HomeMy WebLinkAbout2014-02-06 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES FEBRUARY 6, 2014 The Windward Planning Commission met in regular session at 9:04 a.m. in the County of Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman Wallace A. Ishibashi, Jr. presiding. COMMISSIONERS PRESENT: Wallace A. Ishibashi, Jr., Ronald Gonzales, Charles Heaukulani, Gregory Henkel, Myles Miyasato, and Raylene Moses. ABSENT AND EXCUSED: Stephen Ono. ALSO PRESENT: Bobby Command (Deputy Planning Director), Molly Stebbins (Deputy Corporation Counsel for the Windward Planning Commission), William Brilhante (from 10:09 a.m. to 10:28 a.m. and from 10:58 a.m. to 12:01 p.m., Deputy Corporation Counsel for the Planning Director), Kelly Gomes (from 10:02 a.m. to 11:20 a.m., Department of Public Works Engineering Division), Daryn Arai (Planning Program Manager), Jeff Darrow (Staff Planner), Maija Cottle (Staff Planner), and Sarah Hata-Finley (Secretary). A quorum was present. Chairman Ishibashi introduced staff and Windward Planning Commissioners to members of the public. STATEMENTS FROM THE PUBLIC – No statements were presented under this section of the agenda. APPLICANT: JERRY A. SOUZA (SLU 13-039/REZ 13-171) Applications for a State Land Use Boundary Amendment from Agricultural to Urban District and a Change of Zone from Agricultural-1 acre (A-1a) to a Village Commercial - 20,000 square feet (CV-20) zoning district for one (1) acre of land. The property is located on the east side of Kahakai Boulevard, across from the Woodland Center Shopping Center, Keonepoko, Puna, Hawai‘i, TMK: 1-5-007: 061. The property is located behind the YMCA on the north side of West Lanikāula Street and west of the future Kapi‘olani Street extension, Waiākea Cane Lots, Waiākea, South Hilo, Hawai‘i, TMK: 2-4-056:030. The Commission took this item up at 9:20 a.m. with 15 people from the public in attendance. (SEE EXHIBIT B) This item ended at 9:37 a.m. APPLICANTS: DONALD RANDAL & ALISON SIMPSON (SPP 13-155) Application for a Special Permit to allow the establishment of a 4-bedroom bed and breakfast operation within an addition to an existing two-bedroom single-family dwelling on approximately one (1) acre of land situated within the State Land Use Agricultural District. The property is located at 29-3825 Pueohi Road, Hakalau Homesteads, Hakalau, Hawai‘i, TMK: 2-9-002:032. The Commission took this item up at 9:37 a.m. with 9 people from the public in attendance. (SEE EXHIBIT C) This item ended at 9:49 a.m. APPLICANTS: TODD AND JILL OSBORN (SPP 13-156) Application for a Special Permit toallow the operation of an automotive mechanic repair shop on a 10.034-acre parcel situated within the State Land Use Agricultural District. The subject property is located along the east (makai) side of the Kea‘au-Pāhoa Road (Highway 130), approximately 480 feet southeast of the County water spigots and 2,800 feet southeast of the Hwy 130-Niaulani Street intersection, Keonepoko Homesteads, Puna, Hawai’i, TMK: 1-5-007:014. The Commission took this item up at 9:50 a.m. with 9 people from the public in attendance. Ms. Cottle informed the Commission that this application had been withdrawn by the applicant per email request of February 5, 2014, based on the Planning Director’s unfavorable recommendation. RECESSED: The Chair called a recess at 9:50 a.m., and the meeting was reconvened at 10:02 a.m. Ms. Stebbins returned at 10:04 a.m., and Mr. Brilhante arrived at 10:09 a.m. Page 2 of 5 Windward Planning Commission February 6, 2014 Minutes APPLICANT: WATERFALL ENTERTAINMENT, INC. (REZ 98-006) Requests for time extensions to Condition B (water commitment payment) and Condition C (completion of construction) of Ordinance No. 06 144, which amended Ordinance No. 98 98, which rezoned 21,050 square feet of land from a Single-Family Residential-10,000 square feet (RS-10) to an Industrial-Commercial-Mixed–20,000 square feet (MCX-20) zoning district. The property is located along the west side of Kanoelehua Avenue, approximately 190 feet from the Kanoelehua Avenue – Lanikāula Street intersection, Waiākea, South Hilo, Hawai‘i, TMK: 2-2- 037:029. The Commission took this item up at 10:02 a.m. with 16 people from the public in attendance. (SEE EXHIBIT D) This item ended at 10:13 a.m. APPLICANT: VINCENT T.C. TAI (REZ 13-167) Application for a Change of Zone from a Multiple-Family Residential–2,500 square feet (RM-2.5) to a