A regularly advertised hearing on the application of
was called to order at 9:08 a.m. in the County of Hawai‘i, Aupuni Center Conference Room, 101
Pauahi Street, Hilo, Hawai‘i with Chairman Ronald Gonzales presiding.
COMMISSIONERS PRESENT: Ronald Gonzales, Charles Heaukulani, Gregory Henkel,
Wallace A. Ishibashi, Jr., Raylene Moses, and Stephen Ono.
ABSENT AND EXCUSED: Myles Miyasato.
ALSO PRESENT: Duane Kanuha (Planning Director), Margaret Masunaga (Deputy
Corporation Counsel for the Windward Planning Commission), Amy Self (Deputy Corporation
Counsel for the Planning Director), Jeff Darrow (Staff Planner), Maija Cottle (Staff Planner),
Sarah Hata-Finley (Secretary), and Melissa Dacayanan (Planning Commission Support
Technician).
And approximately 11 people from the public in attendance.
APPLICANT: B2-II EDUCATIONAL TRUST (REZ 14-172)
Application for a Change of Zone from an Agricultural 3-acre (A-3a) and an Agricultural 1-acre
(A-1a) to a Family Agricultural 1-acre (FA-1a) zoned district for 3.012 acres of land. The
property is located at the end of Ho‘ohoaloha Street, approximately 1,500 feet south from its

intersection with Ainaola Drive, Waiākea Homestead 2 Series, South Hilo, Hawai‘i, TMK: 2-4-
034:046.
GONZALES: Item No. 1, B2-II Educational Trust. Good morning, Jeffrey.
DARROW: Good morning, Mr. Chairman. Good morning, members of the Planning
Commission. Welcome. Got a long day ahead of us, so we’ll start off with a bang. Our first
applicant is B2, B2-II Educational Trust, and they’re requesting a change of zone. The area of
the subject application is within the South Hilo District, more specifically, we’re looking in the
Waiākea, upper Waiākea area. Just for reference, this road running through the middle of the
map going in a northeast, southwest direction is Ainaloa, Ainaola Drive. The subject property is
identified with a black outline. We’ll zoom in here so you can get a better view. Again, we have
Ainaola Drive running through the middle of the map, and the actual property is located on
Ho‘ohoaloha Street, and access is provided mainly through that, but it’s also provided through
Ho‘ohoaloha Place. Again, the subject property is identified with a black outline. The different
colors on the map represent different zonings. The green, the blue, the darker blue all represent
Agricultural zoning. There’s actually a blue that’s to the right side of the map that is similar to
the request that the applicant is requesting which is Family Agricultural – 1 acre. Currently, it is

zoned 3 acres. The green is representing one acre Agricultural, and then the yellow up in the
upper right hand corner is Residential with a little bit of commercial in the pink.
This is an aerial photo. Again, we have Ainaola Drive. We have access provided in the black
outline. This is an older photo. Currently, there is a single family dwelling that is developed on
the lot, and it’s back in the south portion of this particular picture. You can see there are
scattered dwellings, larger properties, quite a bit of vacant land as well.
This is the State Land Use Boundary Map. This shows the area mainly Agriculture which is
green. And pink areas are identifying Urban State Land Use. This is our General Plan Land Use
Pattern Allocation Guide Map. The yellow or mustard color is Low Density Urban. There is a
small portion of Medium Density. The green on the outskirts is Important Agricultural Lands so
this application falls within the Low Density Urban area.
The applicant is requesting a change of zone from Agricultural-3 acres and Agricultural-1 acre--
that portion is just a small portion of an easement portion on the right side--to a Family
Agricultural – 1 acre zoning district for 3.012 acres of land. The reason for the request is that the
applicant is requesting this change of zone in order to subdivide the property into three one-acre
lots which are intended to be conveyed to the applicant’s children.
This is the submitted site plan by the applicant. Again, we have access from Ho‘ohoaloha Street
as well as Ho‘ohoaloha Place. You can see that little portion I was speaking about in the
Agricultural – 1 acre area, so they will access, this lot will provide access from the place and
these two lots will provide access from the street. Again, here’s showing the existing dwelling,
and this is a picture of it right in that general location.
We have some site photos. This is at the end of Ho‘ohoaloha Street. The applicant’s single
family dwelling is located in the left hand portion of the map. As you can see, it’s built to
dedicable standards. Again, this is showing the remainder of the property, in the, on the
property. This is looking towards Hilo on Ho‘ohoaloha Street so again you can see the wide
road and paved shoulders.
This is on Ho‘ohoaloha Place. Access to the property would be just to your right, and currently
they have two 8-foot paved shoulder--roadways that go up providing access to the lots on the
right side as well as lots on the left side. And this is a picture from the end of Ho‘ohoaloha Place
showing the subject property with the Single Family Dwelling in the rear of the property.
The Planning Director is recommending that the Planning Commission send a favorable
recommendation to the Hawai‘i County Council. I do have one change we’d like to make to the
conditions. The Planning Director has been made aware of this change and is in agreement with
it. And it’s Condition L found on Page 3. This would be on sentence one-two-three-on the
fourth sentence starting at the end of this sentence. It says the fair share contribution for each
and we’ll add in the words “newly created.” Newly created lot shall be based or lots, shall be
based on the actual number of residential units developed. And so this means that currently,
there’s one lot, so they don’t need to pay the fair share on that particular lot because they already

have a lot. The two new lots that will be created, they will need to pay fair share on those newly
created lots.
With that, that concludes our presentation. Thank you.
GONZALES: Any questions for staff? Thank you. I’ll bring up the applicant at this time.

GONZALES: Do you swear to tell the truth before the Windward Planning Commission today.
FUKE: Yes, I do.
GONZALES: Thank you.
FUKE: Good morning, Mr. Chairman and members of the Commission. My name is Sidney
Fuke. I’m representing the applicant who couldn’t be here today. Your staff’s report is excellent
and comprehensive as always. We’d just like to add two things. One is that the proposed
amendment to the condition is what we had discussed earlier and it’s acceptable as well as all the
other conditions that the Director has proposed. Also that water is available for each, would be
available for each of the newly created two additional lots. So, if there are any other questions
the Commission may have, I’d more than happy to answer.
GONZALES: Any questions from the Commissioners? Mr. Fuke, you’re okay then with the
conditions provided for the change on Condition L?
FUKE: Yes.
GONZALES: Okay, thank you very much. Mr. Director, the change to Condition L is okay
with you?
KANUHA: Mr. Chairman, yes, staff has discussed that with me and actually because of that
language, I think we’ll be utilizing that same language as a standard condition in applications of
this nature from here going forth.
GONZALES: Very good. Thank you. A motion would be in order, and also there’s no public
testimony on this issue. Thank you. Commissioners, anyone? Motion?
MOSES: I move that a favorable recommendation be forwarded to the County Council on the
application for Change of Zone, REZ 14-000172, based on the Planning Director’s
recommendation and proposed conditions and amendment that was just stated to those
conditions.
HENKEL: Second.

DARROW: Thank you, Mr. Chairman. The motion is to send a favorable recommendation to
