KEVIN STAFFORD (SPP 14-165) A regularly advertised hearing on the application of was called to order at 9:00 a.m. in the County of Hawai‘i Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i with Chairman Myles Miyasato presiding. COMMISSIONERS PRESENT: Myles Miyasato, Charles Heaukulani, Gregory Henkel, Donald Ikeda, Raylene Moses, and Stephen Ono. ALSO PRESENT: Duane Kanuha (Planning Director), Margaret Masunaga (Deputy Corporation Counsel for the Windward Planning Commission), Daryn Arai (Planning Program Manager), Jeff Darrow (Staff Planner), Maija Jackson (Staff Planner), Christian Kay (Staff Planner), and Sarah Hata-Finley (Commission Secretary). And approximately 9 people from the public in attendance. APPLICANT: R. KEVIN STAFFORD (SPP 14-165) Application for a Special Permit to allow the establishment of a four-bedroom bed and breakfast operation within an existing dwelling situated on 18,000 square feet of land within the State Land Use Agricultural District. The property is located at 12-7200 Ki‘i Nani Place. It borders both Namohala Place and Ki‘i Nani Place, Kehena Beach Estates Unit 2, Keauohana, Puna, Hawai‘i, TMK: 1-2-031:039. MIYASATO: The first item on our agenda is Kevin Stafford. DARROW: Thank you, Mr. Chairman. Good morning members of the Planning Commission. MIYASATO/MOSES/ONO: Good morning. DARROW: Thank you again for your service. We’re starting off with a bed and breakfast request this morning. Oop, oh jumping the gun--ah, our Applicant is R. Kevin Stafford. He’s requesting a Special Permit to allow a 4-bedroom bed and breakfast operation. The area of the subject application is within the Puna District of Hawai‛i. More specifically, we’re looking in the area of Kehena. Just for reference, this is the Kehena Beach, and the—you might be familiar with Kalapana Seaview Estates. That’s this particular subdivision. You have the highway that brings access to this particular area. The subject application is going to be located within the Kehena Beach Estates Subdivision. More specifically, we can see a black outline of the subject property for this application. This is the General Plan Land Use Pattern Allocation Guide Map for this particular area. The different colors on the map represents the different designations. Just for reference, the dark green represents Open which is mainly along the coastline. The lighter green is Important 1 EXHIBIT A Agricultural Lands. The white is Extensive Agricultural. And the kind of orange-ish brown is Rural, and all these subdivisions have been identified in the Rural General Plan designation. This is a zoomed in photo of the location map. Again, the Kala—Kehena Beach Estates Subdivision. You have the Kalapana-Kaimu Road which provides access to this area, and the subject property which is located between Mamo [sic] Namohala Place and Ki‛i Nani Place. Main access is from Namohala, and alternate access is from Ki‛i Nani. You’ll notice that a majority of the properties are half the size of this property. In 1998, two properties were consolidated to make this one 18,000 square foot property. The other properties are about 9,000 square feet in size. So, this is one of those situations where you have County Agricultural, State Land Use Agricultural, yet you have small residential rural-type lots. This is an aerial photo. Again for reference, we have Ki‛i Nani Place and Namohala Place. The subject property is identified with a red outline, and the existing dwelling is located on the northwest side of the property. The Applicant is requesting a Special Permit to allow the establishment of a 4-bedroom bed and breakfast operation within an existing dwelling situated on 18,000 square feet of land in the Kehena Beach Estates Subdivision. The dwelling has been recently renovated to include four bedrooms, each with a bathroom. That will allow two guests per room. The property also has a detached workshop with a bathroom that will be changed to a guest house in which the two proprietors will reside in. This is a site plan showing the mainly where you have Ki‛i Nani Place on the right side of the map. Namohala Place on the left side. Access is mainly from here, but again access can be provided. Parking, quite a bit of area for parking. The recently renovated dwelling is now three stories, and then you have the detached garage which will be, or workshop which will be converted into a guest house. This is a water tank. This is the first floor so, again, this is showing the porte-cochre and then the existing dwelling’s kitchen. Second floor and third floor which again has bedrooms on each floor. And a site photo. This is actually standing on Namohala Place looking at the 3-story dwelling with the porte- cochre. And, this is the existing roadway on Namohala Place. The Planning Director is recommending that the Planning Commission approve this Special Permit recommendation with conditions. Bed and breakfast requests are usually, come with standard conditions. We have added a special condition for this one that says that within one year that the Applicants convert the workshop, get a change of use building permit to convert it to the guest house that they’re asking for. With that, that concludes our presentation. Thank you. MIYASATO: Commissioners, any questions for staff? STAFFORD: Okay. MIYASATO: Could you please raise your right hand? Do you swear or affirm to tell the truth on this matter now before the Hawai‛i County Planning Commission? STAFFORD: I do. MIYASATO: Could you please state your name and residence? STAFFORD: My name is R. Kevin Stafford. The address is 12-7200 Ki‛i Nani Place, Pāhoa, Hawai‛i. MIYASATO: Do you have any statements or presentation for this application? STAFFORD: No, I appreciate the, the attention of the committee, and I appreciate their work. MIYASATO: Thank you. Commissioners, any questions for the Applicant? ONO: Two questions. STAFFORD: Yes. ONO: It sounds as if you’re ready to function as a bed and breakfast program. STAFFORD: We’ll still a—finishing, finalizing the renovations of the building—within I would say two weeks, the renovations will be finished— ONO: --according to the— STAFFORD: --and then we will— ONO: --I’m sorry— STAFFORD: And then we’ll be furnishing the house appropriately for a bed and breakfast so sometime in December we will be accepting guests, we’ll be able to accept guests. ONO: Second question. The Director’s asking that you be ready with the guest home for your, your use? 3 EXHIBIT A STAFFORD: Yes. ONO: In the meantime, you have a year or so. What, what’s going to happen with your presence for the— STAFFORD: --we’re gonna live in one of the bedrooms in the main house and vacate that workshop area so we will only be renting three bedrooms until we get a, permission to use the workshop as a, as a guest house. ONO: Thank you. MIYASATO: Any further questions, Commissioners? If not, thank you. STAFFORD: Thanks. MIYASATO: Do we have anyone wishing to testify? We have no one signed up to testify for this application? If not, Commissioners, any discussion? I’ll accept a motion. IKEDA: I’ll make the motion. I move that the application for a Special Permit, Docket Number SPP 14-165 be approved based on the Planning Director’s recommendation and proposed conditions. HENKEL: Second. MIYASATO: Moved by Commissioner Ikeda, seconded by Commissioner Henkel. Is there any discussion on the motion? If not, you can call the roll. DARROW: Thank you, Mr. Chairman.
