was called to order at 10:15 a.m. in the County of Hawai‘i Aupuni Center
Conference Room, 101 Pauahi Street, Hilo, Hawai‘i with Chairman Myles Miyasato presiding.
COMMISSIONERS PRESENT: Myles Miyasato, Charles Heaukulani, Gregory Henkel, Donald
Ikeda, Raylene Moses, and Stephen Ono.
ALSO PRESENT: Duane Kanuha (Planning Director), Danny Patel (Deputy Corporation
Counsel for the Windward Planning Commission), Jeff Darrow (Staff Planner), Sarah
Hata-Finley (Commission Secretary), and Melissa Dacayanan (Planning Commission Support
Technician).
And approximately 3 people from the public in attendance.
APPLICANTS: MELVIN AND BRENDA MORRIS (REZ 14-180)
Application for a Change of Zone from an Agricultural 3-acre (A-3a) to a Family Agricultural-1
acre (FA-1a) zoning district for 3.001 acres of land. The property is located at the end of
Ho‘ohoaloha Street, approximately 1,500 feet south from its intersection with Ainaola Drive,

MIYASATO: Move on to Item No. 2 on the agenda, Melvin and Brenda Morris.
ONO: Mr. Chair, can I ask for a 5-minute recess?
MIYASATO: Five-minute recess.
Chairman Miyasato called a recess at 10:16 a.m., and the meeting was reconvened at 10:22 a.m.
MIYASATO: Okay, I’d like to call the meeting back to order. You’re on, Mr. Darrow.
DARROW: Thank you again, Mr. Chairman. Our next Applicants are Melvin and Brenda
Morris. This, they are requesting a Change of Zone. The area of the subject application is within
the South Hilo District, more specifically, we’re looking in the upper Waiākea area. Just for
reference, you have the white line running diagonally through the middle of the map. This is
Ainaola Drive, and the subject application is identified with a black outline.
As we zoom in closer, this again is a County zoning map, so the different colors represent the
different County zonings that we have in place. This location may be familiar. We just had an
application just next door approximately two to three months ago for B-II Educational Trust.
This is a very similar request.

The zoning in the light blue is Agricultural – 3 acres. The darker blue is Family Agricultural – 1
acre. You’ll see there’s three areas identified with that zoning. And the darker green is
Agricultural – 1 acre.
This is the State Land Use Boundary Map. The majority of the area is identified in Agriculture
with your Urban boundary to the north.
This is the General Plan Land Use Pattern Allocation Guide Map. This area is in transition
towards more Low Density Urban type uses. That’s the yellow. You have a small, medium
density node where the commercial stores are located off Ainaola as well as some Important
Agricultural and Extensive Agricultural Lands located more mauka.
The Applicants are requesting a Change of Zone from Agricultural – 3 acres to a Family
Agricultural – 1 acre zoning district for 3.001 acres of land. The property is located at the end of
Ho‛ohoaloha Street, approximately 1,500 feet south from its intersection with Ainaola Drive.
The reason for the request is to subdivide the property into three lots which are intended to be
conveyed to the Applicants’ children.
This is an aerial view. We have Ho‛ohoaloha Street that provides access to the subject property.
This is approximately 50 feet right-of-way, with a 20-foot paved roadway in place currently. As
you can see, there are dwellings located in the area as well as some vacant land.
This is the proposed subdivision layout. Again, access will be at the end of Ho‛ohoaloha Street,
and this is the proposed 3-lot configuration. Lot, one of the lots will be accessing from an
easement that comes off of the end of the cul-de-sac.
The Planning Director is recommending that the Planning Commission send a favorable
recommendation to the Hawai‛i County Council with conditions. We have not received any
correspondence since the application was distributed to the Planning Commission.

MIYASATO: Commissioners, any questions for staff?
ONO: Yes, could you go back to the—the, how do you get to the third lot, the one—
DARROW: --This lot here would be directly from the end of the cul-de-sac—
ONO: --right—
DARROW: --you can see access to this lot would be from this flagpole—
ONO: --okay—
DARROW: --and then again from, for this lot, you would come off this access easement.

ONO: So, what impact would that have on that lot?
DARROW: This lot here?
ONO: Two, yeah.
DARROW: It appears that there is, this property does have the access rights to that.
ONO: Today?
DARROW: Yeah.
ONO: I mean as of—so the 2-A and 3-A, there’s an existing access?
DARROW: Right off there, yeah.
ONO: Okay, thank you.
DARROW: The Applicant may be able to further clarify that for us.
MIYASATO: Any further questions for staff, Commissioners?
DARROW: Thank you.
MIYASATO: Will the Applicant or representative please come forward? Do you swear or
affirm to tell the truth on this matter now before the Hawai‛i County Planning Commission?
FUKE: Yes, I do. Good morning, Mr. Chairman and Members of the Commission. My name is
Sidney Fuke. I’m here assisting the Applicant, Mr. and Mrs. Morris. I’d also like to
acknowledge the presence of the Morris’s niece, Miss Kristen Brilhante.
The staff’s report as always is excellent and on point. The recommendations were reviewed by
the Applicant, and found them all to be acceptable. I’d like to also kind of point out that one
thing which the staff did mention is that this particular area is, was originally subdivided by Ms.
Brilhante’s dad, Bill Brilhante, and so, he created like a number of 3-acre lots, pretty much like
for family oriented. And, if you look at where you see Lot No. 5—I’m sorry, Lot No. 5 on the
right-hand side. Yeah, that property was recently rezoned by this Commission and that was
owned by one of Mr. Brilhante’s son, and so he has this prop—he has this dwelling on the
property, and that was also for like a 3-lot subdivision, so that was recently considered by the
Commission and ultimately approved by the County Council.
This property here is owned by Mr. Brilhante’s sister, which is Mrs. Morris, and the property,
you can see Lot 5-A, that’s owned by another member of the Brilhante family, so at some point
in time, that Lot 5-A may come in for a zone change. So, when they asked me, I said like why
don’t you guys all get together and make one application, you know, but anyway, like, so that’s

the only addition I wanted to add. But in terms of the substance of the report, the water
condition and so on and so forth, what your staff provided is all accurate.
There isn’t for the—to answer Commissioner Ono’s question—to service Lot 4-A, the access
would come in from you know the pole of Lot 3-A. There is an existing easement that would
provide access to that. So—thank you very much.
MIYASATO: Any questions, Commissioners? Thank you. Commissioners, any discussion? If
not, I’ll accept a motion.
MOSES: I move that a favorable recommendation be forwarded to the County Council on the
application for a Change of Zone REZ 14-000180, based on the Planning Director’s
Recommendation and proposed conditions.
IKEDA: Second.
MIYASATO: Motion by Commissioner Moses, seconded by Commissioner Ikeda. Any
discussion on the motion? You can call the roll.
DARROW: Thank you, Mr. Chairman, with that we’ll take the roll call. Commissioner Moses?
