HomeMy WebLinkAbout2016-01-07 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES JANUARY 7, 2016 The Windward Planning Commission met in regular session at 9:00 a.m. in the County of Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Vice-Chairman Gregory Henkel presiding. COMMISSIONERS PRESENT: Gregory Henkel, Donald Ikeda, Myles Miyasato, and Raylene Moses. ABSENT & EXCUSED: Donn Dela Cruz and Charles Heaukulani. ALSO PRESENT: Duane Kanuha (Planning Director), Danny Patel (Deputy Corporation Counsel for the Windward Planning Commission), Kelly Gomes (representing the Department of Public Works, from 9:30 a.m. to 9:52 a.m.), Daryn Arai (Planning Program Manager), Jeff Darrow (Staff Planner), Christian Kay (Staff Planner), and Sarah Hata-Finley (Commission Secretary). A quorum was present. Vice-Chairman Henkel introduced Windward Planning Commissioners and staff to members of the public, and went over the procedures for public testimony. STATEMENTS FROM THE PUBLIC – No statements were presented under this section of the agenda. 1.APPLICANT: SIDNEY T. MIZUKAMI REVOCABLE LIVING TRUST (SPP 09-96) Amendment to Special Permit No. 09-000096 to allow for a 10-year extension to the life of permit to allow for the continued use of the property and existing agricultural building for the parking, deployment and storing of equipment and materials associated with a telecommunications cable installation business located in the Wainaku Farms Subdivision, approximately 650 feet south of the intersection of Kulana Kea Drive and Kaohu Lehua Place, Wainaku, South Hilo, Hawaiʽi, : 2-6-032:015. TMK The Commission took this item up at 9:01 a.m. with 6 people from the public in attendance. (SEE EXHIBIT A) This item ended at 9:11 a.m. 2.APPLICANT: MILO STREET VENTURES INC. (SLU-15-045/REZ-15-197) Applications for a State Land Use Boundary Amendment from the Agricultural to the Urban District and a Change of Zone from an Agricultural-20 acres (A-20a) to a Limited Industrial- 20,000 square feet (ML-20) zoning district for approximately 2.082 acres of land. The property is located at 16-685 Milo Street, which is on the south side of Milo Street Page 1 of 3 Windward Planning Commission January 7, 2016 Minutes approximately 400 feet east of the Kea‘au Bypass Road and Milo Street intersection, Keaʻau, Puna, Hawaiʻi, TMK: 1-6-152:020. The Commission took this item up at 9:12 a.m. with 7 people from the public in attendance. Chairman Pro Tem Henkel called a recess at 9:12 a.m., and the meeting was reconvened at 9:16 a.m. (SEE EXHIBIT B) This item ended at 9:17 a.m. Chairman Pro Tem Henkel called a recess at 9:17 a.m., and the meeting was reconvened at 9:30 a.m. 3.APPLICANT: ARROW OF OREGON/HAWAII, LLC (Amend SPP 09-076) Continued hearing on the application for an amendment to Special Permit No. 09-076, which was approved to allow a cinder and rock quarry operation on 5.003 acres of land situated within the State Land Use Agricultural District. The amendment will add 8.009 acres for a total of 13.012 acres of land. The properties are located northwest of Mahimahi Drive, between Lurline Lane and Liliana Lane within the Hawaiian Ocean View Estates Subdivision, Kahuku, Ka‘ū, Hawai‘i, TMK: 9-2-148:005, 006-010, 015, 016 & 036. 4.APPLICANTS: DAVID AND LAURA RODRIGUES (SPP 15-178) Continued hearing regarding the application for a Special Permit to allow a cinder and rock quarry operation on 5.003 acres of land situated within the State Land Use Agricultural District. The properties are located on the northeast and southeast corners of Kailua Boulevard and Lurline Lane, Hawaiian Ocean View Estates Subdivision, Kahuku, Ka‘ū, Hawai‘i, TMKs: 9-2-142:020, 021, 022 & 9-2-145:047, 048. The Commission took Item Nos. 3 and 4 (consolidated) up at 9:30 a.m. with 14 people from the public in attendance. Chairman Pro Tem Henkel called a recess at 9:31 a.m., and the meeting was reconvened at 9:34 a.m. At 9:52 a.m., it was moved by Commissioner Miyasato and seconded by Commissioner Ikeda that the Commission go into executive session to consult with its attorney regarding questions and issues pertaining to the Commission’s powers, duties, privileges, immunities, and liabilities, pursuant to Hawai‘i Revised Statutes Sections 92-5(a)(4). A voice vote was taken of all Commissioners present, and motion carried with four aye votes. At 9:54 a.m., the Commission went into executive session. At 10:10 a.m., it was moved by Commissioner Miyasato and seconded by Commissioner Ikeda that the Commission go out of executive session. A voice vote was taken of all Commissioners present, and motion carried with four aye votes. Page 2 of 3 Windward Planning Commission January 7, 2016 Minutes The hearing reconvened for regular session at 10:11 a.m. Chairman Pro Tem Henkel called a recess at 10:30 a.m., and the meeting was reconvened at 10:48 a.m. (SEE EXHIBIT C) This item ended at 10:54 a.m. MINUTES – The Commission took this item up at 10:54 a.m. Approval of Minutes of the December 3, 2015 meeting – It was moved by Commissioner Miyasato, and seconded by Commissioner Ikeda, that the minutes of December 3, 2015, be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE MATTERS/ANNOUNCEMENTS - The Commission took up the following at 10:54 a.m. 1.Status of applications heard by Windward Planning Commission that are pending before County Council. – There was no report. Mr. Arai stated that the next Commission meeting will be on February 4, 2016, and that there were tentatively three items on the agenda as well as the continuances of the Arrow and Rodrigues applications \[Item Nos. 3 and 4 referenced above\]. ADJOURNMENT – There being no further business, it was moved by Commissioner Miyasato and seconded by Commissioner Ikeda that the meeting be adjourned.
