PLANNING DIRECTOR INITIATED AMENDMENT
A regularly advertised hearing on the
TO CHAPTER 25 OF THE HAWAI‘I COUNTY CODE, RELATING TO REQUIRED
NUMBER OF PARKING SPACES
was called to order at 10:15 a.m. in the West Hawai‘i Civic
Center, Community Center, Building G, 74-5044 Ane Keohokālole Highway, Kailua-Kona,
Hawai‘i, with Chair Geraldine Giffin presiding.
COMMISSIONERS PRESENT: Geraldine Giffin, Brandi Beaudet, Thomas Hickcox,
Barbara Nobriga and Thomas Whittemore
ABSENT AND EXCUSED: Richard Nelson, III
ALSO PRESENT: Duane Kanuha (Planning Director), Margaret Masunaga (Deputy Corporation
Counsel), Jeff Darrow (Planner), Maija Cottle (Planner), Ron Whitmore (Planner),
Bethany Morrison (Planner) and Noriko Sauer (Commission Secretary)
And one person from the public in attendance.
INITIATOR: PLANNING DIRECTOR
Amendment to Chapter 25, Article 4, Division 5 and Article 7, Division 2 of the Hawai‘i County
Code 1983, (2005 Edition, as amended), relating to increased residential density, including parking
requirements, within CDH, Downtown Hilo Commercial District. The purpose of this ordinance is
to rectify an unintended revision to Section 25-4-51 of the Hawai‘i County Code where the
enactment of Ordinance No. 13-95 inadvertently repealed amendments to Section 25-4-51
contained in Ordinance No. 12-91 regarding funeral homes, funeral services, mortuaries and
crematoriums. This draft bill restores the provisions of Ordinance No. 12-91.
GIFFIN: Moving right along, we are going to be going onto Agenda Item No. 2, which is initiated
by the Planning Director. It is an amendment to Chapter 25, Article 4, Division 5 and Article 7,
Division 2 of the Hawai‘i County Code 1983, 2005 Edition, as amended, relating to increased
residential density, including parking requirements, within CDH, Downtown Hilo Commercial
District. The purpose of this ordinance is to rectify an unintended revision of Section 25-4-51 of the
Hawai‘i County Code where the enactment of Ordinance No. 13-95 inadvertently repealed
amendments to Section 25-4-51 contained in Ordinance No. 12-91. This is in regards to funeral
homes, funeral services, mortuaries and crematoriums. Maija?
COTTLE: Thank you, Madam Chair. Good morning, everyone. I think you stole my presentation,
Geri. This is a simple housekeeping measure, and the best way to explain it is to have you look at
Page 2 of our background and recommendation report. So in 2012 an ordinance was passed by the
Council to add funeral services and crematoriums to the parking requirements in the Zoning Code.
And then Ordinance 13-95 was adopted in 2013, related to the Downtown Hilo Commercial
District, and it inadvertently dropped those two references to crematoriums and funeral services in
the Zoning Code. So this is just a simple housekeeping measure to put that reference back into the
Code as was intended when Ordinance 12-91 was adopted.

that no one has signed up to testify for Agenda Item No. 2. And, Commissioners, just FYI, the
recommendation is provided at the bottom half of Page 2.
HICKCOX: We are calling for a vote, Madam Chair?
GIFFIN: Yes.
HICKCOX: Madam Chair, I recommend that this Planning Commission issue a favorable
recommendation to the County Council regarding this proposed Planning Director-initiated bill to
amend Chapter 25, Zoning Code, Article 4, Division 5, Section 25-4-51 of the Hawai‘i County
Code 1983, 2005 Edition, as amended, relating to required number of parking stalls.
GIFFIN: Do I hear a second?
NOBRIGA: Second.
GIFFIN: It’s been moved by Commissioner Hickcox and seconded by Commissioner Nobriga that
we send a favorable recommendation to the County Council regarding this proposed amendment, as
stated by Commissioner Hickcox in his motion. Any discussion? Hearing none, Maija?
COTTLE: Thank you. Commissioner Hickcox?

COTTLE: Commissioner Nobriga?
NOBRIGA: Aye.
COTTLE: Commissioner Beaudet?
