HomeMy WebLinkAbout2013-11-07 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES NOVEMBER 7, 2013 The Windward Planning Commission met in regular session at 9:00 a.m. in the County of Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman Wallace Ishibashi presiding. COMMISSIONERS PRESENT: Wallace Ishibashi, Ronald Gonzales, Charles Heaukulani, Gregory Henkel, Myles Miyasato, and Raylene Moses, and Stephen Ono (from 9:08 a.m.) STAFF PRESENT: Margaret Masunaga (Deputy Corporation Counsel), Duane Kanuha (Planning Director), Daryn Arai (Planning Program Manager), Maija Cottle (Staff Planner), Jeff Darrow (Staff Planner), and Sharon Nomura (Secretary) The Chair introduced the staff and Windward Planning Commissioners to members of the public and described the procedures to be followed for today’s meeting. STATEMENTS FROM THE PUBLIC – Note that statements from the public regarding any particular item on this agenda will be taken at the time the particular item is called to order. NEW BUSINESS – 9:00 a.m. APPLICANTS: BAHMAN AND REBECCA HOVEIDA (SMA 13-053) Application for a Special Management Area Use Permit to allow the construction of a single- family dwelling and related improvements on 2.104 acres situated within the County’s Agricultural-20 acre (A-20a) zoning district and the Special Management Area (SMA). The property is located on the northeast (makai) side of the Hawai‘i Belt Road, approximately 330 feet north of the 16 mile-marker at Kamaee, North Hilo, Hawai‘i, TMK: 3-1-001:052. The Commission took this item up at 9:05 a.m. with 34 people from the public in attendance. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the request, and noted the Planning Director recommended approval of the application with conditions. Mr. Darrow clarified that because of the change to HRS 205(a)-22 single family dwellings of 7,500 square feet of floor area are not considered exempt within the SMA. The applicants, Bahman and Rebecca Hoveida, were in attendance, along with their representative, Lori Mikkelson. Ms. Hoveida stated they have reviewed the proposed conditions and had no questions. Ms. Mikkelson noted the applicants are anxious to have the request approved for their family. 1 There was no one from the public wishing to testify on the application. It was moved by Commissioner Moses, and seconded by Commissioner Gonzales, that the application be approved as recommended by the Planning Director with conditions. A roll call vote was taken and motion carried with seven ayes (Moses, Gonzales, Heaukulani, Henkel, Miyasato, Ono and Ishibashi). APPLICANT: SANDRA KANESHIRO (formerly DR. CURTIS LEE) (REZ 981) Request for a 5-year extension of time to comply with Condition B (secure Final Plan Approval) of Change of Zone Ordinance No. 02-49 that changed the district classification from a Single Family Residential (RS-10) to General-Commercial (CG-20) zoning district for approximately 20,640 square feet of land. The property is located on the northwest side of Kamana Street, between Kino‘ole Street and Kīlauea Street, approximately 340 feet northeast from the Kamana nd Street-Kino‘ole Street intersection, Waiākea House Lots 2 Series, South Hilo, Hawai‘i, TMK: 2-2-022:005. The Commission took this item up at 9:15 a.m. with 34 people from the public in attendance. Mr. Darrow stated that the hearing has been rescheduled as the applicant failed to properly notify surrounding property owners of the hearing. There was no one from the public wishing to testify on the application. It was moved by Commissioner Gonzales and seconded by Commissioner Moses that the matter be placed on the Windward Planning Commission’s December 5, 2013 meeting. Motion was unanimously carried by a voice vote of all Commissioners in attendance. APPLICANT: AGUINALDO 4, LLC (USE 13-043) Application for a Use Permit to allow the construction of a 13,520 square-foot medical facility and related improvements on approximately 1.545 acres of land situated within the County’s Single-Family Residential (RS-10) zoning district. The subject property is located on the southeast corner of the intersection of Pāhoa-Kalapana Road (Highway 130) and Pāhoa-Kapoho Road (Highway 132), across from Pāhoa High School at Kaniahiku Homesteads, Puna, Hawai‘i, TMK: 1-5-003:037. The Commission took this item up at 9:17 a.m. with 39 people from the public in attendance. