1. In your experience, how prevalent is the issue of squatting and adverse possession?
I personally dealt with the problem and puna police is of NO help ! they say its a civil
matter even though im the only one holding documents. when you go to the courts and
win theyre eviction, if they don't leave, you cant just drag them off, you got to hire the
sheriffs department and you looking at tens of thousands of dollars. my own brother has
been doing it for over (5) years .the owner cant afford to do anything .
2. In what communities and districts do squatting and adverse possession appear most
prominent?
all over puna ! nanawale, Hawaiian beaches, paradice park .
3. When you receive notice or a complaint about these situations, what is your normal
course of action?
pray and come up with a solution . like I gave Mr Ilagan today .
4. What kinds of complications have arisen in the past that have prevented a successful
resolution of the situation?
h p d doesn't have access to proper records to confirm who belongs at the property or not .
5. For those situations that have been successfully resolved, please describe what happened.
none that im aware of . a friend of mine won evection by judge Takase over (2) years ago
and at last conversation was still trying to get her to leave .
6. What happens when you contact or try to contact the owner of record?
owners are helpless because they cant afford court and sheriff fees .
7. What solutions would you recommend?
sealed stamped deed provided to home owners when they pay property tax . to illuminate
deed fraud. something h p d can easily look for when faced with a situation where
someone claim to be the owner . provide homeowner renters a lease format with also a
sealed stamp, one that the landlord needs to have every adult tenant notarized. if when the
cops show up the alleged tenant cant provide that sealed stamped lease with an i.d to
match the name on the notarized lease, theyre out ! ! ! I spoke with Mr Ilagan today about
this possible solution .
8. Are there any other comments you would like to make?
ladies and gentleman in council, officers of the law, please put yourself in the
home owners shoes and see how it feels . you are not exempt. this is a epidemic
and the owners are not all banks . also electric company,water company etc, you
all know how to demand a lease if you feel someone at the residents has a prior
unpaid bill .you should be asking this to everyone. connecting utilities to a
residence without the OWNERS consent puts YOU responsible for any damage
caused due to the water or power hooked up . so when we ask you to TURN IT
OFF you should immediately.you refuse cause the income is more important . put
yourself in theyre shoes .
