WINDWARD PLANNING COMMISSION
COUNTY OF HAWAI‘I
MINUTES
OCTOBER 2, 2014
The Windward Planning Commission met in regular session at 9:00 a.m. in the County of
Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman
Myles Miyasato presiding.
COMMISSIONERS PRESENT: Myles Miyasato, Charles Heaukulani, Gregory Henkel, Donald
Ikeda, Raylene Moses, and Stephen Ono.
ALSO PRESENT: Duane Kanuha (Planning Director), Margaret Masunaga (Deputy
Corporation Counsel for the Windward Planning Commission), Daryn Arai (Planning Program
Manager), Jeff Darrow (Staff Planner), Maija Jackson (Staff Planner), Christian Kay (Staff
Planner), and Sarah Hata-Finley (Commission Secretary).
A quorum was present. Chairman Miyasato introduced staff and Windward Planning
Commissioners to members of the public and went over the procedure for public testimony.
STATEMENTS FROM THE PUBLIC – No statements were presented under this section of the
agenda.
1.APPLICANT: ĀHUALOA LAND COMPANY (REZ 14-178)
Application for a Change of Zone from an Agricultural 40-acre (A-40a) to an Agricultural
5-acre (A-5a) district for 67.649 acres of land. The property is located on the mauka side of
Hawai‘i Belt Road, between Hawai‘i Belt Road and Old Māmalahoa Highway,
approximately 0.7 miles east of the Mud Lane–Hawai‘i Belt Road intersection and between
Mile Marker 51 and 52, Kapoaula, Kamoku, Hāmākua, Hawai‘i, TMK: 4-7-007:042.
At 9:01 a.m., Chairman Miyasato announced that this application has been continued.
2.APPLICANT: MARK G. JERNIGAN (SPP 09-081)
Request to amend Condition No. 2 (life of permit) of Special Permit No. 09-000081, that was
originally approved to allow the removal of cinder on 43,608 square feet of land situated
within the State Land Use Agricultural District. Specifically, the amendment seeks a 5-year
extension to the life of the permit. The property is located along the south side of Mahimahi
Drive, approximately 356 feet east of the Mahimahi Drive–Lurline Lane intersection,
Hawaiian Ocean View Estates Subdivision, Kahuku, Ka’u, Hawai‘i, TMK: 9-2-145:59.

3.APPLICANT: RONALD B. QUADE, D.D.S. (SPP 14-168)
Application for a Special Permit to allow the establishment of a dental clinic within an
existing 4-bedroom single family dwelling located on a 1.131-acre parcel situated within the
State Land Use Agricultural District. The subject property is located along the west (mauka)
side of the Volcano Highway (Hwy 11), 1/3-mile south of Mile Marker 19 in Mt. View,
Puna, Hawai’i, TMK: 1-8-021: 029.

4.INITIATOR: COUNTY COUNCIL (Bill No. 266)
County Council Bill No. 266 amending Chapter 23, Article 4, Section 23-58 and Article 5,
Section 23-68 of the Hawaii County Code 1983 (2005 Edition, as amended), relating to
submission of the preliminary plat and final plat for an application for subdivision. The
purpose of these revisions is to require the preparation of both the preliminary and final plat
maps by a surveyor.

Approval of Minutes of the September 4 and 5, 2014 meetings – It was moved by
Commissioner Moses, and seconded by Commissioner Henkel, that the minutes of September 4,
2014 and September 5, 2014 be approved as circulated. Motion was unanimously carried by a
voice vote of all Commissioners in attendance.
ADMINISTRATIVE MATTERS/ANNOUNCEMENTS -
The Commission took up the

1.Status of applications heard by Windward Planning Commission that are pending before
County Council. (No report.)
Mr. Arai informed the Commission that their next meeting will be on November 6, 2014, and
there are tentatively five items on the agenda. He stated that a request for the reconsideration of
th
the Commission’s September 4 denial of an amendment to SMA 450 was submitted by
Applicant Scott Watson, and that request for reconsideration will most likely be held on
November 6, 2014. Once it is scheduled, staff will provide the Commissioners with the entire
record for review.

ADJOURNMENT
– There being no further business, it was moved by Commissioner Moses
and seconded by Commissioner Henkel that the meeting be adjourned. Motion was
unanimously carried by a voice vote of all Commissioners in attendance. Chairman Miyasato
adjourned the meeting at 9:48 a.m.
