CALL TO ORDER
Chair Victorine called the meeting to order at 9:00 a.m.

APPROVAL OF AGENDA
Commissioner Schutte moved to approve the agenda. Commissioner Morioka
seconded, and it carried unanimously.
STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS
None.
APPROVAL OF MINUTES
September 20, 2013, regular and executive sessions. Commissioner Morioka
moved to approve the minutes. Commissioner Schutte seconded, and it carried
unanimously.
COMMUNICATIONS
Correspondence No.2013-13, request for legal representation for Officer Robert K.
Pule in USDC CIV NO. 13-00465 DKW RLP. Commissioner Schutte moved to
accept and file. Commissioner Morioka seconded, and it carried unanimously.

POLICE CHIEF’S REPORT ON DEPARTMENTAL ACTIVITIES
Including, but not limited to:
Crime report by area, category, and trends.
Assistant Chief Tavares reported that up through September 30, 2013, there were
2,253 serious crimes, of which 575 were investigated by the Criminal Investigation
units. For the month of September, they had 7,584 calls for service.
Traffic report by area, category, and trends.
Assistant Chief Kealoha reported having five traffic fatalities in September. They
continue with enforcement in troubled intersections such as the Pahoa Village
intersection at Highway 11. They continue with enforcement on the new Saddle
Road and have had a few DUI stops.
Personnel report on vacancies, recruitment, training, promotions,
reallocations, severance from service, and work assignments.
Deputy Chief Ferreira reported that they received approval for ten new sworn
positions, five in Puna and five in Ka’u. They have two intergovernmental transfers.
They have a couple vacant clerk positions. A class is being held for six new
dispatchers.
Finance report of budget and expenditures.
Deputy Chief Ferreira reported that expenditures are on track. Work on the next
fiscal year’s budget has started. They were told by County Finance to prepare a
status quo budget, except for utilities. They have asked the captains for input and
proposals, primarily for facility maintenance. County Finance is working on the
raises for SHOPO.
Commendations of sworn and civilian employees.
Deputy Chief Ferreira reported receiving nine commendations since the last meeting
involving 51 personnel.
Other departmental activities.
Deputy Chief Ferreira reported that they completed the last Aloha Training Class.
They can put on another class if they need to.
Assistant Chief Tavares explained the stealth monitor which was discussed at the
previous meeting. It is a radar computer mounted on a post. It registers the number
of cars and speed for a 24-hour period. It shows the time of day speeders travel,
and so they can put their resources out at that time. AC Tavares further reported
that they are using excessive driving grants for officers to work after their shift. The
Traffic Enforcement Unit does a lot of enforcement on Saddle Road.

EXECUTIVE SESSION
Commissioner Bertsch moved to meet in executive session to consider discipline and
charges against officers or employees of the Hawai‘i Police Department, to consider
sensitive matters relating to public safety, and to consult with Corporation Counsel on
questions and issues pertaining to the commission's powers, duties, privileges,
immunities, and liabilities pursuant to HRS 92-5 (a) (2) (4) (6) and the Hawai‘i County
Charter Section 13-20 (b). Commissioner Schutte seconded, and it carried
unanimously. Executive session convened at 9:35 a.m.
Regular session reconvened at 10:41 a.m.
ACTION BY THE COMMISSION
Correspondence No. 2013-13, request for legal representation for Officer Robert K.
Pule in USDC CIV NO. 13-00465 DKW RLP. Commissioner Schutte moved to
approve legal representation. Commissioner Gomes seconded the motion, and it
carried unanimously.
Complaint HPC 13-33: Complainant alleged that an officer spoke to him over the
phone in a harassing and threatening manner. Commissioner Gomes moved to
refer the complaint to the Police Chief for further investigation. Commissioner
Schutte seconded, and it carried with a nay vote from Commissioner Bertsch.
There was concern and discussion that when complaints are referred to the Chief, the
commission is not informed of the outcome. The Chief should report back to the
commission on the status of the complaint.
ANNOUNCEMENTS
Chair Victorine announced that the Police Commission’s next monthly meeting will
be on Friday, November 15, 2013, at 9:00 a.m., in the Waimea Civic Center
Conference Room, 67-5189 Kamamalu St., Waimea, Hawai‘i.
