In your experience, how prevalent is the issue of squatting and adverse possession? This is an ever growing concern for property owners on the island of Hawaii. Many lots are owned by absentee owners be it vacant land or a vacation house. 2. In what communities and districts do squatting and adverse possession appear most prominent? Puna, Hilo and Kailua-Kona 3. When you receive notice or a complaint about these situations, what is your normal course of action? Police with an 86 Notice 4. What kinds of complications have arisen in the past that have prevented a successful resolution of the situation? Aggressive, persistent, obnoxious behavior some times resulting in property damage. 5. For those situations that have been successfully resolved, please describe what happened. Pleading to common sense and reasoning and the chance to avoid escalating the situation to require police action seems to work on those that are taking their meds...for those not, it seems hopeless. 6. What happens when you contact or try to contact the owner of record? Usual comment is "What can I do?!?" 7. What solutions would you recommend? Change the the law to a felony status and make sure the courts enforce the sentencing. Once word gets out that it is no more mister nice guy, things will start to change. 8. Are there any other comments you would like to make?
