HomeMy WebLinkAbout2015-09-03 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES SEPTEMBER 3, 2015 The Windward Planning Commission met in regular session at 9:00 a.m. in the County of Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman Myles Miyasato presiding. COMMISSIONERS PRESENT: Myles Miyasato, Donn Dela Cruz, Gregory Henkel, Donald Ikeda, and Raylene Moses. ABSENT & EXCUSED: Charles Heaukulani. ALSO PRESENT: Duane Kanuha (Planning Director), Danny Patel (Deputy Corporation Counsel for the Windward Planning Commission), Daryn Arai (Planning Program Manager), Jeff Darrow (Staff Planner), Christian Kay (Staff Planner), and Sarah Hata-Finley (Commission Secretary). A quorum was present. Chairman Miyasato introduced Windward Planning Commissioners and staff to members of the public, and went over the procedures for public testimony. Chairman Miyasato announced that Item Nos. 3 and 4 on the agenda have been continued at the request of the applicant \[David and Laura Rodrigues\]. STATEMENTS FROM THE PUBLIC – No statements were presented under this section of the agenda. 1.APPLICANTS: MARK AND KIM RODRIGUES (REZ 15-190) Application for a Change of Zone from an Agricultural-20 acres (A-20a) to a Family Agricultural-3 acres (FA-3a) zoning district for approximately 25 acres of land situated along the east (makai) side of Lyman Springs Road, and also bordering along the north side of Kaūmana Drive directly across of the Kaūmana Estates Subdivision in Ponahawai, South Hilo, Hawaiʽi, TMK: 2-5-003:024. The Commission took this item up at 9:01 a.m. with 6 people from the public in attendance. (SEE EXHIBIT A) This item ended at 9:12 a.m. 2.APPLICANT:PARADISE PARK BAPTIST CHURCH (SPP 14-163) Request to amend Special Permit No. 14-163 to include an adjoining 1-acre parcel (Parcel th 124) as part of the permit area to accommodate a new access from 24 Avenue that will allow for termination of access to Kaloli Drive as required by Condition No. 3. Special Page 1 of 3 Windward Planning Commission September 3, 2015 Minutes Permit No. 14-163 was approved to allow the establishment of a church and related improvements on approximately one acre of land situated in the State Land Use Agricultural District. The properties are located in Hawaiian Paradise Park Subdivision along the west rdth side of Kaloli Drive between Naupaka Avenue (23) and Ohe Avenue (24), approximately 1 mile from the Kea‘au-Pāhoa Road intersection, Kea‘au, Puna, Hawai‘i, TMK: 1-5-038:123 & 124. The Commission took this item up at 9:12 a.m. with 4 people from the public in attendance. (SEE EXHIBIT B) This item ended at 9:22 a.m. 3.APPLICANT: ARROW OF OREGON/HAWAII, LLC (Amend SPP 09-076) Contested case proceedings regarding the application for an amendment to Special Permit No. 09-076, which was approved to allow a cinder and rock quarry operation on 5.003 acres of land situated within the State Land Use Agricultural District. The amendment will add 8.009 acres for a total of 13.012 acres of land. The properties are located northwest of Mahimahi Drive, between Lurline Lane and Liliana Lane within the Hawaiian Ocean View Estates Subdivision, Kahuku, Ka‘u, Hawai‘i, TMK: 9-2-148:005, 006-010, 015, 016 & 036. 4.APPLICANTS: DAVID AND LAURA RODRIGUES (SPP 15-178) Contested case proceedings regarding the application for a Special Permit to allow a cinder and rock quarry operation on 5.003 acres of land situated within the State Land Use Agricultural District. The properties are located on the northeast and southeast corners of Kailua Boulevard and Lurline Lane, Hawaiian Ocean View Estates Subdivision, Kahuku, Kau, Hawai‘i, TMKs: 9-2-142:020, 021, 022 & 9-2-145:047, 048. At 9:22 a.m., Chairman Miyasato stated that the contested case proceedings for Item Nos. 3 \[Arrow of Oregon/Hawaiʽi, LLC\] and 4 \[David and Laura Rodrigues\] have been continued to September 30th and if necessary to October 1, 2015, after the regularly scheduled meeting, at the request of the applicant \[David and Laura Rodrigues\]. Secretary’s note: The contested case proceedings for Item Nos. 3 and 4 were consolidated by agreement of the parties. MINUTES – The Commission took this item up at 9:22 a.m. Approval of Minutes of the August 6, 2015 meeting – It was moved by Commissioner Moses and seconded by Commissioner Ikeda that the minutes of August 6, 2015, be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE MATTERS/ANNOUNCEMENTS - The Commission took up the following at 9:23 a.m. 1.Status of applications heard by Windward Planning Commission that are pending before County Council. Page 2 of 3 Windward Planning Commission September 3, 2015 Minutes Mr. Arai reiterated that the contested case proceedings for Arrow of Oregon/Hawaiʽi, LLC \[Amend SPP 09-076\] and David and Laura Rodrigues \[SPP 15-178\] have been thst continued to September 30 and, if necessary, October 1 after the regularly scheduled st meeting. He announced that there were tentatively eight items on the October 1 agenda, with the possibility of two items being taken off the agenda. He also added that the November 5th agenda tentatively had nine separate applications scheduled. Mr. Arai stated that the application for Glory Nani Mau \[Amend REZ 792\], which was th heard at the Commission’s meeting on August 6, was not yet scheduled with the County Council’s Planning Committee. Mr. Arai announced, and Mr. Kanuha confirmed, that the matter regarding the Planning Director Initiated amendment to Map 14 of the Land Use Pattern Allocation Guide (LUPAG) Map of the County of Hawaiʽi General Plan passed final reading at the County Council the previous day, September 2, 2015. Upon Commissioner Henkel’s inquiry, Mr. Arai said that there was no update regarding the claim against the Geothermal Asset Fund for a public health study. ADJOURNMENT – There being no further business, it was moved by Commissioner Ikeda and seconded by Commissioner Dela Cruz that the meeting be adjourned. Motion was unanimously carried by a voice vote of all Commissioners in attendance. Chairman Miyasato adjourned the meeting at 9:26 a.m. Respectfully submitted, Sarah Y.
