WINDWARD PLANNING COMMISSION
COUNTY OF HAWAI‘I
MINUTES
FEBRUARY 4, 2016
The Windward Planning Commission met in regular session at 9:03 a.m. in the County of
Hawai‘i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai‘i, with Chairman
Charles Heaukulani presiding.
COMMISSIONERS PRESENT: Charles Heaukulani, Donn Dela Cruz (to 9:53 a.m.), Gregory
Henkel, Donald Ikeda, Myles Miyasato, and Raylene Moses.
ALSO PRESENT: Duane Kanuha (Planning Director), Danny Patel (Deputy Corporation
Counsel for the Windward Planning Commission), Daryn Arai (Planning Program Manager),
Jeff Darrow (Staff Planner), Christian Kay (Staff Planner) (to 9:53 a.m.), and Sarah Hata-Finley
(Commission Secretary).
A quorum was present. Chairman Heaukulani introduced Windward Planning Commissioners
and staff to members of the public, and went over the procedures for public testimony.
STATEMENTS FROM THE PUBLIC – No statements were presented under this section of the
agenda.
Addition of Approval of Minutes for the January 29, 2016 Site Inspection to the Agenda
At 9:05 a.m., it was moved by Commissioner Miyasato, and seconded by Commissioner Ikeda
that the Approval of the Site Inspection Minutes of January 29, 2016, regarding the Arrow of
Oregon/Hawaiʽi, LLC (Amend SPP 09-076) and David and Laura Rodrigues (SPP 15-178)
applications be added to the Windward Planning Commission’s February 4, 2016 agenda. The
motion was unanimously carried by a voice vote of all Commissioners in attendance.
1.APPLICANTS: RICK AND JUSTIN PORTER (SPP 15-186)
Application for a Special Permit to convert a portion of an existing single family dwelling
into an approximately 500-square foot certified kitchen to accommodate the manufacture and
distribution of salsa. The 20,000-square foot property is situated within the State Land Use
Agricultural District and located along the east side of Amepela Road, approximately 110
feet south of its intersection with Lewa Lani Street in the Mark Twain Estates Subdivision in
Papohaku, Ka‘ū, Hawaiʽi, TMK: 9-4-007:003.

2.APPLICANT: WATANABE FAMILY TRUST (REZ 15-198)
Application for a Change of Zone from an Agricultural-3 acres (A-3a) to a Residential and
Agricultural-1 acre (RA-1a) zoning district for 2.73 acres of land. The property is located
along the south side of Lama Street, approximately 500 feet west of the Railroad Avenue –
Lama Street intersection in the Pana‘ewa House Lots, Waiākea, South Hilo, Hawai‘i,
TMK: 2-2-051:003.
The Commission took this item up at 9:14 a.m. with 13 people from the public in attendance.

3.INITIATOR: COUNTY COUNCIL INITIATED (Bill No. 102 Re: REZ 07-073)
A Bill amending Ordinance No. 10-110 (Applicant: Jin Soo and Ran Hui Iida), which
amended Ordinance No. 08-39, which originally reclassified lands from Single Family
Residential-10,000 square feet (RS-10) to Neighborhood Commercial-20,000 square feet
(CN-20) zoning district for 23,559 square feet of land. Bill No. 102 proposes the amendment
of Ordinance No. 10-110 by extending the deadline to submit required water commitment
payment and complete the proposed commercial development and eliminate various required
improvements to the Kīlauea Street frontage of the subject property which is located along
the west side of Kīlauea Avenue, approximately 420 feet south of the Kīlauea Avenue-
Puainako Street intersection at Waiākea, South Hilo, Hawaiʽi, TMK: 2-2-004:121.
At 9:27 a.m., Chairman Heaukulani announced that this item has been continued per request by
the Planning Director.
4.INITIATOR: PLANNING DIRECTOR
Designation of “redevelopment area” for that area encompassing properties along Banyan
Drive, Lihiwai Street and Kamehameha Avenue located within the Waiākea District of the
City of Hilo in accordance with Section 53-1, Hawaiʽi Revised Statutes regarding the
Hawaiʽi Redevelopment Agency as administered by the County of Hawaiʽi Planning
Department pursuant to Section 16-10 of the Hawaiʽi County Charter. Should this proposed
redevelopment area be so designated by the Windward Planning Commission, the Planning
Department may then undertake and carry out a redevelopment project(s) within all or any
part of these redevelopment areas that may include the planning, development, replanning,
redesign, clearance, reconstruction or rehabilitation, or any combination of these as deemed
appropriate or necessary in the interest of the general welfare and in accordance with
procedures and authorities set forth in Chapter 53, Part I (Urban Redevelopment Act) and
Part II (Urban Renewal), Hawaiʽi Revised Statutes.

