HEARING TRANSCRIPT
APRIL 7, 2016
A regularly advertised hearing on the revocation of Special Permit No. 1201 was called to order
at 9:53 a.m. in the County of Hawaii Aupuni Center Conference Room, 101 Pauahi Street, Hilo,
Hawaii with Chairman Charles Heaukulani presiding.
COMMISSIONERS PRESENT: Charles Heaukulani, Donn Dela Cruz, Gregory Henkel, Donald
Ikeda, Myles Miyasato, and Raylene Moses.
ALSO PRESENT: Duane Kanuha (Planning Director), Danny Patel (Deputy Corporation
Counsel for the Windward Planning Commission), Maija Jackson (Staff Planner), Christian Kay
(Staff Planner), Lucas Mead (Staff Planner), Sarah Hata-Finley (Commission Secretary), and
Kim Tanaka (Secretary).
And no one from the public in attendance.
APPLICANT: DIANNE MARITT (formerly THOMAS BROOKMAN & DIANNE
MARITT-BROOKMAN) (Revocation of SPP 1201)
Request to revoke Special Permit No. 1201, which was originally approved on February 21,
2003, to allow a four-bedroom bed and breakfast operation, within an existing single family
dwelling situated within the State Land Use Agricultural District. The property is located on the
Honoka`a side (north) of Kaiwiki Road, approximately 1/4 mile west of its intersection with the
Old Mamalahoa Highway, Wailua, South Hilo, Hawaii, TMK:2-6-013:Por. of 035.
HEAUKULANL And we will now take up Agenda Item No. 4, Dianne Maritt, revocation of
SPP 1201.
JACKSON: Thank you, Mr. Chair. The next item on your agenda is a request that was
submitted by the Applicant, Dianne Maritt, to revoke her Special Permit.
The Special Permit was granted in 2003 to allow a 4 -bedroom bed and breakfast operation, and
the property is located off of WainakuI'm sorry, off of Kaiwiki Road in the South Hilo
District. This property here is the old C. Brewer Building, Headquarters, and then if you go up
Kaiwiki Road, the subject property is outlined in red here.
So, we received the request from Dianne Maritt. She—she said that she has not been operating
the B&B for five years now and no longer wants to keep the permit. The Director is
recommending approval of her request.

HEAUKULANL Thank you. Commissioners, any questions? And, I'm guessing no one signed
up to testify on this one, so I guess I need a motion to close the limited public testimony portion
of this matter.
IKEDA: Move to close public testimony.
HEAUKULANL Thank you, Commissioner Ikeda.
MOSES: Second.
HEAUKULANL Second by Commissioner Moses. Any discussion? If not, all those in favor
signify by saying aye?
COMMISSIONERS: Aye.
HEAUKULANL Opposed? Hearing none, public testimony is closed. Commissioners, could
we get a motion for action on this matter, please?
MIYASATO: I'll make a motion. I move that the application to revoke Special Permit SPP
1201 be approved based on the Planning Director's recommendations and findings which shall
be adopted.
IKEDA: Second.
HEAUKULANL I've got a motion by Commissioner Miyasato; second by Commissioner Ikeda.
Any discussion? Hearing none, all those in favor of the motion, please sigoh, excuse me,
we're kind of steam rolling over that one. If you would please take the vote.
JACKSON: Yes. Commissioner Miyasato?
MIYASATO: Aye.
JACKSON: Commissioner Ikeda?
IKEDA: Aye.
JACKSON: Commissioner Dela Cruz?
DELA CRUZ: Aye.
JACKSON: Commissioner Henkel?
