23 Robbie Robertson made a motion to approve, and Joel Cohen seconded that motion.
24 All in favor and the motion was carried unanimously.

1.John Mueller stated that after discussion with withdrew the
27
original motion made during the 1/25/16 meeting to allow her to provide clarification
28 then introduced a new
regarding the concerns with the proposed application. Diane
29 motion and Roger Harris seconded the new motion.

Discussion opened up and included discussion with the Aric Arakaki and Rick
31
Gimirkin of the Ala Kahakai National Historic Trail, National Park Service who
32
provided the AC with information regarding the Ala Kahakai Master Plan as well the
33
specific comments made to the Planning Department regarding the proposed project
34
regarding impact to the ala loa and alanui aupuni; scenic and visual considerations;
35
public lateral shoreline access trail; cultural resources and natural resources. Also
36
additional concerns were raised regarding impact to the view of the Bay by the
37
proposed project since it is one of the identified beautiful places in the General Plan
38
and impact of the project to the traffic and wastewater system. The impact of sea level
39
rising was also brought up again this meeting to emphasis the importance of the
40
development analyzing the potential impact to the proposed location of structures.

The Motion was amended to include reference to the identification of Anaehoomalu
42
Bay in the General Plan and the CDP Policy 5.1 and reads as follows:

The South Kohala CDP Action Committee reviewed the request for the Special
44
Management Area Use Permit Application (SMA-15-000061). In reviewing the
45
request the South Kohala CDP, the Action Committee recommends that the Planning
46
Director take into consideration or assure mauka/makai and lateral shoreline access,
47
adequate preservation and protection of historic trails and anchialine ponds, setbacks
48
to accommodate coastal erosion and sea level rising, that the General Plan has
49
identified the Anaehoomalu Bay Area as a Natural Beauty Site, etc. This is based on
50
the SKCDP General Policy No. 1.1, Preserve Cultural and Historic sites and
51
structures; General Policy 2.2, Establish bicycle, pedestrian, and equestrian travel
52
ways to link up the communities within the District (Waikoloa Village, Waimea,
53
Puakō, Kawaihae and the resort nodes) while also establishing alternative travel ways
54
with the individual communities (Appendix H); General Policy No. 5.1, Proposed
55
uses of natural resources shall be duly evaluated by the responsible public entities to
56
ensure that each such use is consistent with the sustainable long-term health of the
57
eco-system, including the direct and indirect impact on coastal waters, General Policy
58
No. 5.5, Preserve visually and environmentally important open space grasslands,
59
ocean views, views of the puu, and South Kohala’s unique “Five Mountain Views: of
60
the Kohala Mountains, Mauna Kea, Mauna Loa, Hualālai, and Haleakala; General
61
Policy No. 5.12 Incorporate the concept of “Sustainability” as defined in the State of
62
Hawai‘i “2050 Sustainability Plan” defines sustainability as a Hawai‘i that achieves
63
the following: Respects the culture, character, beauty and history of our States’ Island
64
communities.”

The motion was passed unanimously.
