HomeMy WebLinkAbout2014-03-06 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES MARCH 6, 2014 The Windward Planning Commission met in regular session at 9:32 a.m. in the Hilo State Office Building, Conference Rooms A, B & C, 75 Aupuni Street, Hilo, Hawai‘i, with Chairman Ronald Gonzales presiding. COMMISSIONERS PRESENT: Ronald Gonzales, Charles Heaukulani, Gregory Henkel, Wallace A. Ishibashi, Jr., Stephen Ono, and Raylene Moses. ABSENT AND EXCUSED: Myles Miyasato. ALSO PRESENT: Duane Kanuha (Planning Director, from 9:32 a.m. to 10:27 a.m.), Margaret Masunaga (Deputy Corporation Counsel for the Windward Planning Commission), William Brilhante (Deputy Corporation Counsel for the Planning Director), Daryn Arai (Planning Program Manager), Jeff Darrow (Staff Planner), Maija Cottle (Staff Planner), and Sarah Hata-Finley (Secretary). A quorum was present. Chairman Gonzales introduced staff and Windward Planning Commissioners to members of the public. STATEMENTS FROM THE PUBLIC – No statements were presented under this section of the agenda. APPLICANT: AT&T MOBILITY (USE 13-044) Application for a Use Permit to allow the construction of a new telecommunication facility, including a 185-foot tall steel monopole with 8-foot tall panel antennas and related facilities within a 10,000 square-foot portion of a 785-acre parcel situated in the State Land Use Agricultural district and the County’s Agricultural 3-acre (A-3a) zoned district. The property is located on the south side of the Old Volcano Highway in the proximity of the 25 mile marker on the Hawai‘i Belt Road (Highway 11), Puna, Hawai`i, TMK: 1-1-004:Por. of 010. The Commission took this item up at 9:33 a.m. with 8 people from the public in attendance. (SEE EXHIBIT A) This item ended at 9:48 a.m. APPLICANT: CELLCO PARTNERSHIP dba VERIZON WIRELESS (USE 14-046) Application for a Use Permit to construct a 105-foot tall steel telecommunication monopine with 8-foot tall panel antennas and related facilities on an 8,100 square-foot parcel situated in the State Land Use Agricultural district and the County’s Agricultural 1-acre (A-1a) zoned district. The property is located on the west side of Silversword Court approximately 235 feet northwest Page 1 of 4 Windward Planning Commision March 6, 2014 Minutes from its junction with Ainaloa Boulevard, Tiki Gardens Subdivision, Kea‘au, Puna, Hawai`i, TMK: 1-6-102:056. The Commission took this item up at 9:48 a.m. with 8 people from the public in attendance. (SEE EXHIBIT B) This item ended at 10:35 a.m. INITIATOR: PLANNING DIRECTOR Amendments to Chapter 25, Articles 2 and 5 of the Hawai‘i County Code 1983 (2005 Edition, as amended), relating to golf courses and related golf course uses. Amendments will clarify that a Use Permit to allow golf courses and related uses within certain zoning districts will not be permitted if the property is situated within the State Land Use Agricultural District, in accordance with the State Land Use Law. The Commission took this item up at 10:35 a.m. with 13 people from the public in attendance. (SEE EXHIBIT C) This item ended at 10:40 a.m. INITIATOR: PLANNING DIRECTOR Amendment to Chapter 16 “Amendment Procedures”, Section 16.1 “Comprehensive Review,” part (1) of the County of Hawai‘i General Plan (2005 Edition, as amended) in order to allow for the comprehensive review of the General Plan to be initiated 10 years after adoption of the previous comprehensive amendments, rather than the submittal of the comprehensive amendments to the County Council within that same time frame. The Commission took this item up at 10:40 a.m. with 17 people from the public in attendance. (SEE EXHIBIT D) This item ended at 10:57 a.m. Chairman Gonzales called a recess at 10:58 a.m., and the meeting was reconvened at 11:11 a.m. APPLICANT: HAWAIIAN ACRES COMMUNITY ASSOCIATION (SPP 845) Discussion and further action regarding submission of an informal opinion from the Board of Ethics regarding proper legal representation of potential intervenor in proceedings involving an amendment to Special Permit No. 845 to allow additional uses within the community center, including a farmers market, and a one-year time extension to comply with Condition No. 4 (construction timeline of the community center and volunteer fire station). Special Permit No. 845 was originally approved to allow the establishment of a volunteer fire station, community center and related improvements situated on three (3) acres of land within the State Land Use Agricultural District. The property is located at the northeast corner of the intersection Page 2 of 4 Windward Planning Commision March 6, 2014 Minutes of Road 8 and Road C within the Hawaiian Acres Subdivision, Kea‘au, Puna, Hawai‘i, TMK: 1- 6-052:002. The Commission took this item up at 11:11 a.m. with 15 people from the public in attendance. (SEE EXHIBIT E) At 11:52 a.m., it was moved by Commissioner Henkel and seconded by Commissioner Ishibashi that the Commission go into executive session to consult with its attorney regarding questions and issues pertaining to the Commission’s powers, duties, privileges, immunities, and liabilities, pursuant to Hawai‘i Revised Statutes Section 92-5. A voice vote was taken of all Commissioners present, and motion carried with six aye votes. At 11:55 a.m. the Commission went into executive session. At 12:06 p.m., it was moved by Commissioner Moses and seconded by Commissioner Henkel that the Commission go out of executive session. A voice vote was taken of all Commissioners present, and motion carried with six aye votes. The hearing reconvened for regular session at 12:08 p.m. This item ended at 12:12 p.m. MINUTES – The Commission took this item up at 12:12 p.m. Approval of Minutes of the February 6, 2014 meeting – It was moved by Commissioner Henkel, and second by Commissioner Ishibashi, that the minutes of February 6, 2014 be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE MATTERS – The Commission took up the following at 12:12 p.m. 1.Status of applications heard by Windward Planning Commission that are pending before County Council. 2. Status of Contested Case proceedings for Connections New Century Public Charter School/CBESS Special Permit Application No. 12-000138 (SPP12-138). Mr. Arai stated that the next Commission meeting is on April 3, 2014, and that there tentatively seems to be six items on the agenda, including the Connections Special Permit (SPP 12-138). ANNOUNCEMENTS – Mr. Arai noted at 12:14 p.m. that there were no announcements at this time.
