A regularly advertised hearing on the application of
SPP 09-077)
was called to order at 9:31 a.m. in the County of Hawai‘i, Aupuni Center
Conference Room, 101 Pauahi Street, Hilo, Hawai‘i with Chairman Ronald Gonzales presiding.
COMMISSIONERS PRESENT: Ronald Gonzales, Charles Heaukulani, Gregory Henkel,
Wallace A. Ishibashi, Jr., Raylene Moses, and Stephen Ono.
ABSENT AND EXCUSED: Myles Miyasato.
ALSO PRESENT: Duane Kanuha (Planning Director), Margaret Masunaga (Deputy
Corporation Counsel for the Windward Planning Commission), Amy Self (Deputy Corporation
Counsel for the Planning Director), Jeff Darrow (Staff Planner), Maija Cottle (Staff Planner),
Sarah Hata-Finley (Secretary), and Melissa Dacayanan (Planning Commission Support
Technician).
And approximately 13 people from the public in attendance.
APPLICANTS:RICHARD AND CINDY VOGEL (Amend SPP 09-077)
Amendment to Special Permit No. 09-077 to increase the number of permitted bed and breakfast
bedrooms units from one (1) bedroom unit to three (3) bedroom units. Special Permit No. 09-
077 was originally approved to allow the establishment of a 1-bedroom bed and breakfast
establishment within an existing 4-bedroom single family dwelling situated on 1-acre of land
within the State Land Use Agricultural District. The property is located at 13-3357 Ho‘okupu
Street, Leilani Estates Subdivision, Keahialaka, Puna, Hawai‘i, TMK: 1-3-31:66.
GONZALES: Item No. 3 is Richard and Cindy Vogel, amendment to Special Permit 09-077.
DARROW: Thank you, Mr. Chairman. If I can direct your attention to our presentation. This is
an amendment to Special Permit No. 09-97 (sic). This is an existing special permit for a one-
bedroom bed and breakfast that was approved back in 2009. The area of the subject application
is within the Puna district, more specifically, we’re looking at Leilani Estates Subdivision.
Access would be from the Pāhoa-Kalapana Road. Pāhoa would be on the upper left portion of
the map. Kalapana-Kaimu area would be more south from this area. Access would be on
Leilani Boulevard from the highway, and the subject property is near the rear of the subdivision
identified with a black outline. We’ll zoom in a little closer. As you can see, the colors on the
map are mainly light green which represent Agricultural – 1 acre zoning, County zoning. This is
on Ho‘okupu Street.

This is an aerial photo. Again, we have Ho‘okupu Street running through the middle of the map
in a north-south direction. The subject property is identified with a red outline. Again, you can
see that there are scattered dwellings in the area, but mainly quite a bit of vacant land.
The applicants are requesting an amendment to Special Permit No. 09-97 (sic) to allow two
additional bed and breakfast units to the one unit bed and breakfast operation within their
existing four-bedroom single family dwelling. The objective is to provide a quiet three-bedroom
B&B for guests who seek a quiet authentic local experience. The operation will provide the
applicants with an opportunity to share their residence and bring additional economic growth to
the area and local businesses.
This is the plot plan or floor plan of the existing single family dwelling. Originally, there was
one bedroom. They’re adding in two additional bedrooms. The applicants and owners reside
within this dwelling, bedroom. There is a pool as well as a garage on the property. This is a
closer up of the aerial. We have Ho‘okupu Street on the left side of the map. You can see the
single family dwelling as well as the pool and the garage. And you can see that it’s quite
protected by a quite a number of existing trees in the area. This is on Ho‘okupu looking towards
Leilani Boulevard. A little wet that day. This is looking directly at the applicant’s driveway
with the subject dwelling in the back, and this is a closer up view.
The Planning Director is recommending that the Planning Commission approve this amendment
for the additional two bedrooms. That concludes our presentation. Thank you.
GONZALES: Any questions for staff? Mr. Ono.
ONO: Clarification. The request, is that for existing bedrooms to convert? The existing
bedrooms or is that an additional bedroom that they plan to build.
DARROW: These would be existing bedrooms so the house was already constructed as a four-
bedroom residence. So they’re just adding in two additional existing bedrooms to the bed and
breakfast operation.
ONO: Thank you.
GONZALES: Any other questions? Thank you.
DARROW: Thank you.
GONZALES: Will the applicant please come forward?
VOGEL (CINDY): Good morning.
GONZALES: Good morning. Would you raise your right hands, please? Do you swear to tell
the truth before the Windward Planning Commission today?
VOGEL (CINDY): Yes.

GONZALES: Okay, will you state your name, where you live, and go ahead.
VOGEL (CINDY): Cindy and Richard Vogel. We live at the residence at 13-3357 Ho‘okupu in
Pāhoa.
GONZALES: Anything you want to say? All good?
VOGEL (CINDY): Everything’s all good. Now we’d just like to provide additional
accommodations. The need is there, and the community that comes to this area really
appreciates the local environment in Pāhoa.
GONZALES: Okay, you’ve read the Director’s Recommendations?
VOGEL (CINDY): Yes.
GONZALES: You’re in agreement—
VOGEL (CINDY) --yes we are—
GONZALES: --with the conditions? Okay, very good.
VOGEL (CINDY): Thank you.
GONZALES: Any questions? Thank you.
VOGEL (CINDY): Thank you.
GONZALES: All right. Commissioners, a motion would be in order. I’d like to state for the
record, too, there is no public testimony.
HENKEL: I’d like to move that Special Permit No. 09-000077 be approved by the Commission
with conditions set by the Planning Director.
DARROW: For clarification, this would be the amendment to Special Permit No. 09-97 (sic)?
HENKEL: So corrected.
DARROW: Thank you.
ISHIBASHI: Second.
GONZALES: All right. Motion to approve by Commissioner Henkel, seconded by
Commissioner Ishibashi. Any discussion, Commissioners? Okay, I guess we take a vote.

DARROW: Thank you, Mr. Chairman. The motion before us is to approve the amendment
request for Special Permit 09-, I’m sorry, 09-77, oh, lucky I just saw that. That was my bad.
