HomeMy WebLinkAboutMichael Donaldson.pdfName of agency/organization: Contact person/phone/email: Michael Donaldson Thank you for taking the time to answer these questions. 1. In your experience, how prevalent is the issue of squatting and adverse possession? Squatting has become very common in most neighborhoods throughout Puna. They are impossible to get rid of and are stealing real estate. This is not "adverse possession" with the caveat to improve property; the squatters on my street have managed to nearly destroy a property in just a manner of a few months. They have had arrests for car theft, have parades of people and cars throughout the night (drugs), hungry children are left alone all day and aggressive dogs not restrained. Increased incidents of miscellaneous thefts are occurring with regularity. Our quiet, one lane street is no longer safe. 2. In what communities and districts do squatting and adverse possession appear most prominent? Keaau, Kurtistown, Mountain View. 3. When you receive notice or a complaint about these situations, what is your normal course of action? I call the police, who have evicted the squatters on my street several times. They just keep coming back. 4. What kinds of complications have arisen in the past that have prevented a successful resolution of the situation? 5. For those situations that have been successfully resolved, please describe what happened. 6. What happens when you contact or try to contact the owner of record? The realtor handling the listing has been locked out and is afraid to return. 7. What solutions would you recommend? Pass legislation immediately to stop this infestation. It is out of control! "Adverse possession" should be regulated with an application process and thorough vetting of candidates. 8. Are there any other comments you would like to make? These people are affecting the quality of life on my street and reducing the value of my home. As a tax payer I demand action.
