1. In your experience, how prevalent is the issue of squatting and adverse possession?
In my experience the issue of squatting has always been prevalent more so in the puna/Mt
View areas. Regarding adverse possession, no issues.
2. In what communities and districts do squatting and adverse possession appear most
prominent?
Puna, Mt. View, HOVE
3. When you receive notice or a complaint about these situations, what is your normal
course of action?
DOH's course of action is to first find out if the squatting complaint is resulting in issues
that concerns DOH. For DOH Sanitation, the main concern is exposed human feces,
Wastewater's concern is an approved waste water system (cesspool or septic), and Vector
Control concerns are rodents, flies, and mosquitos. If these issues are identified then an
inspector conducts a field inspection and all issues are the responsiblity of the land owner.
4. What kinds of complications have arisen in the past that have prevented a successful
resolution of the situation?
Complications that arise are; no access/ persmission to property, property owner is not
able to be contacted via phone or mail, underlying issue of a squatting complaint is
neighbor fueding.
5. For those situations that have been successfully resolved, please describe what happened.
Land owner, squatter, hired help mitigates DOH's requests.
6. What happens when you contact or try to contact the owner of record?
Owner is educated of pertenant Hawaii regulations and notified of required action to
mitigate complaint.
7. What solutions would you recommend?
Owner needs to be held accountable for their responsibilities as a property owner.
