Did the Land Use Permit Report show any prior activity on this application? Reviewed Sennett’s Subdivision application. Reviewed Lot 40 Kohala Estates, LLC and Lot 41 LLC’s approved subdivision. Recommendations: 1) Planning Dept. reviewer should take a very close look at subdivision applications, and 2) The Planning Dept. should create digital files and hard copy files for all new applications to thePlanning Dept. Notes from Growth Management Subcommittee Meeting August 6, 2012 Attendees: Jim Pedersen, Hermann Fernandez, and Margaret Willie We tabled the review of the latest draft of the “Procedures and Policies of the Growth Management Subcommittee” until the NKCDP AC makes some decisions regarding notification of the community by email. Kohala Wishing Well, LLC withdrew their Special Permit Application for a school at the end of Hoea Road. The subcommittee reviewed the Plan Approval of Jack Hoyt’s townhouse building in Kapaau. We understand that we have no ability to influence the plan approval application, but the subcommittee had several questions about what procedures and applications Jack Hoyt needed to obtain, before he received plan approval. Mainly, we wanted to know if this subcommittee, through the Land Use Permit report, received any prior notice that this proposed townhouse was under review by the Planning Dept. The subcommittee reviewed Sennett’s subdivision application and site plan. We had no comment regarding the subdividing of a 50-acre parcel into two parcels (29.471 acres and 20.676 acres) that still conform to the underlying zoning AG- 20A, and, eventually, obtaining a water variance for the parcel without a meter. The subcommittee reviewed the tentative approval with conditions of Lot 40 Kohala Estates, LLC and Lot 41 LLC. The subdivision was approved and the developer will need to provide access to lot 40-A (the flag lot) that meets the standards of the Dept of Public Works. The former road lot (Lot 41) will become an easement and must be in favor of those other lots within Kohala Estates with existing legal rights over extinguished Lot 41. Finally the subcommittee has two recommendations: 1) We think it a good idea, if the Planning Dept. Reviewer took a closer look at subdivision applications to make sure the applicant is in “full” compliance with the County’s rules and regulations, before the County permits a profitable windfall to the applicant. For example, confirming that structures shown or discussed in the application file are properly shown and identified, including any building permit numbers, on the site plan. 2) We highly recommend that all new applications to the Planning Dept. have a hard copy file and a digital copy file. This will create redundancy in the system in case of misplacement, fire, or theft, and this will allow the public/CDP easier access to, what are fundamentally, public records. We think this is the future, it is more open and transparent, and will be much more efficient than our current system. This can easily be done using the Laserfiche software the County already employs. This software can also be used to distribute automatically the CDP files or at least an announcement of new postings via email.
