HomeMy WebLinkAbout2015-04-24 Police Commission Regular Minutes HAWAI‘I POLICE COMMISSION REGULAR SESSION MINUTES APRIL 24, 2015 AUPUNI CENTER CONFERENCE RM., 101 PAUAHI ST., HILO, HI CALL TO ORDER Chair Schutte called the meeting to order at 11:14 a.m. when a quorum was present. ROLL CALL Present: Guy K. Schutte, Chair John M. Bertsch, Vice Chair Peter L. Hendricks, Commissioner Peggy K. Hilton, Commissioner Keith T. Morioka, Commissioner Also present: Kenneth Bugado, Captain Belinda Castillo Hall, Deputy Corporation Counsel Josie Pelayo, Secretary APPROVAL OF AGENDA Vice Chair Bertsch motioned to approve the agenda. Commissioner Hendricks seconded, and it carried unanimously. STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS (None) APPROVAL OF MINUTES Commissioner Morioka motioned to approve the minutes of March 20, 2015, regular and executive sessions. Vice Chair Bertsch seconded, and it carried unanimously. POLICE CHIEF’S REPORT ON DEPARTMENTAL ACTIVITIES All reports were deferred to the next meeting. EXECUTIVE SESSION Commissioner Bertsch motioned to meet in executive session to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities; to consider discipline and charges against officers or employees of the Hawai‘i Police Department, to consider sensitive matters relating to public safety; and to conduct an annual evaluation of Police Chief Kubojiri pursuant to HRS 92-5 (a) (2) (4) (6) and the Hawai‘i County Charter Section 13-20 (b). Commissioner Morioka seconded, and it carried unanimously. Executive session convened at 11:21 a.m. Regular session reconvened at 1:11 p.m. Hawai‘i Police Commission Regular Session Minutes April 24, 2015 Page 2 ACTION ON EXECUTIVE SESSION MATTERS Investigation of Complaints Complaint HPC 15-01: Complainant alleged that an officer extorted money from him after a vehicle accident. Vice Chair Bertsch motioned that there was insufficient evidence to prove the complainant’s allegations of misconduct. Commissioner Hendricks seconded, and it carried unanimously. Complaint HPC 15-02: Complainant alleged that an officer threw him to the ground with such force that his teeth came out. Commissioner Morioka motioned that there was insufficient evidence to prove the complainant’s allegations of misconduct. Commissioner Hendricks seconded, and it carried unanimously. Complaint HPC 15-04: Complainant alleged that an officer was unprofessional during a traffic stop. Commissioner Hendricks motioned that there was insufficient evidence to prove the complainant’s allegations of misconduct. Commissioner Hilton seconded, and it carried unanimously. Complaint HPC 15-05: Complainant alleged that the officer should have used his discretion and not cited him for parking in a prohibited area. Vice Chair Bertsch motioned that there was insufficient evidence to prove the complainant’s allegations of misconduct. Commissioner Hilton seconded, and it carried unanimously. Evaluation of Police Chief Harry Kubojiri: Vice Chair Bertsch motioned to table this to the next meeting. Commissioner Morioka seconded, and it carried unanimously. ANNOUNCEMENTS Chair Schutte announced that the Police Commission’s next monthly meeting will be on Friday, May 15, 2015, at 9:00 a.m., in the West Hawai‘i Civic Center, 74-5044 Ane Keohokalole Hwy., Kailua-Kona, HI.
