1. In your experience, how prevalent is the issue of squatting and adverse possession?
We don't really have an issue with adverse possession of our facilities because most of
them are well maintained and occupied. Squatting may be an issue because of homeless
individuals who take up residence in areas of the small boat harbor facilities such as
Waianae harbor and Kailua Pier
2. In what communities and districts do squatting and adverse possession appear most
prominent?
Hawaii - Kona District, Oahu - Waianae District
3. When you receive notice or a complaint about these situations, what is your normal
course of action?
When we receive notice of individuals loitering or sleeping/camping on our facilities we
inform DOCARE officers who investigate the complaint.
4. What kinds of complications have arisen in the past that have prevented a successful
resolution of the situation?
We have not been able to prevail in court on our citations for sleeping/camping because a
judge found our rule to be too broad/vague and therefore unconstitutional since camping
was not
5. For those situations that have been successfully resolved, please describe what happened.
6. What happens when you contact or try to contact the owner of record?
We do not have this issue because we are the owner of record.
7. What solutions would you recommend?
We think that for state lands and public facilities, posting clear signage and closing public
areas in the evenings etc. help to prevent squatting. Maintaining a regular presence in any
areas helps to dissuade squatters.
8. Are there any other comments you would like to make?
We are not sure that the scope of this survey actually applies to us because we
have a lot of issues with loitering and people sleeping/camping on our property but
not as it relates specifically to long term squatting or adverse possession. We hope
these comments have been helpful.
