HomeMy WebLinkAbout2013-06-06 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES JUNE 6, 2013 The Windward Planning Commission met in regular session at 9:00 a.m. in the County of Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman Wallace Ishibashi presiding. COMMISSIONERS PRESENT: Ronald Gonzales, Wallace Ishibashi, Myles Miyasato, Raylene Moses, Charles Heaukulani, and Gregory Henkel STAFF PRESENT: Ivan Torigoe (Deputy Corporation Counsel), Duane Kanuha (Planning Director), Phyllis Fujimoto (Staff Planner), Jeff Darrow (Staff Planner), and Sharon Nomura (Secretary) ABSENT & EXCUSED: Stephen Ono The Chair introduced the staff and Windward Planning Commissioners to members of the public and described the procedures to be followed for today’s meeting. STATEMENTS FROM THE PUBLIC – Note that statements from the public regarding any particular item on this agenda will be taken at the time the particular item is called to order. NEW BUSINESS – 9:00 a.m. APPLICANT: RODNEY AND LORRIE DIAMOND (SPP 13-150) Application for a Special Permit to allow the establishment of a baseyard for parking, storage and maintenance of well drilling equipment, materials and supplies on a 0.43-acre portion of a one-acre parcel situated within the State Land Use Agricultural District. The property is located rd between Paradise Drive and Maku‘u Drive on the makai (northeast) side of 32 Avenue, approximately 1,500 feet from its intersection with Paradise Drive, Hawaiian Paradise Park Subdivision, Kea‘au, Puna, Hawai‘i TMK: 1-5-17:112. The Commission took this item up at 9:03 a.m. with 10 people from the public in attendance. (SEE EXHIBIT A) APPLICANT: VINCE M. KIMURA (formerly HAKS, INC.) (REZ 1018) Request for a 5-year time extension to Condition C (time to complete construction) of Change of Zone Ordinance No. 03-109, which changed the district classification for 45,000 square feet of land from Single Family Residential (RS-10) to Industrial-Commercial Mixed (MCX-20). The project site is located in Waiākea House Lots, on the northwest corner of Kāwili Street-Laukapu Street intersection, Waiākea, South Hilo, Hawai‘i, TMK: 2-2-50:37 & 38. The Commission took this item up at 11:45 a.m. with six people from the public in attendance. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the request, and noted the Planning Director recommended a favorable consideration to the Hawai‘i County Council with conditions. The applicant, Vince M. Kimura, said Central Supply is a locally owned distributor with eight employees, and has been in business since 1979. In response to Commissioner Ono’s inquiries, Mr. Kimura said they have only cleared the trees and erected a fence in the rear portion of the property since they purchased the property in 2003. In response to the Chair’s inquiry, Mr. Kimura said as soon the rezoning is approved, they will put the project out to bid, noting they cannot complete construction by July 2013 deadline. There was no one from the public wishing to testify on the application. It was moved by Commissioner Gonzales and seconded by Commissioner Henkel to send a favorable recommendation for a five-year time extension to the Hawai‘i County Council with conditions. A roll call vote was taken and motion carried with six ayes (Gonzales, Henkel, Heaukulani, Miyasato, Moses, and Ishibashi) NEW BUSINESS – 9:30 a.m. INITIATOR: PLANNINGDIRECTOR Amendment to Chapter 25, Article 4, Division 5 and Article 7, Division 2 of the Hawai‘i County Code 1983, (2005 Edition, as amended), relating to increase in residential density, including parking requirements, within CDH, Downtown Hilo Commercial District. The Commission took this item up at 11:56 a.m. with two people from the public in attendance. (SEE EXHIBIT B AND ATTACHMENTS A, B, C AND D) RECESSED – The Chair recessed the meeting at 12:41 p.m. RECONVENED – The Chair reconvened the meeting at 12:43 p.m. INITIATOR: COUNTY COUNCIL Bill No. 25, Draft 2 regarding an amendment to Chapter 25 (Zoning Code) of the Hawai‘i County Code 1983 (2005 Edition, as amended), relating to Agricultural Tourism. The purpose of the proposed bill is to clarify definitions, procedural guidelines and requirements, and standards related to agricultural tourism operations. The bill specifically: Amends Chapter 25 (Zoning Code), Article 1, Section 25-1-5 relating to Definitions. Amends Article 2, Division 7, Section 25-2-71 relating to Plan Approval applicability. Amends Section 25-2-75 relating to 2 Plan Approval application requirements for agricultural tourism. Amends Section 25-2-76 relating to Action on Plan Approval application. Amends Article 4, Division 1, Section 25-4-15 relating to Use Regulations for agricultural tourism. The Commission took this item up at12:43 a.m. with two people from the public in attendance. (SEE EXHIBIT C) MINUTES – At 1:01 p.m., the Commission took up the following: Approval of Minutes of the May 2, 2013 meeting – It was moved by Commissioner Gonzales and seconded by Commissioner Miyasato that the minutes be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE MATTERS – At 1:02 p.m., the Commission took up the following: 1.Status of applications heard by Windward Planning Commission that are pending before County Council – Mr. Arai said he did not have any current information to present at this time. 2.Status of Contested Case proceedings for Connections New Century Public Charter School/CBESS Special Permit Application No. 12-000138 (SPP-12-138) – Mr. Arai said Sandra Song who has been selected as the hearings officer will commence with the contested case hearing procedure shortly, which would include a prehearing conference, as soon as the Mayor signs the contract. He stated he will update the Commissioner as the contested case procedure moves along. 3.Status of appeal filed regarding Windward Planning Commission’s approval of amendment to SMA Use Permit No. 221, Applicant, Hu Honua- Corporation Counsel – Mr. Torigoe said th oral argument before Judge Nakamura is scheduled for June 14 and an update will be provided to the Commission at a later date. ANNOUNCEMENTS – Mr. Torigoe at this time extended his aloha to the Planning Commission as he is retiring from the County. The Commission and staff wished him well and expressed their appreciation for his dedicated service. ADJOURNMENT – There being no further business, at 1:05 p.m., it was moved by Commissioner Moses and seconded by Commissioner Henkel that the meeting be adjourned.
