HomeMy WebLinkAbout2015-12-03 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES DECEMBER 3, 2015 The Windward Planning Commission met in regular session at 9:01 a.m. in the County of Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman Myles Miyasato presiding. COMMISSIONERS PRESENT: Myles Miyasato, Donn Dela Cruz, Gregory Henkel, Donald Ikeda, and Raylene Moses. ABSENT & EXCUSED: Charles Heaukulani. ALSO PRESENT: Duane Kanuha (Planning Director), Danny Patel (Deputy Corporation Counsel for the Windward Planning Commission), Kelly Gomes (representing the Department of Public Works) (from 10:07 a.m. to 10:43 a.m.), Daryn Arai (Planning Program Manager), Jeff Darrow (Staff Planner) (left at 9:18 a.m.), Lucas Mead (Staff Planner), Maija Jackson (Staff Planner), Christian Kay (Staff Planner), and Sarah Hata-Finley (Commission Secretary). A quorum was present. Chairman Miyasato introduced Windward Planning Commissioners and staff to members of the public, and went over the procedures for public testimony. STATEMENTS FROM THE PUBLIC – No statements were presented under this section of the agenda. 1. APPLICANT: MARK FROST (SPP 15-184) Application for a Special Permit to allow the establishment of a five-bedroom bed and breakfast operation within two detached two-bedroom suites and one one-bedroom guest house on a portion of a 6.025-acre property situated within the State Land Use Agricultural District. The property is located at 14-4838 Kapoho Beach Road. It is located the southwest corner at the intersection of Kapoho Beach Road and Ililani Street, Kapoho, Puna, Hawaiʽi, TMK: 1-4-072:001. The Commission took this item up at 9:02 a.m. with 7 people from the public in attendance. (SEE EXHIBIT A) This item ended at 9:15 a.m. 2. APPLICANT: SIDNEY T. MIZUKAMI REVOCABLE LIVING TRUST (SPP 09-96) Amendment to Special Permit No. 09-000096 to allow for a 10-year extension to the life of permit to allow for the continued use of the property and existing agricultural building for the parking, deployment and storing of equipment and materials associated with a telecommunications cable installation business located in the Wainaku Farms Subdivision, Page 1 of 5 Windward Planning Commission December 3, 2015 Minutes approximately 650 feet south of the intersection of Kulana Kea Drive and Kaohu Lehua Place, Wainaku, South Hilo, Hawaiʽi, TMK: 2-6-032:015. At 9:15 a.m., Chairman Miyasato announced that this item had been continued. There was no one from the public who wished to testify on this application. 3.APPLICANT: GTP ACQUISITION PARTNERS II, LLC (USE 15-058) Application for an after-the-fact Use Permit to allow the continued operation of a telecommunication facility, consisting of a 200-foot tall steel guy-wired tower and adjacent 40-foot tall steel guy-wired tower with antennas and related facilities within a 3,580 square- foot portion of a 11,312-acre parcel situated in the State Land Use Agricultural district and the County’s Agricultural 20-acre (A-20a) zoning district. The project site is located about 3,550 feet west of South Point Road, approximately 2.3 miles south of the Kamāʽoa Road – South Point Road intersection, Pākini iki ahupuaa, Kaʽū, Hawaiʽi, TMK: 9-3-001:Por. 006. At 9:15 a.m., Chairman Miyasato announced that this request had been withdrawn. 4.APPLICANT: CCTMO, LLC (USE 15-057) Application for a Use Permit to allow for the construction of a new telecommunication facility, including a 150-foot tall steel lattice tower with 12 panel antennas with remote radio units and microwave dish antennas and related facilities within a 10,000 square-foot portion of a 2-acre parcel situated in the County’s Agricultural 1-acre (A-1a) zoning district. The affected property is situated at the southeast corner of Palm Parkway and Reef Circle Mauka within the Hawaiian Ocean View Estates Subdivision, Kaʽū, Hawaiʽi, TMK: 9-2-062:054. The Commission took this item up at 9:15 a.m. with 6 people from the public in attendance. (SEE EXHIBIT B) This item ended at 9:26 a.m. Chairman Miyasato called a recess at 9:26 a.m., and the meeting was reconvened at 9:31 a.m. 5.APPLICANT: SBA TOWERS III, LLC (Revoke SPP 1225) Revocation of Special Permit No. 1225, issued to VoiceStream PCS II Corporation on October 17, 2003, to allow for the construction of a telecommunication facility consisting of an 100-foot tall steel lattice tower and related facilities within a 10,000 square-foot portion of a 2-acre parcel situated in the County’s Agricultural 1-acre (A-1a) zoning district. The affected property is situated at the southeast corner of Palm Parkway and Reef Circle Mauka within the Hawaiian Ocean View Estates Subdivision, Kaʽū, Hawaiʽi, TMK: 9-2-062:054. At 9:31 a.m., Chairman Miyasato announced that this item had been deferred by request of the Planning