HomeMy WebLinkAbout2012-10-23 BOR Meeting MinutesTAX BOARD OF REVIEW MEETING MINUTES Appeal Hearings Tuesday, October 23, 2012 West Hawai'i Civic Center Department of Liquor Control Conference Room Kailua-Kona, Hawaii CALL TO ORDER Chairman Albert Kualii called the meeting to order at 9:00 a.m. Present were: Board Members Albert Kualii, Wesley Takai and Michael D'Amico; Deputy Corporation Counsel Craig Masuda; Real Property Tax Appraisal Supervisor Jon Pike and Board Secretary Elizabeth Nina Swain. Absent: Board Member Scott Church STATEMENTS FROM THE PUBLIC There were no statements from the public. TAX APPEAL CASE HEARINGS Note: There were no members from the public present at the start of the appeal case hearings. For each appeal case, the appraiser submitted a packet of information to the Board, unless there had been a prior settlement with the Appellant or withdrawal. If the Appellant was not present, any information sent in by the Appellant was presented to the Board along with the appraisers' packet. CASE #19286, 19315, 19316, 19317, 19318, 19383, 19385, 19386, 19387, 19389, 19391, 19415, 19439, 19420, 19426 & 19433 — MAUNA LANI RESORT (OPERATION) II TM K 6-8-022-001-0000, 6-8-022-022-0000, 6-8-022-023-0000, 6-8-022-027-0000, 6-8-022- 033-0000, 6-8-022-033-0000, 6-8-022-034-0000, 6-8-022-037-0000, 6-8-022-039-0000, 6-8- 022-042-0000, 6-8-022-043-0000, 6-8-022-044-0000, 6-8-022-045-00000, 6-8-022-056- 0000, 6-8-022-058-0000 & 6-9-001-017-0000 Appellant was not present. Appraiser Jaime Ortiz Nava was present for the County. County informed the Board that a settlement agreement had been reached with the appellant. Copies of the agreement was distributed to the Members and attached hereto as Exhibit A. A call for questions was made. Mr. Takai moved to accept the settlement dated October 19 signed by the appellant with the values as listed on page 2 of the settlement letter. Seconded by Mr. D'Amico. A call for discussion was made. Motion passed by a vote of 3:0. SETTLEMENTS — 9:OOA APPEALS AGENDA County presented to the Board a 1 -page Appeals Agenda containing information on two (2) cases that had reached settlement agreements between the County and the respective appellants. A copy of the agenda is attached hereto as Exhibit B. A call for questions was made. No questions presented. Mr. Takai moved to accept the two settlements listed on page 1 of the 9:00 agenda. Seconded by Mr. D'Amico. A call for discussion was made. Motion passed by a vote of 3:0. Recessed: 9:34 a.m. Reconvened: 1:30 p.m. CASE #19519, 19525, 19523, 19517, 19516, 19512, 19507, 19392, 19504, 19537 & 19533 WB KUKIO RESORTS, LLC TMK 7-2-004-016-0000 (4 cases), 7-2-016-002-0000 (2 cases), 7-2-016-003-0019, 7-2-016- 006-0000 (2 cases) & 7-2-016-007-0000 (2 cases) Appellant was not present. Appraiser Jaime Ortiz Nava was present for the County. County informed the Board that a settlement agreement had been reached with the appellant. Copies of the agreement was distributed to the Members and attached hereto as Exhibit C. A call for questions was made. Board questioned the removal of building values for TMK 7-2-004-016-0000. Appraiser Jaime Ortiz Nava responded. Board questioned the building value in Case No. 19523. Appraiser Jaime Ortiz Nava responded. No further questions. Mr. Takai moved to accept the settlements for WB Kukio Resorts as listed in the letter signed by the appellant. Seconded by Mr. D'Amico. A call for discussion was made. Motion passed by a vote of 3:0. 2 SETTLEMENTS — 1:30P APPEALS AGENDA County presented to the Board a 5 -page Appeals Agenda containing information on 33 cases that had reached settlement agreements between the County and the respective appellants. A copy of the agenda is attached hereto as Exhibit D. A call for questions was made. Board questioned the land value as being lower than the rest of the settled land values for Case No. 19234. Appraiser Hoku Manning was present and responded. Board questioned the land value for Case No. 19134. Appraiser Hoku Manning was present and responded. No further questions. Mr. Takai moved to accept the settlements as listed on pages 1 to 5 of the October 23 1:30 p.m. agenda. Seconded by Mr. D'Amico. A call for discussion was made. Motion passed by a vote of 3:0. OLD BUSINESS No discussion held on old business. NEW BUSINESS No discussion held on new business. ANNOUNCEMENTS Mr. D'Amico stated that he will not be present at the complaint hearings scheduled for November 28 in Hilo. Mr. Masuda instructed the Board to send in information for the preparation of their annual report to Secretary Nina Swain. The information will be compiled and a draft will be provided to the Members for their review at the November 28 hearing. Based on the current market analysis of subject property a downward adjustment was required for each parcel and the improvements to reflect the market conditions that are affecting subject property. Please see second page for the breakdown of the recommended assessment. If you accept this settlement offer, I would ask you or your agent to sign the enclosed copy of this letter and return it to me as soon as possible. It will be presented to the Board for approval.
