Thank you for taking the time to answer these questions.
1. In your experience, how prevalent is the issue of squatting and adverse possession?
In Kona District, I have not heard of any instances of squatters in the past year or two.
There used to be quite a few bank foreclosures at one time with squatters taking
advantage of empty houses, but not in recent memory.
2. In what communities and districts do squatting and adverse possession appear most
prominent?
Unknown
3. When you receive notice or a complaint about these situations, what is your normal
course of action?
On duty patrol officer would be assigned to meet with the reporting party and to see if
ownership of property can be established. If owner is unknown, there is not much that
can be done at that time to remove the alleged squatter. If owner of property is known
and clearly established, officer may stand by while property owner asks the squatter to
leave.
4. What kinds of complications have arisen in the past that have prevented a successful
resolution of the situation?
Not aware of complications other than mentioned above regarding establishing ownership
of property.
5. For those situations that have been successfully resolved, please describe what happened.
Squatter left without incident; property owner satisfied.
