LEEWARD PLANNING COMMISSION
COUNTY OF HAWAI‘I
NOTICE IS HEREBY GIVEN of the following matters to be considered by the Leeward Planning
Commission of the County of Hawai‘i in accordance with the provisions of Chapters 91 and 92, Hawai‘i
Revised Statutes, Section 6-7.5(a) of the Charter of the County of Hawai‘i, and the Commission’s Rules
of Practice and Procedure.

STATEMENTS FROM THE PUBLIC – Note that statements from the public regarding any
particular item on this agenda will be taken at the time the particular item is called to order.
NEW BUSINESS – 9:30 a.m.
1. APPLICANT: CLEMENS CLASSEN (SPP 15-180)
Application for a Special Permit to establish a 3-bedroom bed and breakfast operation within an
existing 5-bedroom dwelling on approximately 20.97 acres of land situated within the State Land Use
Agricultural District. The property is located east (mauka) of Hawai‘i Belt Road at the 100 mile
marker approximately 1.1 miles south of the intersection of Ho‘okena Beach Road and Hawai‘i Belt
Road in Waiea ahupua‘a, South Kona, Hawai‘i, TMK: 8-6-001:013.
2. INITIATOR: PLANNING DIRECTOR (SMA 10-039)
Revocation of Special Management Area Use (SMA) Permit No. 10-000039 originally issued to
Kawaihae Restaurant, LLC by the Planning Commission on May 3, 2010, to allow the establishment
of a restaurant and commercial/recreational uses, facilities and activities consistent with the
(Industrial- Commercial Mixed) MCX zoning on 1.32 acres in the Special Management Area. The
property is located along the ocean (makai) side of Akoni Pule Highway just north of Kawaihae
Harbor, South Kohala, Hawai‘i, TMK: 6-1-003:015.
3. APPLICANT: ALII BEACH ESTATES III CONDOMINIUM LOT OWNERS (SMA 314)
Amendment to Condition No. 3 (time to complete construction of three remaining dwellings) of
Special Management Area Use Permit No. 314, which allowed the construction of six single-family
residential units and related improvements within the Special Management Area (SMA). The
property is located approximately 450 feet southeast (Keauhou side) of Kahakai Elementary School,

4. APPLICANT: RT’S SERVICE, LLC (Amend SPP 1247)
Request to amend Special Permit No. 1247 by deleting Condition 2 (life of the permit), Condition 6
(increasing days and hours of operation), and increasing the number of stored vehicles. Special
Permit No. 1247 was issued in 2004 to allow office and storage uses for investigative/collection
services, a towing service, and short term parking for repossessed or disabled vehicles on
approximately 14,273 square feet of land in the State Land Use Agricultural District. The property is

located along the west side of Kauakea Road, approximately 400 feet north of the Kauakea Road-
Māmalahoa Highway (Highway 19) intersection, and abutting the Nani Waimea Subdivision,
Pu‘ukapu Homesteads, South Kohala, Hawai‘i, TMK: 6-4-017: Portion of 064.

5. APPLICANT:CHARLES E. LIPPS, JR. AND JANET S. LIPPS TRUST (REZ 15-187)
Continued hearing on the application for a Change of Zone from an Agricultural-3 acre (A-3a) to a
Family Agricultural-1 acre (FA-1a) zoning district for approximately 3.039 acres of land. The
property is located on Hiona Street, approximately 1,000 feet west of its intersection with Māmalahoa

6. INITIATOR: PLANNING DIRECTOR (GPA-14-002)
An amendment to Map 14 of the Land Use Pattern Allocation Guide (LUPAG) Map of the County of
Hawai‛i General Plan (adopted by Ordinance No. 05-025, amended by Ordinance Nos. 06-153 and
14-087) by changing the land use designation for portions of Kea‛au Village and immediately
surrounding area as follows:

A-1: Low Density UrbanMedium DensityUrban encompassing a contiguous area of
approximately 475 acres from approximately 0.3 miles northwest (makai) of the intersection of
Kea‛au-Pāhoa Bypass Road and Highway 11 (Volcano Highway) to and including the area in the
vicinity of Ulupono and Milo Streets, extending south of Kukula Street and then in a westerly
direction to the boundary of the Kea‛au Ag Lots Subdivision to the Highway 11-Old Volcano
Highway intersection along the Old Volcano Highway leading to the Village core.

of approximately 112 acres from Kukula Street-Kea‛au Bypass Road intersection south to the
Kea‛au Bypass Road-Kea‛au Pāhoa Road intersection, and then approximately to the northeastern

The purpose of the public hearing is to afford all interested persons a reasonable opportunity to be
heard on the above matter.
Submitting Testimony: According to Rule 1 (General Rules) of the Planning Commission, a
person desiring to submit oral or written testimony shall indicate her/his name; address; and whether the
testimony is on her/his behalf or as a representative of an organization or individual. If testimony is being
submitted on behalf of an organization, documentation showing membership ratification should
accompany the testimony. Written testimony shall be submitted with an original and fifteen copies prior
to testifying. The Commission would appreciate timely submittal to the Planning Department at least one

week prior to the hearing date to allow for mailing and thorough Commission review. Testimony that is
irrelevant or unduly repetitious may be limited by the Chairperson pursuant to Rule 1.
Pursuant to Rule 4, Contested Case Procedure, of the County of Hawai‘i Planning Commission
Rules of Practice and Procedure, any person seeking to intervene as a party to a contested case hearing on
Agenda Item Nos. 1, 3 and 4 above is required to file a written request which must be received in the
office of the Planning Department no later than seven (7) calendar days prior to the Planning
Commission’s first public meeting on the matter. Such written request shall be in conformity with Rule
4, in a form as provided by the Planning Department entitled “Petition for Standing in a Contested Case
Hearing.” The written petition/request shall be filed with the Planning Commission at Aupuni Center,
101 Pauahi Street, Suite 3, Hilo, Hawai‘i 96720, and accompanied by a filing fee of $200 payable to the
Director of Finance. Any party may retain counsel if that person so desires. Rule 4 may be inspected or
purchased ($2.50) at the above-cited location. Rule 4 may also be viewed at the County of Hawai‘i
website (http://www.co.Hawaii.hi.us).
Notice to Lobbyists: If you are a lobbyist, you must register with the Hawai‘i County Clerk
within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawai‘i County Code}. A
lobbyist means “any individual engaged for pay or other consideration who spends more than five hours
in any month or $275 in any six-month period for the purpose of attempting to influence legislative or
administrative action by communicating or urging others to communicate with public officials.” {Article
15, Section 2-91.3(a)(6), Hawai‘i County Code} Registration forms and expenditure report documents
are available at the Office of the County Clerk, 25 Aupuni Street, Room 1402, Hilo, Hawai‘i 96720.
Copies of the applications are on file and open to inspection during office hours at the Planning
Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawai‘i and at the Kona office of the
Planning Department, West Hawai‘i Civic Center, 74-5044 Ane Keohokālole Highway, Kailua-Kona,
Hawai‘i.
Anyone who requires an auxiliary aid or service, other reasonable modification, or language
interpretation to access this meeting please contact the Planning Department at 961-8288 as soon as
possible, but no later than five working days prior to the meeting date, to arrange for accommodations.
“Other reasonable modification” refers to communication methods or devices for people with disabilities
who are mentally and/or physically challenged.
