Hawaii Police Commission Meeting Agenda September 16, 2016 Page 2 (CLOSED SESSION AT APPROXIMATELY 10:00 A.M.) EXECUTIVE SESSION (Closed to the public.) The commission will meet in executive session to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities; to consider discipline and charges against officers or employees of the Hawaii Police Department; and to consider sensitive matters relating to public safety pursuant to HRS 92-5 (a) (2) (4) (6) and the Hawaii County Charter Section 13-20 (b). (Complaints are briefly summarized.) • Reconsideration of Complaint HPC 16-24: Complainant alleged that it was a violation of her privacy when an officer responded to a request to check on her welfare. The commission found insufficient evidence of misconduct. Complainant requested a reconsideration of the commission's decision. • Consideration and Investigation of Complaints ✓ Complaint HPC 16-20: Complainant alleged that when an officer responded to a call, he was biased and unprofessional. ✓ Complaint HPC 16-21: Complainant complained about the manner in which an officer conducted a traffic stop. ✓ Complaint HPC 16-27: Complainant alleged that her vehicle was illegally searched. ✓ Complaint HPC 16-29: Complainant alleged that an officer's response to her stolen marijuana plant was unprofessional. ✓ Complaint HPC 16-30: Complainant alleged that when he made a complaint, an officer had a conflict of interest. ✓ Complaint HPC 16-31: Complainant alleged that when an officer responded to her complaint, he had a bad attitude and criticized her. ✓ Complaint HPC 16-32A, 16-32B: Complainants alleged that an off-duty officer followed them very closely and aggressively. They also alleged that during the traffic stop the officer used profanity at them and bullied them into agreeing with her. • Consideration of Complaints Received After the 90 -Day Filing Deadline: The Commission will only determine whether to accept or decline investigation. If it is accepted, it will be placed on a subsequent agenda. ✓ Complaint HPC 16-34: Complainant requested an exception to the 90 -day rule because he needed assistance with filing the complaint.