Director. Page 2 of 5 Windward Planning Commission December 3, 2015 Minutes Chairman Miyasato called a recess at 9:32 a.m., and the meeting was reconvened at 10:07 a.m. 6.APPLICANT: CELLCO PARTNERSHIP DBA VERIZON WIRELESS (USE 15-055) Continued hearing on the application for a Use Permit to allow the construction of a new telecommunication facility, including a 185-foot tall steel monopole with 8-foot tall panel antennas and related facilities within a 1,600 square-foot portion of a 17.824-acre parcel situated in the County’s Agricultural 5-acre (A-5a) zoning district. The property is located on the south side of Komo Street, across from the Kaʽawale Boulevard–Komo Street junction, ʽŌlaʽa Reservation Lots, Puna, Hawaiʽi, TMK: 1-8-007:Por. 045. The Commission took this item up at 10:07 a.m. with 11 people from the public in attendance. (SEE EXHIBIT C) Chairman Miyasato called a recess at 10:32 a.m., and the meeting was reconvened at 10:36 a.m. This item ended at 10:43 a.m. 7.APPLICANT: ARROW OF OREGON/HAWAIʽI, LLC (Amend SPP 09-076) Continued hearing on the application for an amendment to Special Permit No. 09-076, which was approved to allow a cinder and rock quarry operation on 5.003 acres of land situated within the State Land Use Agricultural District. The amendment will add 8.009 acres for a total of 13.012 acres of land. The properties are located northwest of Mahimahi Drive, between Lurline Lane and Liliana Lane within the Hawaiian Ocean View Estates Subdivision, Kahuku, Kaʽū, Hawaiʽi, TMK: 9-2-148:005, 006-010, 015, 016 & 036. 8.APPLICANTS: DAVID AND LAURA RODRIGUES (SPP 15-178) Continued hearing regarding the application for a Special Permit to allow a cinder and rock quarry operation on 5.003 acres of land situated within the State Land Use Agricultural District. The properties are located on the northeast and southeast corners of Kailua Boulevard and Lurline Lane, Hawaiian Ocean View Estates Subdivision, Kahuku, Kaʽū, Hawaiʽi, TMKs: 9-2-142:020, 021, 022 & 9-2-145:047, 048. At 10:43 a.m., Chairman Miyasato announced that Item Nos. 7 and 8 were continued \[per agreement by the parties to the Commission’s next meeting on January 7, 2016\]. MINUTES – The Commission took this item up at 10:43 a.m. Approval of Minutes of the November 5, 2015 meeting – It was moved by Commissioner Ikeda and seconded by Commissioner Moses that the minutes of November 5, 2015, be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. Page 3 of 5 Windward Planning Commission December 3, 2015 Minutes ADMINISTRATIVE MATTERS/ANNOUNCEMENTS- The Commission took up the following at 10:43 a.m. 1.Status of applications heard by Windward Planning Commission that are pending before County Council. – There was no report. Mr. Arai announced that the Commission’s next meeting will be on January 7, 2016, with seven applications tentatively on the agenda, including the Arrow of Oregon and David and Laura Rodrigues applications (Item Nos. 7 and 8, respectively, referenced above). Mr. Arai added that the complete record, including the record built during the contested case proceeding, was presented to the entire Commission for review and consideration. th Mr. Arai stated that another item tentatively on the January 7 agenda was the Glover Special Permit application \[Jas W. Glover, Ltd. SPP 14-162\] which previously received approval by the Windward Planning Commission. The application was remanded by the State Land Use Commission back to the Commission so that certain evidentiary items could be admitted into the record. 2.Election of Officers for 2016. It was moved by Commissioner Dela Cruz and seconded by Commissioner Moses to nominate Commissioner Heaukulani as Chairman of the Windward Planning Commission for the year 2016. It was then moved by Commissioner Henkel and seconded by Commissioner Moses to close the nomination for Chairman. The nomination motion was unanimously carried by a voice vote of all Commissioners in attendance. It was moved by Commissioner Henkel and seconded by Commissioner Moses to nominate Commissioner Ikeda as Vice-Chairman of the Windward Planning Commission for the year 2016. Commissioner Ikeda declined the nomination. It was moved by Commissioner Moses and seconded by Commissioner Henkel to nominate Commissioner Dela Cruz as Vice-Chairman of the Windward Planning Commission for the year 2016. Commissioner Dela Cruz declined the nomination. It was moved by Commissioner Moses and seconded by Commissioner Dela Cruz to nominate Commissioner Henkel as Vice-Chairman of the Windward Planning Commission for the year 2016. It was then moved by Commissioner Moses and seconded by Commissioner Ikeda to close the nomination for Vice-Chairman. The nomination motion was unanimously carried by a voice vote of all Commissioners in attendance.