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the request, and noted the Planning Director recommended approval of the application with conditions. The applicant, Gilbert Aguinaldo, on behalf of his mom, wife, and himself, gave some background information and said the proposal was to address the needs and concerns he had for the area being born and raised in Pahoa. He said a lot of the people have to travel out of the district to get medical attention, noting the congestion onto Highway 130. He said he realized the need when his dad needed medical attention and it was a burden for his mom to drive from 2 Pahoa to Hilo and back to see his doctors, noting this would help the community in a positive way. Chairman Ishibashi commended the applicants in their attempts to provide much needed medical services. Maddie Green, past president of the Nanawale Community Association consisting of 4,000 members, spoke in support of the request as many members in the community do not drive. She said she sits on the Pahoa Regional Town Center Steering Committee and the Puna Community Development Implementation Action Team who are also in support of the medical facility, noting she was sure that other associations have the same problem and would greatly appreciate such a facility. Mark Hinshaw, Chairman of the Pahoa Regional Town Center Steering Committee, spoke in support of the application, noting the project is in compliance with their design guidelines up for adoption by the Council this year. He said they are pleased the applicant is stepping up for this community and hometown in developing the much-needed medical services for Pahoa town. He said he also serves as president of the Main Street Pahoa, Chamber of Commerce, who are also in support of the request. Dr. David Nakamura testified in favor of the project. He spoke of the difficulty of recruiting new physicians to the area because of the lack of vacant medical office space and the lack of funds to build an office because of having to pay off over $200,000 of educational loans. He said the Hilo Medical Center has established a family medicine residency program in an attempt to recruit doctors on the Big Island; and unless there is a practice opportunity all the effort to training the doctors is going to go to waste as they will be looking for a place to practice. He said the only thing that made it practical for him to establish his practice here after graduating from medical school was an established physician actually shared his office so that he could build up enough funds to go on his own. He felt this project would give other doctors a similar chance to live and work in this community. Chairman Ishibashi agreed with Dr. Nakamura on the difficulty of recruiting doctor, adding he felt projects such as this really encourages new physicians to remain on the Big Island and to serve our people. which is greatly needed. Mr. Aguinaldo had no objections to a condition stating that the applicant shall comply with the Pahoa Village Design guidelines as represented. It was moved by Commissioner Henkel and seconded by Commission Moses that the application be approved as recommended by the Planning Director, with the added condition. A roll call vote was taken and motion carried with seven ayes (Henkel, Moses, Gonzales, Heaukulani, Miyasato, Ono, and Ishibashi). 3 NEW BUSINESS – 9:30 a.m. APPLICANTS: MICHAEL AND CYNTHIA GREENLAW (SPP 13-153) Application for a Special Permit to allow the establishment of a satellite learning and education center (school) and water catchment tank business on 4 acres of land situated within the State Land Use Agricultural District. The property consists of four lots and is located at the very end th of 19 Avenue on the west (mauka) side of the road, approximately 2,200 feet southeast of the th intersection of 19 Avenue and Maku‘u Drive, Hawaiian Paradise Park Subdivision, Puna, Hawai‘i, TMK: 1-5-021: 054, 055, 056 and 057. The Commission took this item up at 9:40 a.m. with 63 people from the public in attendance. (SEE EXHIBIT A) INITIATOR: PLANNING DIRECTOR (SP NO. 653) Assessment and appropriate action on applicant’s response/action regarding Condition No. 10 of Special Permit No. 653 issued to Ocean View Investment Company, Inc., on December 8, 1987 which allowed a variety of commercial and industrial uses and a farmers’ market on 14.75 acres of land within the State Land Use Agricultural District. The property is located at the western corner of the Hawai‘i Belt Road-Prince Kuhio Boulevard intersection and includes the existing Ocean View Store complex known as Pohue Plaza, Kahuku, Ka'u, Hawai‘i. TMK: 9-2-l85:094, 095,096 and Portions of 092 and 093. The Commission took this item up at 12:19 p.m. with 4 people from the public in attendance. (SEE EXHIBIT B) MINUTES – The Commission took up the following minutes at this time, 1:00 p.m. Approval of Minutes of the October 3, 2013 meeting – It was moved by Commissioner Gonzales, and seconded by Commissioner Moses, that the minutes be approved. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE MATTERS – The Commission took up the following under administrative matters at this time, 1:05 p.m. 1.Status of applications heard by Windward Planning Commission that are pending before County Council. – Mr. Arai said he will report on the UH Hilo rezoning and Kuwahara rezoning and boundary amendment at the next Hilo meeting. 2.Status of Contested Case proceedings for Connections New Century Public Charter School/CBESS Special Permit Application No. 12-000138 (SPP-12-138) – Mr. Arai had nothing new to report. th ANNOUNCEMENTS – Mr. Arai said the next meeting is set for Dec. 5. 4 ADJOURNMENT – There being no further business, at 1:07 p.m., the Chair declared the meeting adjourned.
