's relatively flat, due to previous development. The majon,ty of the site is level to 2% to 4% slope E. Lava and Earthquake Hazard Zones KIII B. The applicant is requesting a change in State zoning from agriculture to urban-, and a change in County zoning from A-la Agricultural to CV-10 Village Commercial, for the purpose of constructing a retail shopping center. Each of the three parcels are comprised of 3.3 acres and currently being used as a base yard for Bryson's Cinders, and for residential purposes. According to the application, the existing dwellings date to 1975 and 1985. Based on available information, the history of land use, and the current condition of the project area, we believe that no historic properties wI*II be affected by the proposed change in zoning and future construction activities. Zoning varies from commercial-industrial to AG20 to Ag5 and neighborhood commercial. Traffic from this development will have an impact on the surrounding roads. This impact will be measured for the 'intersections stated above. B, Site Accessibility The proposed development will be accessed primarily from the extension westwardly of Kahakai Blvd from Old Pahoa Village Road Secondary access will be from two driveways along Old Pahoa Village Road, one located in the approximate center of the development and one at the southerly boundary. The Center Driveway is full movement. The South Driveway will be left-turn only. C. Land Use The project area is cuffently designated agricultural. The area is currently being use 2s a base yard for a cinder operation. There are two dwelling units on-site, one o which which may be converted to a restaurant. Also, there is a warehouse once use for flower distribution which currently is used as an office and equipment repai facility for Byson's Cinders. il D, Concurrency Pursuant to Section 25-2-46, Concurrency Requirements of the Hawaii County f%fl* 0 Zoning Code, the County requires a trallic impact analysis report (TIAR) of major developments be prepared or updated within six (6) months before the submission of any change of zone that can generate 50 or more peak hour trips. With the two driveways fronting Old Paho• Village Road, 'it can be shown that these do not critically affect the traffic flow with left-tum movements. The South Driveway is also an easement for an existing business in back of the development that requi*res left-tum traffic movements. This arrangements must rernainin place. As for the Center Driveway, the level of service does not drop below "B". 16 of 17 REVISED 5/29/12 The secondary accesses from Old Pahoa Village Road will need the above mentioned widening to facilitate smooth motions in all directions. Pedestrian and bicycle information is nol required by the County code. If 'it appears that there are substantial pedestrian o bicycle traffic, then comments will be made addressing them. In this case, there wer very few, if any observed during the traffic count penod. The report does not provide any inventory, analysis, projections or consideration of pedestriar, or bicycle traffic in this area. There is no analysis of the adequacy of the storage lencith of existing turning lanes or the impact that the development will have on the intersection other than level of service. The report recommends a traffic signal in order to mitigate congestion yet does not provide any analysis or traffic warrant study. No traffic signal installation shail be considered without an approved warrant study. It should be noted by the report preparer that if a development cannot or will not provide any mitigation measures because an existing level of service is at an unacceptable level the development should not be allowed to proceed to worsen the situation.
