LEEWARD PLANNING COMMISSION
COUNTY OF HAWAI‘I
MINUTES
JULY 16, 2015
The Leeward Planning Commission met in regular session at 9:32 a.m. in the West Hawai‘i Civic
Center, Community Center, Building G, 74-5044 Ane Keohokālole Highway, Kailua-Kona,
Hawai‘i, with Chairman Brandi Beaudet presiding.
COMMISSIONERS PRESENT: Brandi Beaudet, Scott Church, Collin Kaholo, Barbara Nobriga,
Keith Unger, Sonny Shimaoka (until 10:20 a.m.) and Thomas Whittemore (until 10:20 a.m.)
ALSO PRESENT: Danny Patel (Counsel for the Commission), Duane Kanuha (Planning
Director), Daryn Arai (Planning Program Manager), Jeff Darrow (Planner), Maija Jackson
(Planner) and Noriko Sauer (Commission Secretary)
And six people from the public in attendance.
A quorum was present. Chair Beaudet called the meeting to order, and introduced the
Commissioners and staff to members of the public.
STATEMENTS FROM THE PUBLIC – No statements were presented under this section of the
agenda.
NEW BUSINESS
1.APPLICANT: CLEMENS CLASSEN (SPP 15-180)
Application for a Special Permit to establish a 3-bedroom bed and breakfast operation within
an existing 5-bedroom dwelling on approximately 20.97 acres of land situated within the State
Land Use Agricultural District. The property is located east (mauka) of Hawai‘i Belt Road at
the 100 mile marker approximately 1.1 miles south of the intersection of Ho‘okena Beach
Road and Hawai‘i Belt Road in Waiea ahupua‘a, South Kona, Hawai‘i, TMK: 8-6-001:013.
The Commission took up this item at 9:33 a.m. with approximately eleven people from the public
in attendance.

2.INITIATOR: PLANNING DIRECTOR (SMA 10-039)
Revocation of Special Management Area Use (SMA) Permit No. 10-000039 originally issued
to Kawaihae Restaurant, LLC by the Planning Commission on May 3, 2010, to allow the
establishment of a restaurant and commercial/recreational uses, facilities and activities
consistent with the (Industrial- Commercial Mixed) MCX zoning on 1.32 acres in the Special
Management Area. The property is located along the ocean (makai) side of Akoni Pule
Highway just north of Kawaihae Harbor, South Kohala, Hawai‘i, TMK: 6-1-003:015.

3.APPLICANT: ALII BEACH ESTATES III CONDOMINIUM LOT OWNERS (SMA 314)
Amendment to Condition No. 3 (time to complete construction of three remaining dwellings)
of Special Management Area Use Permit No. 314, which allowed the construction of six
single-family residential units and related improvements within the Special Management Area
(SMA). The property is located approximately 450 feet southeast (Keauhou side) of Kahakai
stnd
Elementary School, Hōlualoa 1 and 2, North Kona, Hawai‘i, TMK: 7-6-17: 006.
The Commission took up this item at 9:48 a.m. with approximately 16 people from the public in
attendance.

RECESSED The Chair called a recess at 10:20 a.m. \[At this time Commissioners
Shimaoka and Whittemore left the meeting.\]
RECONVENED The meeting reconvened at 10:35 a.m.
4.APPLICANT: RT’S SERVICE, LLC (Amend SPP 1247)
Request to amend Special Permit No. 1247 by deleting Condition 2 (life of the permit),
Condition 6 (increasing days and hours of operation), and increasing the number of stored
vehicles. Special Permit No. 1247 was issued in 2004 to allow office and storage uses for
investigative/collection services, a towing service, and short term parking for repossessed or
disabled vehicles on approximately 14,273 square feet of land in the State Land Use
Agricultural District. The property is located along the west side of Kauakea Road,
approximately 400 feet north of the Kauakea Road-Māmalahoa Highway (Highway 19)
intersection, and abutting the Nani Waimea Subdivision, Pu‘ukapu Homesteads, South
Kohala, Hawai‘i, TMK: 6-4-017: Portion of 064.
The Commission took up this item at 10:35 a.m. with approximately 17 people from the public in
attendance.
Ms. Jackson said that in response to the Planning Department’s recommendation to deny this
amendment request, the applicant requested to defer the hearing or, in the alternative, to
implement contested case procedures, as the recommendation is adverse to the applicant. Copies
of the request had been distributed to the Commissioners. She informed the Commission that the
Planning Department was agreeable to postponement. Chair Beaudet granted the request to defer
the hearing, noting that the applicant’s request was for 90 days.
There was no one from the public wishing to testify regarding this agenda item.

UNFINISHED BUSINESS
5.APPLICANT:CHARLES E. LIPPS, JR. AND JANET S. LIPPS TRUST (REZ 15-187)
Continued hearing on the application for a Change of Zone from an Agricultural-3 acre (A-3a)
to a Family Agricultural-1 acre (FA-1a) zoning district for approximately 3.039 acres of
land. The property is located on Hiona Street, approximately 1,000 feet west of its intersection

with Māmalahoa Highway, Keopu 3, North Kona, Hawai‘i, TMK: 7-5-024:078.
The Commission took up this item at 10:37 a.m. with approximately twelve people from the
public in attendance.

NEW BUSINESS
6.INITIATOR: PLANNING DIRECTOR (GPA-14-002)
An amendment to Map 14 of the Land Use Pattern Allocation Guide (LUPAG) Map of the
County of Hawai‛i General Plan (adopted by Ordinance No. 05-025, amended by Ordinance
Nos. 06-153 and 14-087) by changing the land use designation for portions of Kea‘au Village
and immediately surrounding area as follows:
Low Density Urban to Medium Density Urban
A-1: encompassing a contiguous area of
approximately 475 acres from approximately 0.3 miles northwest (makai) of the
intersection of Kea‘au-Pāhoa Bypass Road and Highway 11 (Volcano Highway) to and
including the area in the vicinity of Ulupono and Milo Streets, extending south of Kukula
Street and then in a westerly direction to the boundary of the Kea‘au Ag Lots Subdivision
to the Highway 11-Old Volcano Highway intersection along the Old Volcano Highway
leading to the Village core.
Important Agricultural Land to Medium Density Urban
A-2: encompassing the
triangular area of approximately 112 acres from Kukula Street-Kea‘au Bypass Road
intersection south to the Kea‘au Bypass Road-Kea‘au Pāhoa Road intersection, and then
approximately to the northeastern corner of the Kea‘au Ag Lots Subdivision.
The Commission took up this item at 10:54 a.m. with six people from the public in attendance.

MINUTES
June 18, 2015 meeting – The Commission approved the minutes as submitted during the hearing
on Agenda Item No. 5 (SEE EXHIBIT D). \[The motion was made by Commissioner Church,
seconded by Commissioner Nobriga, and unanimously carried by a voice vote of all
Commissioners present.\]
ADMINISTRATIVE MATTERS – The Commission took up the following matters at 11:09 a.m.
with five people from the public in attendance.

1.Status of applications heard by Leeward Planning Commission that are pending before
County Council. – No report was made.
ANNOUNCEMENTS – Mr. Arai announced that the next meeting was scheduled for August 20,
2015, with tentatively two items on the agenda.
ADJOURNMENT – There being no further business, the Chair declared the meeting adjourned at
11:11 a.m.