Chairman Heaukulani called a recess at 9:53 a.m., and the meeting was reconvened at
10:03 a.m.
5.APPLICANT: ARROW OF OREGON/HAWAII, LLC (Amend SPP 09-076)
Continued hearing on the application for an amendment to Special Permit No. 09-076, which
was approved to allow a cinder and rock quarry operation on 5.003 acres of land situated
within the State Land Use Agricultural District. The amendment will add 8.009 acres for a
total of 13.012 acres of land. The properties are located northwest of Mahimahi Drive,
between Lurline Lane and Liliana Lane within the Hawaiian Ocean View Estates
Subdivision, Kahuku, Ka‘ū, Hawai‘i, TMK: 9-2-148:005, 006-010, 015, 016 & 036.
6.APPLICANTS: DAVID AND LAURA RODRIGUES (SPP 15-178)
Continued hearing regarding the application for a Special Permit to allow a cinder and rock
quarry operation on 5.003 acres of land situated within the State Land Use Agricultural
District. The properties are located on the northeast and southeast corners of Kailua
Boulevard and Lurline Lane, Hawaiian Ocean View Estates Subdivision, Kahuku, Ka‘ū,
Hawai‘i, TMKs: 9-2-142:020, 021, 022 & 9-2-145:047, 048.
The Commission took this item up at 10:03 a.m. with 8 people from the public in attendance.
At 11:09 a.m., it was moved by Commissioner Henkel and seconded by Commissioner Ikeda
that the Commission go into executive session to consult with its attorney regarding questions
and issues pertaining to the Commission’s powers, duties, privileges, immunities, and liabilities,
pursuant to Hawai‘i Revised Statutes Sections 92-5. A voice vote was taken of all
Commissioners present, and motion carried with five aye votes.
At 11:14 a.m., the Commission went into executive session. At 1:04 p.m., it was moved by
Commissioner Moses and seconded by Commissioner Henkel that the Commission go out of
executive session. A voice vote was taken of all Commissioners present, and motion carried
with five aye votes.
Chairman Heaukulani called a recess at 1:04 p.m., and the hearing was reconvened for regular
session at 1:08 p.m.

MINUTES
– The Commission had taken this item up at 10:08 a.m. during the hearing for the
Arrow/Rodrigues applications.
Approval of Minutes of the January 7, 2016 meeting and the Site Inspection Minutes of
January 29, 2016 – It was moved by Commissioner Moses, and seconded by Commissioner
Miyasato, that the minutes of January 7, 2016 and the Site Inspection Minutes of January 29,

2016, be approved as circulated. Motion was unanimously carried by a voice vote of all
Commissioners in attendance.
ADMINISTRATIVE MATTERS/ANNOUNCEMENTS -
The Commission took up the
following at 1:13 p.m.
1.Status of applications heard by Windward Planning Commission that are pending before
County Council.
Mr. Arai updated the Commission on two applications that they heard on November 5,
2015. The McClary \[Brad McClary REZ 15-193\] Change of Zone application passed the
Planning Committee level at the County Council and will have two more readings at the
full Council; and the Takehiro \[Minoru, Jr. & Katherine Takehiro SLU 15-043/REZ 15-
194\] State Land Use Boundary Amendment and Change of Zone applications passed
second and final reading at the County Council.
Mr. Arai informed the Commission that they tentatively have four items on their
March 3, 2016 agenda.
ADJOURNMENT
– There being no further business, it was moved by Commissioner Miyasato
and seconded by Commissioner Moses that the meeting be adjourned. Motion was unanimously
carried by a voice vote of all Commissioners in attendance. Chairman Heaukulani adjourned the
meeting at 1:17 p.m.