Multiple-Family Residential–1,500 square feet (RM-1.5) zoning district for approximately 3.292 acres of land. The subject property is located at the end of Hualālai Street, just west of the Hualālai Street/Hale Nani Street intersection, Waiākea, South Hilo, Hawai‘i, TMK: 2-4-028:009. The Commission took this item up at 10:13 a.m. with 15 people from the public in attendance. (SEE EXHIBIT E) This item ended at 11:20 a.m. CLAIMANT: OFFICE OF THE MAYOR Discussion regarding action on claims for the release of funds from the Geothermal Asset Fund and recommendations from the claims adjuster, for the following community approved geothermal impact mitigation projects: Air Quality Monitoring Equipment Purchases - $174,000 a. New fixed and hand held air quality monitors to be purchased by Hawai‘i County Civil Defense to improve emergency response to geothermal events and to provide community members with hand held monitors, on a pilot basis. Ground Water Sampling in the Kīlauea East Rift - $45,000 b. Contract with USGS to conduct ground water sampling of existing wells and selected warm ponds along the Lower Puna coast to test for the presence of chemicals used in the geothermal energy process that might have mixed with ground water in the region. The study follows up a 1994 Study by USGS and addresses a specific recommendation in the study group’s report to conduct such studies. Page 3 of 5 Windward Planning Commission February 6, 2014 Minutes Meta-Analysis of Health Effects of Low to Moderate H2S Exposure; John A Burns c. School of Medicine - $55,000 The study will synthesize results of available published studies on the impacts of low to moderate exposures of H2S from geothermal and other sources globally. The report will highlight consistent research findings using independent biostatisticians and epidemiologist and lay the ground work for future health studies in the Puna Region. Enhanced Level 1 Environmental Site Assessment on former HGP-A brine water d. pond sites - $25,000 Study would collect existing environmental data and conduct soil sampling from the former brine pond sites to analyze for the presence of any hazardous materials that may be in the ground as a result of the early years of geothermal development. The Commission took this item up at 11:20 a.m. with 12 people from the public in attendance. (SEE EXHIBIT F) This item ended at 11:59 a.m. MINUTES – The Commission took this item up at 12:00 p.m. with 2 people from the public in attendance. Approval of Minutes of the January 9, 2014 meeting – It was moved by Commissioner Gonzales, and seconded by Commissioner Henkel, that the minutes of January 9, 2014 be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE MATTERS – The Commission took up the following at 12:01p.m. 1. Election of Officers for 2014. It was moved by Commissioner Moses and second by Commissioner Henkel to nominate Ronald Gonzales as Chairman of the Windward Planning Commission for the year 2014. Motion was unanimously carried by a voice vote of all Commissioners in attendance. It was moved by Commissioner Gonzales and second by Commissioner Moses to nominate Myles Miyasato as Vice-Chairman of the Windward Planning Commission for the year 2014. Motion was unanimously carried by a voice vote of all Commissioners in attendance. 2.Status of applications heard by Windward Planning Commission that are pending before County Council – Mr. Arai stated that there was nothing specific to report on this matter. Page 4 of 5 Windward Planning Commission February 6, 2014 Minutes 3.Status of Contested Case proceedings for Connections New Century Public Charter School/CBESS Special Permit Application No. 12-000138 (SPP-12-138) – Mr. Arai announced that the Connections contested case proceedings before hearings officer, Sandra Song, has concluded. Ms. Song’s proposed Findings of Fact, Conclusions of Law, and Decision and Order are due to the parties on March 7, 2014. Exceptions to the report are due by the parties on March 21, 2014; Statements of Support on March 28, 2014. The matter is expected to return to the Commission at its April 3, 2014, meeting. ANNOUNCEMENTS – Mr. Arai noted at 12:06 p.m. that the next Windward Planning Commission meeting is on March 6, 2014, and there are currently 5 items on the agenda. Mr. Ishibashi thanked the staff and Commissioners for a job well done. ADJOURNMENT – There being no further business, Chairman Wallace A.
