HomeMy WebLinkAbout2012-11-14 BOR Meeting MinutesTAX BOARD OF REVIEW MEETING MINUTES Appeal Hearings Wednesday, November 14, 2012 West Hawai'i Civic Center Department of Liquor Control Conference Room Kailua-Kona, Hawaii CALL TO ORDER Chairman Albert Kualii called the meeting to order at 9:00 a.m. Present were: Board Members Albert Kualii, Wesley Takai and Michael D'Amico; Deputy Corporation Counsel Craig Masuda; Real Property Tax Administrator Stanley Sitko; Real Property Tax Appraisal Supervisor Jon Pike and Board Secretary Elizabeth Nina Swain. Absent: Board Member Scott Church STATEMENTS FROM THE PUBLIC There were no statements from the public. TAX APPEAL CASE HEARINGS Note: Prior to the start of the afternoon case hearings, Deputy Corporation Counsel, Craig Masuda, advised all Appellants and the Department of the appointment of Board Members as private citizens and volunteers from the community, the procedure the Board would be following for the rendering of their decision, and the Appellants' further right to appeal to the Tax Appeal Court located in Honolulu within 30 days from the date of the decision letter that the appellant will be receiving via certified mail. For each appeal case, the appraiser submitted a packet of information to the Board, unless there had been a prior settlement with the Appellant or withdrawal. If the Appellant was not present, any information sent in by the Appellant was presented to the Board along with the appraisers' packet. CASE #20077 — GRACE, SAMUEL TMK 8-9-003-006-0000 Present were appellant Samuel Grace and Leonard Tanaka, friend of the appellant. Clerical Supervisor June Ban was present for the County. Property located in Milolii, South Kona. Appeal on the denial of homeowner's exemption. Appellant presented his case. County presented their case and recommended sustaining the denial of the homeowner's exemption. A call for questions was made. Mr. Takai moved to grant the homeowner's exemption. Seconded by Mr. D'Amico. A call for discussion was made. Motion passed by a vote of 3:0. CASE #19641 — MCCABE, LARRY TMK 7-4-009-109-0000 Present were appellant Larry McCabe and County appraiser Mary Ann Todd -Waller. Property located on Tomi Tomi Drive in the Kealakehe Homesteads. Appeal on building value. Appellant presented his case. County presented their case and recommended reducing the building value to $745,000 and sustaining the land value. A call for questions was made. Mr. Takai moved to reduce the building value to $525,000 and the land value remain at $200,000 for a total of $725,000. Seconded by Mr. D'Amico. A call for discussion was made. Motion passed by a vote of 3:0. Recessed: 10:02 am Reconvened: 10: 17 am SETTLEMENTS — 9:OOA APPEALS AGENDA County presented to the Board a 2 -page Appeals Agenda containing information on 8 cases that had reached settlement agreements between the County and the respective appellants. A copy of the agenda is attached hereto as Exhibit A. A call for questions was made. Board questioned the reduction of land value for Case #19660. County appraiser Ellsworth Hulihee was present and responded. Board questioned the land value being below appellant's requested value for Case #19396. County appraiser Mary Ann Todd -Waller was present and responded. Board questioned the CPR in Case #19406. Mr. Pike responded. No further questions. Mr. Takai moved to accept the 9:00 settlements for November 14 and for Case #19660 to include the change to Pitt 9. Seconded by Mr. D'Amico. A call for discussion was made. Motion passed by a vote of 3:0. 2 OLD BUSINESS No discussion held on old business. NEW BUSINESS No discussion held on new business. ANNOUNCEMENTS Complaint hearing will be held on November 28 at 9:00 a.m. in Hilo at the Aupuni Center Conference Room.
